Mrs. Stilley said she thought she noticed some discharge of water. However, our farm is appealing this claim due to the following reasons: 1. We took photos of the ditch the day Mrs. Stilley came by our farm which was August 02,2023. We have enclosed those photos. The photo of the map is document 1. There is an X marked that shows where Mrs. Stilley claims she noticed the discharge. Document 2 is a photo of the drainage from the field she says the discharge is from. The photo of document 2 shows no waste, and no water sample was taken of this area to show it was waste that we are aware of. 2. Document 3 is the ditch marked on the map as 1. Document 3 displays no wastewater, and no sample was taken that we were aware of. Document 1 is marked with number 1 is the ditch that is on the left, number 2 is the ditch on the right, number 3 is the ditch across the road, number 4 is the field on the left, number 5 is the field on the right and number 6 is David May Page 2 road of Black Jack -Simpson Rd the arrows show how the water runs to the ditch, and the arrows running both ways is the way water flows in the area, and 7/8 shows the ditch flow. 3. Document 1 field 4 would have runoff to location X then to location 1 which shows clear water and no discharge. The discharge would have to be at location 1 to have discharge in location 2 and 3. This is what Mrs. Stilley explained. There is no way for there to be discharge of waste in those locations if there was no discharge in location 1. 4. There are other facilities in the area that the discharge could have come from due to the way the water flows from the ditch. As explained to Mrs. Stilley, we have pulled furniture, 5 gallons of buckets/jugs not knowing what is in them, trash and etc that people dump in the ditch at location 2. Mrs. Stilley even agreed she smelled and saw oily residue and odor of diesel to the water. 5. Document 4 and 5 is the ditch for field 5 on document 1. You can see there is no water or waste to run to location 2. 6. Document 6, 7, 8 is the ditch on document 1 labeled 7 and 8. Those documents show no water waste. The reasons listed above state why we feel we should be held responsible for the waste found in 2 and 3.
