Location description: The proiect site is located on a tract of land (PIN 8609-96-4882) known as Town of Maggie Valley
Wastewater Treatment Plant at 5320 Jonathan Creek Road in Maggie Valley, Haywood County, North Carolina.
Description of projects area and activity: This permit verification authorizes 197 linear feet (0.039 ac) of permanent
stream impacts to Jonathan Creek associated with maintance to existing bank stabilization. 29.59 Linear feet (0.017
acre) of temporary stream impacts for the installation of coffer dams and construction access, and 167.70 linear feet
(0.097 ac) of temporary stream impact for dewatering. Instream work shall not be concudcted during Trout
Moritorium (October 15 — April 15).

Your work is authorized by the above referenced permit provided it is accomplished in strict accordance with the
attached conditions, above noted special conditions, and your submitted application and attached information dated
July 21, 2023. Any violation of the attached conditions or deviation from your submitted plans may subject the
permittee to a stop work order, a restoration order, a Class I administrative penalty, and/or appropriate legal action.
This verification will remain valid until the expiration date identified below unless the nationwide/regional authorization is
modified, suspended or revoked. If, prior to the expiration date identified below, the nationwide/regional permit authorization
is reissued and/or modified, this verification will remain valid until the expiration date identified below, provided it complies
with all requirements of the modified nationwide/regional permit. If the nationwide/regional permit authorization expires or is
suspended, revoked, or is modified, such that the activity would no longer comply with the terms and conditions of the
nationwide/regional permit, activities which have commenced (i.e_, are under construction) or are under contract to commence
in reliance upon the nationwide/regional permit, will remain authorized provided the activity is completed within twelve months
of the date of the nationwide/regional permit's expiration, modification or revocation, unless discretionary authority has been
exercised on a case -by -case basis to modify, suspend or revoke the authorization.
Activities subject to Section 404 (as indicated above) may also require an individual Section 401 Water Quality Certification.

GENERAL NOTES:
1. EXISTING 8ITE CONDITIONS: THE CONTRACTOR SHALL FAMILIARIZE THEMSELVES AS TO THE EXISTING SITE CONDITIONS
PRIOR TO BIDDING THE PROJECT. THE CONTRACTOR SHALL BE RESPONSIBLE FOR MAINTAINING A WORKABLE SITE
CONDITION DURING THE EXECUTION OF THIS CONTRACT, THE CONTRACTOR SHALL DOCUMENT EXISTING CONDITIONS
UTILIZING PHOTOGRAPHIC AND/OR VIDEOGRAPHIC MEANS, AND SHALL FURNISH THE OWNER WITH SUCH DOCUMENTATION
ON SUITABLE MEDIA (DVD, USB DRIVE, ETOI, AND SHALL BE RESPONSIBLE FOR RESTORING ALL DISTURBED AREAS TO
ORIGINAL DR SATISFACTORY CONDITIONS AS APPROVED BY THE OWNER REASONABLE CARE SHALL BETAKEN DURING
CONSTRUCTION TO AVOID DAMAGE TO VEGETATION. ORNAMENTAL SHRUBBERY AND TREE BRANCHES SHALL BE
TEMPORARILY TIED BACK, WHERE APPROPRIATE, TO MINIMIZE DAMAGE. TREES THAT RECEIVE DAMAGE TO TREE
BRANCHES SHALL BE TRIMMED OF THOSE BRANCHES TO IMPROVETHE APPEARANCE OF THE TREE. TREETRUNKS
RECEIVING DAMAGE FROM EQUIPMENT SHALL BE TREATED WITH A TREE DRESSING. TAKE PROPER PRECAUTIONS NOT TO
DISTURB EXISTING PROPERTY CORNERS. IF NECESSARY, CONTRACTOR TO BE RESPONSIBLE FOR HIRINGA REGISTERED
LAND SURVEYOR TO COMPLETE THIS WORK, TO REMOVE AND RESET PROPERTY IRONS.
2. PIPE SEPARATION: THE FOLLOWING MINIMUM PIPE SEPARATIONS WILL BE MAINTAINED: 18 INCHES VERTICAL SEPARATION
BETWEEN CROSSING OF SANITARY SEWER (INCLUDING FORCE MAIN) AND WATER MAIN, AND 10 FEET HORIZONTAL
SEPARATION BETWEEN SANITARY SEWER (INCLUDING FORCE MAIN) AND WATER MAINS. IF THESE SEPARATIONS CANNOT
BE MAINTAINED, DUCTILE IRON PIPE WILL BE USED 10 FEET EITHER SIDE OF CROSSING AND ALONG ENTIRE LENGTH OF
LINE LESS THAN 10 HORIZONTAL FEET OR 13 INCHES VERTICAL SEPARATION FROM WATER MAINS. THE CONTRACTOR
SHALL RECEIVE APPROVAL FROM THE ENGINEER IN THE FIELD BEFORE PAYMENT WILL BE MADE AT THE DUCTILE IRON
PRICES.
3. SEDIMENTATION AND EROSION CONTROL: THE CONTRACTOR SHALL COMPLY WITH ALL APPLICABLE PROVISIONS OF THE
SEDIMENTATION POLLUTION CONTROL ACT. THE CONTRACTOR SHALL BE RESPONSIBLE FOR INCORPORATING
CONSERVATION PROCEDURES NECESSARY TO COMPLY WITH THIS ACT IN MINIMIZING EROSION AND SEDIMENT POLLUTION
ASSOCIATED WITH THE CONSTRUCTION OF THIS PROJECT AS SHOWN AND AS DIRECTED BY THE ENGINEER.
4. MATERIALS, TOOLS, TESTING: THE CONTRACTOR SHALL FURNISH ALL THE NECESSARY MATERIALS, APPARATUS, TOOLS,
MACHINERY, AND LABOR. MATERIALS AND APPARATUS SHALL BE NEW AND THE BEST OF THEIR RESPECTIVE KINDS, AND
SHALL BE SUBJECT TO SUCH STANDARD TESTS AS THE OWNER MAY SELECT IN DETERMINING THE FITNESS AND
DURABILITY OF THE MATERIALS AND APPARATUS TO BE FURNISHED. THE TOOLS AND MACHINERY SHALL BE SUITABLE
FOR THE PURPOSE INTENDED, AND IN GOOD WORKING ORDER WITH NO OIL, COOLANT OR HYDRAULIC FLUID LEAKS. ALL
LABOR SHALL BE PERFORMED IN AN EXPEDITIOUS, THOROUGH, WORKMANLIKE MANNER: ALL IN ACCORDANCE WITH
THESE SPECIFICATIONS, THE ACCOMPANYING DRAWINGS, AND SUBJECT TO THE APPROVAL OF THE OWNER.
5. DEFECTIVE MATERIALS: SHOULD ANY OF THE MATERIALS, WHEN DELIVERED UPON THE LOCATIONS OF THE WORK,13E
FOUND DEFECTIVE OR NOT IN ACCORDANCE WITH THESE SPECIFICATIONS OR ACCOMPANYING DRAWINGS, THEY SHALL
BE IMMEDIATELY REPLACED BY THE CONTRACTOR, OTHERWISE THE OWNER OR ENGINEER MAY CAUSE THE SAME TO BE
REMOVED AT THE CONTRACTOR'S EXPENSE.
6. CHANGESTO ACCOMMODATE MATERIALS AND EQUIPMENT TO BE PROVIDED: THE CONTRACTOR SHALL PROVIDE
MATERIALS AND EQUIPMENTTO FIT AND. BE CAPABLE OF USE AND/OR OPERATION WITHIN THE STRUCTURE DIMENSIONS
SHOWN. IF MATERIALS AND EQUIPMENT PROVIDED BY THE CONTRACTOR REQUIRE CHANGES IN HIS WORK, THE
CONTRACTOR SHALL MAKE THE REQUIRED CHANGES AT HIS EXPENSE AND SHALL BE RESPONSIBLE FOR ALL ADDITIONAL
EXPENSE OF THE ENGINEER INCURRED BY THE OWNER AT ACCOMMODATE THE CHANGES.
7. SUBSURFACE INVESTIGATION AND GEOTECHNICAL REPORT: THE CONTRACTOR SHALL FAMILIARIZE HIMSELF AS TO THE
EXISTING SITE CONDITIONS PRIOR TO BIDDING THE PROJECT, NO SUBSURFACE INVESTIGATION OR GEOTECHNICAL
REPORT IS PROVIDED.
8, OSHA: CONTRACTOR SHALL COMPLY WITH CURRENT OSHA REGULATIONS.
9. INSTALLATION: THE CONTRACTOR SHALL PROVIDE TEMPORARY ACCESSTOTHE CONSTRUCTION SITE DURING
INSTALLATION. ALL WORK ASSOCIATED WITH PROVIDING ACCESS SHALL ALSO INCLUDE ANY ASSOCIATED ELECTRICAL
COSTS, FENCE INSTALLATION, NECESSARY FILL MATERIAL, DRIVEWAY CULVERTS, NECESSARY SILT FENCING, AND ALL
FINAL GRADING AND SEEDING ON THE SITE UNLESS OTHERWISE NOTED.
10. TEMPORARY UTILITIES: CONTRACTOR SHALL BE RESPONSIBLE FOR OBTAINING ALL TEMPORARY UTILITIES NECESSARY
TO PERFORM THE CONSTRUCTION.
NOTES:
• THE CONTRACTOR SHALL TEMPORARILY MOVE UNDERGROUND UTILITIES WHEN THE UTILITY CAN BE MOVED OUT OF THE
WAY OF ACTIVE CONSTRUCTION ACTIVITY WITHOUT DAMAGING THE UTILITY. WHERE THIS CANNOT BE ACCOMPLISHED,
THE CONTRACTOR SHALL NOTIFY THE TOWN ENGINEER IMMEDIATELY AND SHALL WORK WITH THE OWNER AND THE
AFFECTED UTILITY COMPANY TO DEVELOP A PLAN OF ACTION. WHERE ADDITIONAL WORK IS REQUIRED BY THE
CONTRACTOR, THE CONTRACTOR SHALL SUBMIT A CHANGE ORDER FOR APPROVAL BY THE OWNER PRIOR TO
COMMENCING CORRECTIVE ACTIONS.
• THIS DOES NOT RELIEVE THE CONTRACTOR FROM LIABILITY RELATED TO DAMAGED UTILITIES OR INTERRUPTION OF
SERVICE AS WRITTEN IN BELOW, AND IN THE CONTRACT DOCUMENTS.
11, COMPACTION OF TRENCHES: ALL TRENCHES SHALL BE COMPACTED TO A MINIMUM OF 95% OF MAXIMUM DENSITY IN
TOWN AND NCDOT RIGHTS OF WAY TO WITHIN 12' OF FINISHED GRADE. DENSITY TESTS SHALL BE PAID FOR BY THE
CONTRACTOR. ALL TRENCHES FOR ROAD CUTS WILL BE COMPACTED BY MECHANICAL MEANS,
12. SEEDING AND MULCHING: PAYMENT FOR SEEDING AND MULCHING THE AREAS DISTURBED WRING CONSTRUCTION SHALL
BE INCLUDED IN THE PRICE ESTABLISHED IN THE BID.
13. DRIVEWAY REPLACEMENT: THE CONTRACTOR WILL BE REQUIRED TO REPLACE ANY EXISTING GRAVEL, CONCRETE,
ASPHALT OR PAVERS THAT HAVE TO BE REMOVED AND REPAIR THESE SECTIONS TO ORIGINAL OR BETTER CONDITION.
14. SUBMITTALS: THE CONTRACTOR SHALL OBTAIN WRITTEN APPROVAL FOR ALL SHOP DRAWINGS AND SUBMITTALS FROM
THE ENGINEER PRIOR TO BEGINNING ANY INSTALLATION WORK.
15. SHOPDRAWINGS: SHOP DRAWINGS SHALLBE SUBMITTED FOR ALL PRECAST STRUCTURES, METAL CASTINGS INCLUDING
HATCHES, MANHOLE RINGS AND COVERS, VALVE BOXES, AND CATCH BASIN FRAMES AND GRATES; ROLLED EROSION
CONTROL PRODUCTS, AND GEOTEXTILES. MANUFACTURERS CERTIFICATIONS SHALL BE SUBMITTED TO THE ENGINEER
CERTIFYING THATALL PUMPS AND PIPE MEETS THE PROJECT SPECIFICATIONS. CONCRETE MIX DESIGNS, THE DETAIL
SPECIFICATIONS AND BITUMINOUS CONCRETE PLANT MIX DESIGNS OF THE DETAIL SPECIFICATIONS SHALL BE SUBMITTED
TO THE ENGINEER FOR APPROVAL. NONE OF THE ABOVE LISTED MATERIALS SHALL BE USED ON THE PROJECTS UNLESS
THE ENGINEER HAS GIVEN THE NECESSARY APPROVAL FOR THAT PARTICULAR MATERIAL. THE CONTRACTOR SHALL
SUBMIT ALL SHOP DRAWINGS,CERTIFICATIONS, AND MIX DESIGNS REQUIRED WITHIN THIS CONTRACT.
16, AS -BUILT DRAWINGS AND SPECIFICATIONS AT THE JOB SITE: THE CONTRACTOR SHALL MAINTAIN, IN READABLE
CONDITION AT THE JOB SITE, ONE COMPLETE SET OF WORKING DRAWINGS AND SPECIFICATION FOR THE WORK,
INCLUDING ALL SHOP DRAWINGS. SUCH DRAWINGS AND SPECIFICATIONS SHALL BE AVAILABLE FOR USE BY THE OWNER
OR ITS REPRESENTATIVE ATALL TIMES. THIS SET SHALL BE MARKED, OR NCTES ACCEPTABLE TO THE ENGINEER
