The owner hired an engineer and contractor to assist him in the permitting and construction of the crossing. Neither was aware that this crossing
required approval from the USACE and DWR, and were not informed of such until notified by the County. However, they designed the crossing to
cross a straight section of the stream and to avoid the upstream bend in the stream and the downstream bedrock waterfall /cascade.

The construction included erosion and sediment control measures, including sediment basins, check dams, silt fencing, ground cover, etc. that have
been reviewed and deemed in compliance by the County.

As the driveway crossed a stream with a riffle -pool complex and was greater than 25 ft. (2,500 sf) of buffer impacts, approvals from the USACE and
DVVR should have been obtained prior to construction per the conditions of NWP29 and GC3890. The owner and his engineer and contractor were
unaware of these conditions of the NWP & GC. They were not made aware of it until notified by the County. A site meeting was held with the County,
DWR and USACE on May 14, 2015, and the owner agreed to request the after - the -fact permit approval. The owner and his representatives have since
been preparing the attached exhibits and modifying the flood study required by the County for the potential back water flood event conditions.

The project involves a private driveway to a single family home to be built on a 24+ acre property. This is similar to other adjacent rural residential and
farm properties, and is not anticipated to result in cumulative or direct or indirect impacts.

the proposed project, or available capacity of the subject facility.
The property will utilize on -site wastewater (septic system) and will obtain a septic permit from the County.

SHPO HPO -WEB website The driveway enters the property from Bold Run Hill Rd. just north of the James Mangum House (WA1410) surveyed by
SHPO but not listed. The driveway will not impact that property and the house no longer exists, replaced in 2013 with a new house and horse barn.
