The owner hired an engineer and contractor to assist him in the permitting and construction of the crossing. Neither was aware that this crossing required approval from the USACE and DWR, and were not informed of such until notified by the County. However, they designed the crossing to cross a straight section of the stream and to avoid the upstream bend in the stream and the downstream bedrock waterfall /cascade. 1 b. The construction included erosion and sediment control measures, including sediment basins, check dams, silt fencing, ground cover, etc. that have been reviewed and deemed in compliance by the County. 2. The owner and his engineer and contractor were unaware of these conditions of the NWP & GC. They were not made aware of it until notified by the County. A site meeting was held with the County, DWR and USACE on May 14, 2015, and the owner agreed to request the after - the -fact permit approval. The owner and his representatives have since been preparing the attached exhibits and modifying the flood study required by the County for the potential back water flood event conditions. 3.
