This request was submitted in a letter received by DCM on July 25th, 2023 with two (2) drawings, labeled "Existing Structures", and "Proposed Gazebo', dated as received by DCM on July 20, 2023. The applicant was issued State Permit No. 51-22, which was originally issued on May 16, 2022 for the expansion of an existing gazebo of an existing docking facility_ State Permit No. S 1-22 is due to expire on December 31, 2025. The applicant is requesting a minor modification to the permit to allow for the replacement of the existing access pier (---200' x 6'), covered landward gazebo (reduced to 13' x 6') and the existing waterward gazebo (-22' x 13'). The applicant is requesting this modification to replace the existing structures while they are in the process of expanding and constructing the new area of gazebo permitted under State Permit 51-22. The landward gazebo that is currently 13' x 13' will be reduced to 13' long x 6' wide since it is located over coastal wetlands, to reduce any shading impacts. There is no other change to the footprint being requested at this time. The applicant has notified the adjacent riparian property owners via certified mail and received signatures of no objection. The proposed modifications appear to be consistent with NCAC 07H .0208(b)(6), which includes the specific use standards for piers and docking facilities. This office has no objection to the modification of State Permit No. 51-22, provided it is consistent with all other local, state, and federal regulations. St. James Plantation has submitted a check (check No. 100389) in the fee amount of $100. By copy of this memo, DCM is requesting that the USACE, NC DWR, and the Brunswick County LPO provide any comments that your agency may have on the proposed Project to Cameron Luck of DCM's Morehead City office within 14 days of receipt of this memo.
