This letter is to notify you of the findings of an inspection of the Anderson Trust groundwater
remediation site conducted on September 24, 2014.
A summary of the findings and comments noted during this inspection is provided on the attached
copy of the complete inspection report entitled "Water Compliance Inspection Report".
You are reauested to respond to this inspection with a written explanation as to the status of the
groundwater remediation wastewater treatmendwastewater discharge. The groundwater
treatment system appears to have been removed and no longer in operation. Please explain detail
the closure status of on -site wells and any future monitoring expectations. If the treatment and
the discharse Permit are no longer reauired, please submit a rescission request letter, a request to
end the permit coverage to the address below:

Thanks for doing this inspection and keeping us informed of the situation. Please make sure that your inspection is
recorded in BIMS, and check with Mark Powers in UST to make sure that the site has been "closed out" or "no further
action" required. I am also concerned about the 31 wells at the site that have not been properly abandoned. They are a
potential threat to the groundwater resource at a site like this, perhaps even a bigger threat than the abandoned
remediation system. I realize that the current owner may not have much knowledge or interest in the system, but the
current owner is responsible for complying with the State's rules. I think we need to follow through on our end and try
to get this site into compliance.

I made a site visit at the subject ground water remediation facility on 03.27.2014. The building that houses the controls
and other equipment is standing. There was no electrical lines connected to the building. The building is secured by
locked doors. Kudzu vines had grown up around the air sparge manifold and the recovery well influent and air supply
manifolds. Picture is attached. According to the plans and specs for the facility, there are 15 ground water remediation
wells and 16 sparge wells. Sparge well SP-15 may be damage due to repeated vehicle driving. Picture is attached.
I am including the last email I received from Charles Weaver concerning this permit.

Mitch — sorry it's taken me a while to get back to you on this.
Danny and Rich are correct regarding the 2T requirements for site closure. However, in this particular case, we don't
know what's there.
The CoC was issued to the R.C. Anderson Trust in 2001. This was when Stormwater was issuing wastewater CoCs, so
there's nothing in the file apart from a copy of the CoC. The elderly Mr. Anderson (Jr.) took ownership of the CoC in
2005.
In my conversations with him [and in John Hennessy's also], Mr. Anderson professed no knowledge of what, if anything,
was installed at the site, or by whom. Mr. Anderson has no interest in the system, if it exists, and little unrrstanding of
what the CoC covers.
There are no recorded site inspections in RIMS. Can someone from the RRO visit the site and see what's there?
I don't want to circumvent the 2T requirements, but I also think this CoC should be rescinded. If there is anything there,
we gain little in penalizing Mr. Anderson by forcing him to hire an engineer [or scrap -metal collector] to dismantle it, just
so this CoC can be rescinded. We also don't need to keep his permit on the books [and keep charging him an annual fee]
if we know nothing is being discharged. !aj

The Division received your request for renewal of the subject Certificate of Coverage (CoC) on June
19, 2006. The revised General Permit was signed on September 20+h, 2006 and takes effect October 1, 2006.
Accordingly, we are forwarding the attached CoC to discharge under NCG510000. This CoC is issued
pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of
Agreement between North Carolina and the US Environmental Protection agency dated May 9, 1994.
A copy of the renewed General Permit is enclosed, as well as an updated Technical Bulletin. The
Technical Bulletin summarizes the changes from the previous version of NCG510000. If any parts,
measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you
have the right to request an individual permit by submitting an individual permit application. Unless such
demand is made, this Certificate of Coverage shall be final and binding.
The CoC is not transferable except after notice to the Division. You must notify the Division if you
sell or otherwise transfer ownership of the permitted facility. The Division may require modification or
reissuance of the CoC.
If your facility ceases discharge of wastewater before the expiration date of this permit, contact the
Regional Office listed below. Once discharge from your facility has ceased, this permit may be rescinded.
This permit does not affect the legal requirements to obtain other permits which may be required by the
Division of Water Quality, the Division of Land Resources, Coastal Area Management Act or any other
Federal or Local government. If you have any questions concerning this permit, please contact Charles

Dear Permittee:
NPDES General Permit NCG510000, under which the subject facility is covered, expires on
September 30, 2006. North Carolina Administrative Code (15A NCAC 2H.0105(e)) requires that an
application for permit renewal be filed at least 180 days prior to expiration of the current permit. To satisfy
this requirement, your renewal package should have been sent to the Division postmarked no later than
April 3, 2006.
The Division has not received a renewal request for the subject CoC. This is a violation of your
permit at Part II. B. 10, which states "Any permittee that has not requested renewal at least 180 days prior
to expiration... will subject the permittee to enforcement procedures as provided in NCGS 143-215.6 and 33
USC 1251 et. seq.".
To prevent an assessment of civil penalties you must submit a completed permit application (see
enclosed forms) no later than June 19, 2006. If the system is inactive due to lack of trust fund payments,
but the remediation equipment is still on site, the CoC should be renewed.
If all remediation discharge from this facility has ceased and you wish to rescind this CoC [or if you
have any other questions], contact Charles Weaver of my staff. Mr. Weaver's telephone number, fax number

In accordance with your application for a discharge permit received October 25, 2000 we are
forwarding herewith the subject Certificate of Coverage to discharge under the subject state - NPDES
general permit for petroleum contaminated groundwater remediation systems and one set of final
approved plans and specifications. Authorization is hereby granted for the construction and operation
of an oil/water separator, a product storage tank, an air stripper, two particulate filters in series, and
two carbon adsorption vessels in series with a discharge of 0.028 MGD of treated wastewater to an
unnamed tributary of Little Cokey Swamp, a Class C NSW water in the Tar -Pamlico River Basin.
This Certificate of Coverage is issued pursuant to the requirements of North Carolina General Statute
143-215.1 and the Memorandum of Agreement between North Carolina and the US Environmental
Protection Agency dated May 9, 1994 (or as subsequently amended).
Based on the source of your contamination, specifically gasoline, effluent page
A. (1) applies to your facility and lists required effluent limitations and monitoring frequencies.
At the recommendation of the regional office, to avoid any potential flooding problems at the
adjacent mobile home park, please move the discharge point as close to the edge of your property line
as possible. This change is noted in Figure 2 of your approved plans.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to request an individual permit by submitting an individual
permit application and letter requesting coverage under an individual permit. Unless such demand is
made, this certificate of coverage shall be final and binding.
Please take notice that this certificate of coverage is not transferable except after notice to the
Division of Water Quality. The Division of Water Quality may require modification or revocation and
reissuance of the certificate of coverage in case of change of ownership or control of this discharge.
The Authorization to Construct is issued in accordance with Part III, Paragraph 2 of NPDES
Permit No. NCG510000, and shall be subject to revocation unless the wastewater treatment facilities
are constructed in accordance with the conditions and limitations specified in Permit No. NCG510000.

In the event that the facilities fail to perform satisfactorily, including the creation of nuisance
conditions, the Permittee shall take immediate corrective action, including those as may be required by
this Division, such as the construction of additional or replacement wastewater treatment or disposal
facilities.
The Raleigh Regional Office, telephone number (919) 571-4700, shall be notified at least forty-
eight (48) hours in advance of operation of the installed facilities so that an in -place inspection can be
made. Such notification to the regional supervisor shall be made during the normal office hours from
8:00 a.m. until 5:00 p.m. on Monday through Friday, excluding State Holidays.
Upon completion of construction and prior to operation of this permitted facility a certification
must be received from a professional engineer certifying that the permitted facility has been installed in
accordance with the NPDES Permit, the Certificate of Coverage, this Authorization to Construct and the
approved plans and specifications. Mail the Certification to the Stormwater and General Permits Unit,
NCDENR, DWQ, 1617 Mail Service Center, Raleigh, NC 27699-1617.
A copy of the approved plans and specifications shall be maintained on file by the Permittee for
the life of the facility.
Failure to abide by the requirements contained in this Authorization to Construct may subject the
Permittee to an enforcement action by the Division of Water Quality in accordance with North Carolina
General Statute 143-215.6A to 143-215.6C.
This permit does not affect the legal requirements to obtain other permits which may be required
by the Division of Water Quality or permits required by the Division of Land Resources, the Coastal
Area Management Act or any other Federal or Local governmental permit that may be required.
