The review indicates that soil contamination exceeds the residential maximum soil contaminant concentrations (MSCCs) established in Title 15A NCAC 2L .0411 and groundwater contamination meets the cleanup requirements for a low -risk site but exceeds the groundwater quality standards established in Title 15A NCAC 2L .0202. The UST Section determines that no further action is warranted for this incident. All required actions have been completed. On January 19, 2017, the UST Section received a certified copy of the Notice of Residual Petroleum which is filed with the Register of Deeds. On January 19, 2017, the UST Section was provided with proof of receipt of the conditional Notice of No Further Action letter or of refusal by the addressee to accept delivery of the letter or with a description of the manner in which the letter was posted. This determination shall apply unless the UST Section later finds that the discharge or release poses an unacceptable risk or a potentially unacceptable risk to human health or the environment. Pursuant to Title 15A NCAC 2L .0407(a) you have a continuing obligation to notify the Department of Environmental Quality of any changes that might affect the risk or land use classifications that have been assigned. But for the last groundwater remediation permit rescission, Anderson Trust, Danny wanted me to ask Rick about the monitoring wells, and that led Rick to ask me to ask Mark Powers about the UST's and if the facility had a corrective action plan. It was so much easier when we just rescinded permits in the past when the owner requested rescission. I feel your frustration. Beginning this past 01.01.2014, administration of all aspects of stormwater permits were transferred to the Division of Energy Mining Land Resources. Dave Parnell, who was transferred to DEMLR (Land Quality Section), is the only person I know that is doing SW inspections. Dave did the last inspection at the facility on 08.01.2011. Dave is on AL to Mon June 2. John Holley is the supervisor of Land Quality Section. The UST section oversees the permanent closure activities of UST systems. Mark Powers is the supervisor of UST. All monitoring wells must be closed and capped before the permit is rescinded. This includes removal of infiltration galleries. Monitoring wells and any wells installed are permitted by Aquifer Protection Section. Rick Bolich is the supervisor Of APS section. (Formerly Carolina Freight) Nash County Dear Mr. Rogers: I, Dave Parnell, of the Raleigh Regional Office of the Division of Water Quality (DWQ), performed a compliance evaluation inspection (CEI) at the referenced facility, on August 1, 2011. The assistance and cooperation of Mr. Bobby Hobgood, Manager of Barnhill Contracting Company — Rocky Mount, was helpful and appreciated. The inspection summary is enclosed for your review. During the inspection the following items were noted: SITE SUMMARY The facility is a groundwater remediation system, consisting of the following: electric recovery wells, a oil/water separator, a product recovery tank, an air stripper, carbon canisters and all accompanying hardware and software. After treatment, the waste flow is discharged to an unnamed tributary to the Tar River, a class WS-IV NSW stream in subbasin 30302 of the Tar Pamlico River Basin. INSPECTION SUMMARY 1. The tour of the facility began at the point that the wastewater enters the facility from the recovery pumps and followed through the process and to the effluent pipe. The facility was not in operation on this date and Mr. Hobgood reports that it has not been in operation for about ten years. 2. The facility is not in operation at this time, as pointed out above. Recent storms have ripped a hole in the building and the idle equipment is danger of being ruined. Mr. Hobgood is not the operator of the facility and, of course, was not cognizant of the workings of the operation. In order to get the operation up and running again some components, as well as the roof, would have to be repaired or replaced. After speaking with your staff in Fort Smith and in Durham, it is apparent that there has been no monitoring at this facility in recent years. Quarterly monitoring is required to be conducted. The records are to be made available to the DWQ representative when that person visits the site for a Compliance Evaluation Inspection. In your case, as long as the facility is not discharging, but still has a permit, your Discharge Monitoring Reports would simply state "No Discharge" or "No Flow" for that quarterly monitoring period. Please begin keeping these records and if there is a discharge, begin having the samples analyzed. 4.
