On May 19, 2023, the Division of Water Resources (Division) received your application requesting a 401 Water Quality
Certification from the Division for the subject project. Additional information in support of the project was received July
29, 2023. The Division has determined that your application is incomplete and cannot be processed. The application is
on -hold until all of the following information is received:
1. The engineering plans and calculations package (including the Supplemental EZ form, cover page) need to be
sealed, signed, and dated by a NC professional engineer.
Please provide copy of any applicable soils report with the associated SHWT elevation where the underground
sand filter is being proposed. In addition, please add the SHWT elevation to the sand filter's profile drawing to
ensure that the required minimum separation between the bottom of the sand filter and the SHWT can be met
(2 feet for open -bottom designs). Note that the Geo report shows that groundwater was encountered at
elevation 2172 for boring pit# P-07 which located toward the east side of the proposed sediment chamber and
adjacent to the sand filter (bottom elevation is 2167). So, we recommend that a more accurate location borings
(2 or 3 within the area proposed for sand filter) be performed to determine the actual SHWT elevation.
3. The O&M plan needs to be signed, dated, and notarized.
Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested information for the
proper consideration of the application. Please provide your response by September 1, 2023. You may provide your
response directly to Chonticha McDaniel (chonticha.mcdaniel@deg.nc.gov) with the 401 & Buffer Permitting Unit. If all
of the requested information is not received, the Division will be unable to approve the application and it will be denied
as incomplete. The denial of this project will necessitate reapplication to the Division for approval, including a complete
application package and appropriate fee.
