Specifically describe measures taken to avoid or minimize the proposed impacts in designing project. The applicant requested a detailed delineation of streams and wetlands prior to site plan development in order to determine the extent and location of streams and wetlands in the vicinity of the proposed crossings. The subject site contains jurisdictional wetlands and streams. The site plan (for Phase 2) has limited permanent impacts to a road crossing of perennial /important stream. Individual streams are not crossed multiple times by roads. The proposed road crossing is necessary in order to provide the primary access to Phase 2 from the existing development and main entrance. A secondary access was also required by the City of Raleigh. This access will be provided via a connection to Myra Road. These are the only two access points available to Phase 2. Additionally, headwalls have also been utilized to minimize the footprint of the roadway crossing impacts. 1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques. The development will obtain all necessary permits from the City of Raleigh to include a land disturbance permit which will include an erosion and sediment control plan during construction. The development will also obtain a stormwater management plan to protect downstream waters from post- construction stormwater runoff. 2. On October 10, 2013, the applicant's agents, USACE and City of Raleigh met to discuss the need for the western most proposed road crossing. The City agreed that the applicant did not need to construct this road crossing. As such, the request for this road crossing has been removed from this application and the requested impacts are below mitigation thresholds. 4. The NC- Natural Heritage Programs GIS Dataset was used to search for elemental occurrences of state and federally protected species in the vicinity of the project. There are no Federally listed Endangered Species within the 2 -mile radius search of the project center. Since the approval of Phase 1 of the development, the Northern Long -eared Bat (NLEB) has been added to the endangered and threatened species list. There are no known occurrences of NLEB on the property, but we understand from NHP and FWS, that there have been recorded sightings of the NLEB in Wake County. As such, we understand that the USACE will submit this application to the FWS for concurrence. We should note that any clearing associated with the impacts requested within this application will not occur until outside of the pup season (June 1 to July 315) 6.
