Trask, Jr. 1202 Eastwood Road Wilmington, NC 28403 Subject: Approved Plan Revision (Revised) Westfall Office Park Stormwater Project No. SW8 990306 New Hanover County Dear Mr. Trask: On March 31, 2005, the Wilmington Regional Office received a plan revision for Stormwater Management Permit Number SW8 990306, Westfall Office Park, and issued an approval on April 7, 2005. The approval letter referenced the incorrect permit number. This approval letter replaces the one dated April 7, 2005. The approved revisions include changes to the drainage area layouts for Ponds 1 & 2 due to the taking of right-of-way for the widening of Military Cutoff Road. The taking created a condition wherein the permitted ponds were available for treatment of runoff, but parts of the drainage areas that had been approved to be treated in the ponds could not be developed. The Division is allowing the taken right-of-way to be swapped for the former New Hanover County Library Site, as long as the new total drainage area and built-upon area for each pond does not exceed that which was previously permitted: Pond 1 had a net reduction in drainage area of 1.07 acres; Pond 2 added a portion of the former New Hanover County Library Site and deleted portions of Tracts C1 and B-1 R that were taken for right-of-way, for no net change in drainage area. The area that comprises Tract C3 (Recombination) must be made subject to the deed restrictions previously recorded on January 31, 2000, in DB 2698 at Pages 0030-0046. It has been determined that a formal permit modification is not required for the proposed changes. We previously forwarded you a copy of the revised drainage area plans approved on April 7, 2005, for your files. Please replace the old approved drainage area sheet with the new one dated April 7, 2005. Please be aware that all terms and conditions of the permit issued on April 10, 2001, remain in full force and effect. Please also understand that the approval of this revision to the approved plans fqr the subject State Stormwater Permit is done on a case-by-case basis. Any other changes to this project must be approved through this Office prior to construction. The issuance of this plan revision does not preclude the permittee from complying with all other applicable statutes, rules, regulations or ordinances which may have jurisdiction over the proposed activity, and obtaining a permit or approval prior to construction. The project site has been created by combining four (4) existing lots within Westfall Office Park and one (1) additional lot that is not within Westfall Office Park. The four (4) lots within Westfall Office Park are referenced as Tract C1, Tract C2, Tract C3 and Tract C4 as shown on the enclosed survey and plans. The additional lot that is not within Westfall Office Park is referenced as the New Hanover County Library site as shown on the enclosed survey and plans. Therefore, the project site will be approximately 4.76 acres after combining the following lots as mentioned above: • Tract C1 —Westfall Office Park: 0.22 Acres • Tract C2—Westfall Office Park: 1.00 Acre • Tract C3—Westfall Office Park: 1.07 Acres • Tract C4—Westfall Office Park: 1.34 Acres • New Hanover County Library Site: 1.12 Acres • Total Project Site: 4.76 Acres Per Recombination Survey Enclosed The New Hanover County Library site is not currently part of Westfall Office Park project area or drainage area to the existing Westfall Office Park stormwater ponds. However, due to the North Carolina Department of Transportation acquiring additional right-of-way from Westfall Office Park sites and acquiring additional right-of-way from the New Hanover County Library site, we are proposing to add the subject site to the Westfall Office Park Pond 1 and Pond 2 drainage area. The Westfall Office Park Pond 1 and Pond 2 drainage areas have been reduced due to NC DOT acquiring additional right-of-way for roadway improvements on Military Cutoff Road / SR 1409. The New Hanover County Library site can be added to the Westfall Office Park Pond 1 and Pond 2 drainage areas due to NC DOT acquiring the additional right-of-way. A revision to the existing Westfall Office Park State Stormwater Permit SW8 990306 permits will be required per a meeting with Linda Lewis and correspondence enclosed. Additional information on the revised Pond 1 and Pond 2 drainage areas and required permit revisions will be provided in following sections of the narrative. The project site abuts two (2) existing City roads which are Sir Tyler Drive and Ashes Drive and one (1) existing NC DOT road which is Military Cutoff Road / SR 1409. Site access will be provided to both City roads. The project will include one (1)three story office building with paved parking and access as shown on the enclosed plans. EROSION CONTROL INFORMATION AND MEASURES: Approximately 5.90 acres of the project site, Sir Tyler Drive right-of-way and Ashes Drive right-of- way will be disturbed to construct the proposed building and onsite and offsite improvements. zIitp Approximately 0.35 acres of the NC DOT right-of-way will be disturbed to install a new control access fence and for selective vegetation removal as shown on the enclosed plans. Therefore, the total project disturbed area will be approximately 6.25 acres. The existing New Hanover County Land Disturbing Activity/ Grading Permit No. GP 78-98 is being revised for the proposed project. The permit revision will include the additional disturbed area associated with the New Hanover County Library site and transfer ownership and the financial responsibility of the project site and project disturbed area to FNB Properties, LLC. The enclosed plans and specifications give the requirements for erosion control measures. Silt fence shall be installed as shown on the plans. Erosion control measures will be installed around the inlets as shown on the plans to trap silt during construction. Inspect the erosion control around the inlets after each rain and make repairs as needed. Remove sediment as necessary to provide adequate storage volume for subsequent rains. When the contributing drainage area has been adequately stabilized, remove all materials and any unsuitable soil and either salvage or dispose of it properly. Bring the disturbed area to proper grade, then smooth and compact it. Appropriately stabilize all bare areas around the drop inlets. Temporary graveled construction entrances will be installed as shown on the plans. Maintain the gravel construction entrances in a condition to prevent mud or sediment from leaving the site. The contractor shall inspect the construction entrance on a daily basis. This may require periodic top dressing with additional stone. Any objectionable materials spilled, washed, or tracked onto public roadways shall be removed immediately. STORMWATER MANAGEMENT INFORMATION AND MEASURES: Land disturbing on the site will exceed one (1) acre, which requires the site to comply with the State Stormwater Regulations. The site will also be required to comply with a portion of the City of Wilmington Stormwater Ordinance for stormdrain pipe sizing. The City of Wilmington Stormwater Ordinance requires that the stormdrain pipes be sized for the 10-year storm and checked for the 50-year storm. StormCAD stormdrain pipe calculations are attached or enclosed for the 10-year storm and the 50-year storm. A 75% tailwater condition has been assigned at the outlet for the stormdrain pipes draining to Pond 1 and Pond 2. The remaining portion of the narrative will focus on the State Stormwater Regulations. The stormwater runoff from the project site drains to two (2) existing stormwater ponds permitted under Westfall Office Park State Stormwater Permit No. SW8 990306. The two (2) existing stormwater ponds are referenced in Westfall Office Park State Stormwater Permit No. SW8 990306 as Pond 1 and Pond 2. The impervious area for each drainage area is based on 85% of the lot area plus the roads associated with Westfall Office Park. The existing Westfall Office Park drainage area to Pond 1 and Pond 2 traverse,the project site as shown on the enclosed plans. The drainage area to Pond 1 and Pond 2 is being revised to include an additional site referenced as the New Hanover County Library site due to NC DOT acquiring additional right-of-way from the existing Wesffali Office Park sites for roadway improvements on Military Cutoff Road / SR 1409. See the enclosed plans, calculations, stormwater permit application, and stormwater pond drainage area exhibit plan for additional information. Stormwater runoff from the project site including the building roof area will be collected and directed to the appropriate revised Pond 1 and Pond 2 drainage area and drainage system. The project site is allowed 85% impervious coverage. The total impervious coverage for the project site is 70.00% or 143,930 .30 Acres. Deed restrictions are being prepared for the project site and will be submitted upon receipt from the owner's attorney. CONSTRUCTION SEQUENCE: The contractor will install the gravel construction entrances and new silt fence prior to beginning any grading operations. Disturbed areas will be landscaped or seeded upon completion in accordance with the specifications attached. Can you leave the file up front 0, for us to review today or Monday? The attorney is on standby to prepare the revise document. 2. The current permit for Westfall does not list a breakdown of lots for each pond. It only lists a total impervious which is referenced as the lots at 85%. I can not find anything that lists the individual lots at 85% and Tunstall does not seem to remember. The permit also lists the road impervious area for each pond which may not change. So, I have the drainage area to each pond 1 and pond 2 and the amount of road impervious area that will not change. I can figure the remaining developable area based on the DA reduction and restrict it to 85% or whatever it is as long as we do not exceed the impervious total permitted for each pond. Pond 2 drainage area ended up being the same total as it was originally permitted, so does that one even need revising? To complicate things further my new lot for the office building is split into two drainage areas to pond 1 and pond 2. I am confused! Can you provide any direction? Please note that the revision could not be submitted until the I was done with the The Tricoast Office Building design due to the existing and revised Pond 1 and Pond 2 Drainage area line splitting the site and the building. It was very complicated to grade the site and direct the building roof runoff to the appropriate pond. The design governed the exact location of the revised drainage area line which is essentially the same on the site as what is currently permitted. I had to swap out an equal size area on the site from each drainage area to get the grades to work based on the site and building configuration. The main drainage area revision is due to NC DOT acquiring additional right of way which allowed adding the Library Site. Pond 1 drainage area has been reduced and Pond 2 drainage area ended up remaining the same. The application includes a letter from the Corps of Engineers (USACE)indicating that there are waters of the U.S.on the site. However,there is no signed survey(or other mapping)to indicate that the areas for proposed impact are the same areas identified by the Corps of Engineers during their site visit. The application does include a letter dated December 22,2003 from Mr. Jim Spangler from Spangler Environmental,Inc.to Ms.Angie Pennock of the USACE detailing the areas that she determined the waters of the U.S. during her site visit. However,the letter appears to identify an area of jurisdictional waters that are presently authorized as an onsite stream mitigation site for the NC Department of Transportation's Military Cutoff Road widening project. The letter makes no reference to the 2 drainage features that drain to the referenced stream segment(i.e.the proposed DOT mitigation site) and are proposed for impact with the application. This decision is based on the information you provided at our meeting where you indicated that the former library lot was just barely over an acre in size after the taking of right-of-way, and could easily have disturbed less than 1 acre, and not been required to submit for state stormwater. A hardship was created when the DOT imposed controlled access on Military Cutoff, which landlocked the former library lot. If either of these conditions is not the case, this agreement is null and void. The office park is across Military Cutoff from Mayfaire, and drains to Howe Creek. The permit for Westfall was issued prior to rescission of the 4th Directive regarding the chlorides testing for SA waters. Based on the chlorides test, which indicated freshwater 1/2 mile downstream from the project, the project was permitted for 4 detention ponds. The ORW waters of Howe Creek had been determined to be "freshwater", and therefore subject to NCAC .1007 (1) (b) , which allows wet detention ponds, and does not require low density within 575' . Military Cutoff is being widened. NCDOT took a large swath of right-of-way in front of the permitted office park, and has established controlled access. This right-of-way is within the permitted drainage area of Westfall's ponds. A 2.1 acre tract of land fronting Military Cutoff was excluded from the Westfall project area because it had been donated to the County for a new library. The County ended up selling the lot and using another tract for the library. Access to the 2.1 acre former library lot was cut off by the taking of the ROW, reducing the tract acreage to 1.125 acres. The group that John Tunstall represents would like to bring in the former library lot to the drainage area for this permit and exclude the right-of-way (over 2 acres) that was taken and which will not be draining to the permitted ponds. The former library lot would be added to other lots that they currently own in the office park to create one development, all draining to the previously permitted ponds. The total drainage area and built-upon area will be reduced from what was permitted. All of the drainage from the development will drain to ponds that currently exist under the permit. Problems arise in the re-permitting of the wet ponds due to the fact that if the project were getting a new permit today, we would require infiltration and low density within 575' of Howe Creek. If we don't revise the permit to include the former library site, it could conceiveably disturb less than 1 acre and not be required to get a permit from us (i.e. , no water quality treatment at all, with runoff going directly into Howe Creek) . If we revise the permit to allow the swap of drainage area, and keep the wet ponds, we will at least have gotten treatment of an area that would not have been subject to state stormwater requirements, otherwise. Because of the hardship created by the controlled access, I am seeking your concurrence that a plan revision is the best option. All parameters of the permit remain the same, except that the BUA is laid out differently, or in this, the drainage area boundary will change to exclude one area and bring in another. The surface area of the existing pond may not be expanded to accommodate this modification. The Division will allow a slight change to the temporary storage elevation to accommodate minor volume increases, due to the larger drainage area, if necessary. Hopefully, the pond as currently exists will accommodate the new drainage area without any modification at all. Additionally, the deed restrictions for the development within the new drainage area will need to be tied into the existing project. I'm not 101 exactly sure what the intent is here, but I will assume that the new drainage area to be added is an expansion of the same project and will .1117 be considered another phase of the project, therefore, it can be made subject to the same master restrictions and covenants that should be in place for the existing development. Since the currently permitted BUA's will be changing, be sure to include a copy of the amended covenants when you submit the application. They reduced the BUA on the single family lots that were already a part of the drainage area by an amount sufficient to cover the new BUA from the retirement center.
