(Attn: Ken Jones) please find attached a complete application and supplemental information requesting written concurrence from the U.S. Army Corps of Engineers that the activities proposed below may proceed under Nationwide Permit 18 (impact S1, S2 & W1) & 39 (Impacts W2 and 01), a request for approval to utilize general water quality certification 3890 and a request for an associated buffer authorization from the N.C. Division of Water Resources (NCDWR). The proposed impacts are required to allow for access to and the development of the site into 3 auto dealerships. The wetland area to be impacted is within an existing agricultural field and is of low quality. It appears to have been created by the placement of ditch spoil that has trapped water behind it (see photo). The actual wetland area to be impacted is less than indicated because the upland spoil are adjacent to the ditch is included within the wetland delineation area. This was reviewed onsite with Gary Beecher of the Corps of Engineers. Rather than trying to modify the delineation, the owner prefers to apply for the impacts as mapped and mitigate for them at a 1:1 ratio to expedite the permitting process. The mitigation ratio, confirmation that the ditch being impacted is a ditch and not a jurisdictional stream and nonriparian mitigation type has been field verified by the Corps. The stream impact is to the day lighted section of a stream that receives stormwater discharge from upslope commercial developments. That stream is not buffered (does not show up on soils or usgs maps), and is in a maintained area adjacent to the existing service road (see photo). That is why we are requesting that these impacts be covered by NW18, the remaining impacts are outside the 100 year floodplain and should be covered by NW39. 8c. Page 10 of 10 Impact Justification To U.S. Army Corps of Engineers, or Whom It may Concern I recently purchased 17 acres of the McLean Street property fronting Goldsboro's Industrial Park. I researched several properties during a course of approximately two years, including acreage within the industrial park adjoining this property, acreage situated diagonally across highway 70 from the property selected, as well as some acreage on the west side of Goldsboro proximate to the new by -pass being constructed. All of these properties were available at a substantial discount to the acreage selected. However, after seeking counsel from different folks with varying expertise, and with some exerted pressure from one of the manufacturers, I made the decision to go with the final selected property. The property within the Goldsboro Industrial Park was rejected because the visibility to the public is a problem - pushed too far back from U.S. Hwy 70 and with no frontage on the main highway. The property on the North side diagonally from the property selected was partially fronted by a tree line within a protected area and thus had visibility challenges as well. The third alternative that was rejected, on the west side of Goldsboro had some acreage limitations, but also was being rejected by one of the manufacturers (and others may have also rejected that site) as being not central to the concentrations of vehicle registrations indicate din their market study completed last year. This property is ideal for the requirements of our industry- sufficient acreage to build several dealerships adjacent to each other, but with significant road frontage on the major thoroughfare of Highway 70 for public visibility. It has some road frontage on Oak Forest Road as well, which functions as the entry to McLean Street so as to access this property. The road frontage is actually on McLean Street (a service road) - albeit behind the guard rail and the waterway. The road frontage on McLean Street is the purpose behind this letter of explanation and the reason for my request to you. The N. C. Department of Transportation requires us to maintain a large buffer from the Oak Forest Road, essentially preventing a bottle -neck of traffic turning in so close to the main intersection with U.S. Hwy 70, which means that we need permission to pipe approximately 50 -75 feet of the waterway in several pieces, from near the north -end. The piping is necessary to maintain the water -flow currently occurring in the uncovered drainage ditch when the access drive is constructed across the ditch. This would provide us a North -end entrance to the property, as well as a Southern -end entrance, a requirement because there will be three dealerships. More importantly, the additional entrances are a convenience to the public who will be utilizing McLean Street to enter into the separate dealerships. Our Manufacturer Sales & Service Agreements require us to comply with their established criteria for building size, Customer access and parking spaces dedicated for employee parking, Customer parking, new & used vehicle inventory display areas and service Customer parking, among many other requirements. In general, the building size requirements vary, from approximately 20,000 sq.ft. to 35,000 sq.ft., depending on the manufacture and the sales "planning volume" assigned to our franchise. Our facilities proposed for their review and approval, which is being prepared currently, meet their requirements. I have the documents from Ford Motor Company and from Nissan North America which delineate all of the criteria necessary to receive their building and site approvals, which are necessary before construction begins and requiring a final inspection and approval when all is complete. As a result of complying with the manufacturer site specifics, as well as needing to properly utilize the road frontage for maximum visibility of the new vehicles available for sale along U.S. Highway 70 (refer to the 15S paragraph above outlining the reason for selecting this property over others available), for the Kia dealership that is scheduled for the southern -most section of the McLean Street property, it will necessitate that we provide inventory and Customer parking spaces and road frontage parking for vehicle display (and the Southern -end property access from McLean Street), which is within a wetland designated piece of the property at the Southwest corner of the property. I look forward to an opportunity to discuss the specifics of how we can design and construct passages that will satisfy your requirements (and those of any other affected agencies), and our needs, to expedite approval of our request. The features are labeled "11 -4497 A to 11- 0497 H" on the attached maps and initialed by me on May 25, 2011. The Division of Water Quality (DWQ) has determined that the feature labeled as "11 -0497 A" on the attached maps, and highlighted in hive is subjrrr to the Neuse Buffer Rules. The features labeled as "11 -04W B through 11- 0497 H and 11 -0299 A to 11-02" B" on the attached traps, and highlighted in refi are not subject to the Neuse Buffer Rules. The subject feature is marked on the ground with yellow DWQ flagging and starts at the culvert outlet that crosses under McLain Street and Hwy. 70 and flows down gradient along the east side of McLain Street to the inlet of a second culvert that passes under McLain Street and Hwy. 70. The sabject site is labeled t 1-0497 A (N 35° 22.148' W 77° 55.868'). The second drainage feature is labeled as 11 -0497 B (N 350 21.987' W 77° 55.674') and 11 -0497 C (N 350 22.119' W 77° 55.599') and highlighted in i c on the attached maps. The feature starts at the perennial stream labeled I ] -0497 A and continues up gradient, heading due east for sever hundred feet, and branches off southeast to end at a farm path culvert crossing marked on the ground with yellowing DWQ Buffer flagging. Feature I 1 -0497 C continues northeast from the split and is marked on the ground with yellow DWQ flagging. Please note that drainage features continue past the flagged end point and are considered not subject to the Neuse Riparian Buffer Rules. The third drainage feature labeled as 11 -0299 B to I 1 -0299 C, highlighted in ::.1 on the attached maps, is a separate stream determination conducted in April of 2011. The fifth feature starts at point 11 -0497 F (N 35121.758' W 77° 55.715') adjacent to power lines and continues up gradient northeast to point 11- 0497 G (N 35° 21.917' W 77° 55.205'), marked on the ground with yellow flagging, the drainage feature makes a right hand turn southeast and ends at point 1 1 -0497 H (N 35° 21.779' W 770 55.114') in the far back southeast corner of the field marked with yellow DWQ flagging (see attached maps). Please note that although the subject features highlighted in ,cc are not subject to the Neuse Riparian Buffer rules they may be considered 404 wetlands. It is therefore recommended that the US Army Corp of Engineers be contacted to determine if wetlands exist before any grading or excavation commences on this site. The owner (or future owners) should notify the DWQ (and other relevant agencies) of this decision in any future correspondences concerning this property. 'Ibis on -site determination shall expire five (5) years from the date of this letter. landowners or affected parties that dispute a determination made by the DWQ or Delegated Local Authority that a surface water exists and that it is subject to the buffer rule may request a determination by the Director. A request for a determination by the Director shall be referred to the Director in writing c/o John Domey, DWQ Wetlands/401 Unit, 2321 Crabtree Blvd., Raleigh, NC 27604 -2260. Individuals that dispute a determination by the DWQ or Delegated Local Authority that "exempts" a surface water from the buffer rule may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. Applicants are hereby notified that the 60 -day statutory appeal time does not start until the affected parry (including downstream and adjacent landowners) is notified of this decision. DWQ recommends that the applicant conduct this notification in order to be certain that third party appeals are made in a timely manner. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative I learings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714.
