Dear Mr. Alsmeyer:
Angler Environmental is pleased to present the following Preconstruction Notification application
on behalf of Lakefield Farm, LLC. The proposed project includes the construction of a gravity
sewer outfall located within an approximately 3 -acre easement at 4580 Rivermont Road, in
Durham, Durham County, North Carolina (PIN 0813- 01 -07- 8788). The proposed sewer outfall
will service future residential development located adjacent to the project site at 3600 and 3601
Valley Springs Road Road (PINs 0813 -01 -28 -8143 and 0813 -01 -27 -6061) as shown in Figure 1.
At this time there are no site plans for the future residential development.
Based on anticipated jurisdictional impacts, this project will qualify for Section 404 authorization
under the U.S. Army Corps of Engineers (USACE) Nationwide Permit 12 (Utility Line Activity),
the associated General Water Quality Certification #3884, and a Buffer Authorization from the
N.C. Division of Water Resources.
The project site is best characterized as an undeveloped, forested property. The proposed work
includes the installation of approximately 430 linear foot of 8" gravity sewer main that will
connect to an existing sanitary sewer main west of the subject property.
The subject property was delineated by Angler Environmental on April 10, 2015 in accordance
with the methodology outlined in the 1987 Corps of Engineers Wetlands Delineation Manual
and the Regional Supplement to the Eastern and Piedmont Regions, Version 2.0. All Waters of
the U.S. present on the subject property are located within the Neuse River Basin (Hydrologic
Unit Code 03020201). One perennial channel flows west through the proposed sewer main
corridor. Three wetland areas (WA, WB, and WF) are present north of S2 within the floodplain.
No other Waters of the U.S. (WOUS) were observed during this course of the investigation on
3601 Valley Springs Road, 3600 Valley Springs Road, or within the proposed gravity sewer line
corridor at 4580 Rivermont Road.
All work for the proposed sanitary sewer line will take place within a 30 foot permanent
easement. The proposed sewer line was designed to minimize impacts by crossing the stream
at a perpendicular angle. In addition, the stream crossing will be completed by a suspended

sanitary sewer main located above the ordinary high water mark and will not result in permanent
impacts to the stream channel. Contractors will minimize impacts to adjacent areas by utilizing
silt fencing along the construction corridor. In addition, tree protection fencing will be utilized
throughout the project.

This document confirms that Lakefield Farm, LLC (Applicant) for the Vallev Springs Sewer Outfall
(Project) has expressed an interest to utilize 1,255.50 Square Feet of Riparian Buffer Mitigation
Credits from either of the EBX sponsored Banks: EBX Neuse Riparian Buffer Umbrella Mitigation
Bank, EBX -EM Forrest Creek Riparian Buffer Mitigation Bank, or EBX Upper Neuse Riparian Buffer
Umbrella Mitigation Bank. All of these bank sites are located in IIUC 03020201. As the official Bank
Sponsor, EBX, attests to the fact that mitigation is available for reservation at this time.
These mitigation credits are not considered secured, and consequently are eligible to be used for alternate
purposes by the Bank Sponsor, until payment in full is received from the Applicant resulting in the
issuance of a Mitigation Credit Transfer Certificate by the bank acknowledging that the Applicant has
fully secured credits from the bank and the Banker has accepted full responsibility for the mitigation
obligation requiring the credits /units.
The Banker will issue the Mitigation Credit Transfer Certificate within three (3) days of receipt of the
purchase price. Banker shall provide to Applicant a copy of the Mitigation Credit Transfer Certificate and
a documented copy of the debit of credits from the Bank Official Credit Ledger(s), indicating the permit
number and the resource type secured by the applicant. A copy of the Mitigation Credit Transfer

This on -site determination shall expire five (5) years from the date of this letter. Landowners or affected parties that
dispute a determination made by the DWR or Delegated Local Authority may request a determination by the
Director. An appeal request must be made within sixty (60) days of date of this letter or from the date the affected
party (including downstream and /or adjacent owners) is notified of this letter. A request for a determination by the
Director shall be referred to the Director in writing c/o Karen Higgins, DWR 401 & Buffer Permitting Unit, 1617
Mail Service Center, Raleigh, NC 27699.
This determination is final and binding unless, as detailed above, you ask for a hearing or appeal within sixty (60)
days.
The owner /future owners should notify the Division of Water Resources (including any other Local, State, and
Federal Agencies) of this decision concerning any future correspondences regarding the subject property (stated
above), This project may require a Section 404/401 Permit for the proposed activity. Any inquiries should be

Anna: I apologize for the delay in getting back to you. I am OK with doing a desktop Jurisdictional Determination (JD) for
this one, unless you have specific questions that need to be addressed in the field. Because of the backlog of JD's that I
have, it will likely be quite some time before I can get you a written Preliminary JD verification. It will expedite things if
you submit a request for Nationwide General Permit (NWP) verification based on your submitted Preliminary JD, once
you know the impacts, and you will get the NWP verification pretty quickly (usually within 45 days), since permits have
priority over J D's.

Dear Mr. Alsmeyer,
Hope you are doing well this afternoon. Angler Environmental would like to request a Preliminary Jurisdictional
Determination on behalf of Pinpoint Properties and Lakefield Farm, LLC for the approximately 37 -acre property located
at the intersection of Valley Springs Road and Rose of Sharon road in Durham, Durham County, North Carolina.
The subject property is comprised of three parcels including 3600 Valley Springs Road, 3601 Valley Springs Road, and an
approximately 3 -acre portion of 4580 Rivermont Road to be utilized for a gravity sewer connection. Site reconnaissance
was performed on April 10, 2015. Based on our site visit, one perennial stream and three jurisdictional wetlands were
delineated within the proposed sewer corridor. One ephemeral stream is located at the southern boundary of the
property at 3601 Valley Springs Drive. No other Waters of the U.S. are located on the subject property.
