Location description: The proposed project is located on a Town of Bryson City -owned island to the
southeast of the town within the Tuckasegee River in Bryson City, Swain County, North Carolina. The
approximate central project area latitude is 35.431753 and longitude is-83.442033.
Description of projects area and activity: The project would stabilize the banks along 3 sections, totaling 460
linear feet of the Tuckasegee River, where the bank erosion is threatening the stability of the island. Bank
stabilization would consist of the installation of a log vane, removal of an existing collapsing retaining wall,
and grading and installing geolifts along the banks to create a more stable slope. Temporary impacts
consisting of 110 linear feet of a ford across the river would be installed for construction equipment access.

Your work is authorized by the above referenced permit provided it is accomplished in strict accordance
with the attached conditions, above noted special conditions, and your submitted application and attached
information dated May 10, 2023, and all subsequent documentation submitted in June and July 2023. Any
violation of the attached conditions or deviation from your submitted plans may subject the permittee to a
stop work order, a restoration order, a Class I administrative penalty, and/or appropriate legal action.
This verification will remain valid until the expiration date identified below unless the nationwide and/or regional
general permit authorization is modified, suspended or revoked. If, prior to the expiration date identified below,
the nationwide and/or regional general permit authorization is reissued and/or modified, this verification will remain
valid until the expiration date identified below, provided it complies with all requirements of the modified
nationwide permit. If the nationwide and/or regional general permit authorization expires or is suspended, revoked,
or is modified, such that the activity would no longer comply with the terms and conditions of the nationwide
permit, activities which have commenced (i.e., are under construction) or are under contract to commence in reliance
upon the nationwide and/or regional general permit, will remain authorized provided the activity is completed
within twelve months of the date of the nationwide and/or regional general permit's expiration, modification or
revocation, unless discretionary authority has been exercised on a case -by -case basis to modify, suspend or revoke
the authorization.
Activities subject to Section 404 (as indicated above) may also require an individual Section 401 Water Quality
Certification. You should contact the NC Division of Water Resources (telephone 919-807-6300) to determine
Section 401 requirements.
For activities occurring within the twenty coastal counties subject to regulation under the Coastal Area Management
Act (CAMA), prior to beginning work you must contact the N.C. Division of Coastal Management
in Morehead City, NC, at (252) 808-2808.
This Department of the Army verification does not relieve the permittee of the responsibility to obtain any other
required Federal, State or local approvals/permits.

SUBJECT: Bryson City Island Park
Tuckasegee River, Swain County
Dear Ms. Davis:
Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed an
application to stabilize 461 ft and temporarily impact 110 ft of the Tuckasegee River in Swain
County. I have visited the site multiple times in the past. Our comments on this application are
offered for your consideration under provisions of the Clean Water Act of 1977 (33 U.S.C. 466
et. seq.) and Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-
667d).
Wild trout reproduction should not be impacted by project activities and a trout moratorium is
not needed. However, the Tuckasegee River is a popular trout fishery, and it is important to
minimize turbidity from project activities. In addition, the Tuckasegee River is part of the
Tuckasegee River Aquatic Habitat, a natural area rated Exceptional by the NC Natural Heritage
Program due to the richness of rare species it supports. Rare and listed species in the river in the
project vicinity include Appalachian Elktoe (Alasmidonta raveneliana, US and NC Endangered),
Sicklefin Redhorse (Moxostoma sp., NC Threatened), Wounded Darter [Etheostoma vulneratum,
US Federal Species of Concern (FSC), NC Special Concern (SC)], Olive Darter (Percina
squamata, US FSC, NC SC), Eastern Hellbender (Cryptobranchus alleganiensis, US FSC, NC
SC), Little Tennessee Crayfish (Cambarus georgiae, US FSC, NC SC), and Smoky Dace
(Clinostomus sp., NC SC). These species are especially sensitive to sedimentation, and effective
erosion and sediment control measures for this project are essential to protect these species.
The project proposes to stabilize eroding reaches of stream by removing rock walls, grading
stream banks, installing geolifts and one log vane, and planting native riparian vegetation. A
temporary ford will be used to cross the river right channel for equipment access to the island;

NCWRC staff have surveyed the general area for Appalachian Elktoe, and no animals were
found.
We offer the following recommendations to minimize impacts to the aquatic community:
1. In -channel work should be accomplished as quickly as possible and vigilance used in
sediment and erosion control during site preparation, construction, and clean up. Disturbed
areas should be seeded, mulched and/or matted as soon as possible, preferably at the end of
each work day.
2. Any erosion control matting used should be free of plastic mesh, as this type of mesh netting
frequently entangles wildlife and is slow to degrade, resulting in a hazard that may last for
years.
