PROJECT SUMMARY: The applicant proposes to expand the existing docking facility with the addition of a boatlift for a total of four formalized slips within the Ocean Isle Beach canal system. Hill Private Dock Expansion August 24, 2023 Paze 2 9. PROJECT DESCRIPTION The proposed project is located on the north end of Dare Street at 50 Dare Street in Ocean Isle Beach, Brunswick County. General Permit #60707D was issued on 12/19/12 to install a 6' x 12' access pier and an 8' x 20' floating dock on the north side of the property, adjacent to Feeder Canal #19 (Slip 3, See Sheet 2 of 3). General Permit #69247D was issued on 6/14/17 to replace pilings on the existing 8' x 20' floating dock (Slip 3, See Sheet 2 of 3) and replace pilings on an unpermitted 8' x 20' floating dock (Slip 1, See Sheet 2 of 3) and 6' x 12' PWC float (Slip 2, See Sheet 2 of 3) located on the east side of property adjacent to Finger Canal 46. Based on aerial imagery, the 8' x 20' floating dock (Slip 1) has been in place since at least January 2013 and the 6' x 12' PWC float (Slip 2) has been in place since at least October 2014. The project site is approximately .19 acres and is vegetated primarily with domestic grasses and ornamental landscaping. The high ground portion is elevated approximately 4' above the normal high water (NHW) level, and the shoreline (+/- 208 linear feet) is stabilized by a concrete bulkhead. There are no indications of any Coastal Wetlands on -site. The applicant's property sits at the end of a man-made canal system between Finger Canal #6 to the east and Feeder Canal #19 to the north. Dare Street and residential properties border the project site to the west and south, respectively. According to the application, Feeder Canal #19 measures approximately 112' wide from NHW at the bulkhead in the vicinity of the proposed project site. The waters of the canal system are classified SA by the Division of Water Quality and ARE NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. They are CLOSED to the harvest of shellfish. Based on visual observations made by DCM staff during the August 2023 site visit, there appears to be NO Submerged Aquatic Vegetation (SAV) in the surrounding waters. Water depths in the vicinity of the proposed boatlift range from -2.0' to -3.0', relative to NLW. PROPOSED PROJECT The applicant proposes to expand the existing docking facility with the addition of a boatlift for a total of four formalized slips within the Ocean Isle Beach canal system. As proposed, a 3' x 12' access pier would originate from the concrete bulkhead east of existing Slip #3 and extend north into Feeder Canal #19. The proposed access pier would terminate with a 2' x 13' T-head and provide access to a 13' x 13' open boatlift (Slip 4, See Sheet 2 of 3), oriented parallel with the concrete bulkhead. The boatlift would extend approximately 24' waterward of NHW, to align with the waterward edge of the adjacent floating dock (Slip 3). The proposed boatlift would remain landward of the %4 width of the waterbody and outside of the eastern riparian. setback. The applicant did not receive any adjacent setback waivers. 10. ANTICIPATED IMPACTS The proposed docking facility expansion would result in the incorporation of an additional 219 square feet of Estuarine Waters and Public Trust Area. As proposed, the boatlift would align with the waterward edge of the existing 8' x 20' floating dock and would not exceed the 1/4 width of the waterbody. The proposed development would be located outside of both 15' riparian corridor setbacks. Water depths in the vicinity of the proposed boatlift range from -2.0' to -3.0', relative to NLW. Minor increases in turbidity should be expected during piling installation. The square footage of the proposed docking facility is calculated as follows: Shoreline length = 208 ft. x 8 sq. ft. =1,664 sq. ft. This application is for the installation of a new 13' x 13' boatlift which will be located adjacent to the existing S' x 20' floating on the east end. A new 3' x 12' access pier will also be installed which will extend to a new 2' x 13' platform/walk board adjacent to the boatlift for access. The boatlift will provide dockage for 1 additional vessel, creating a total of 4 slips at the property within existing water depths ranging from -2 to -3' @ normal low water (NLW). As proposed, the structures will not encroach into either of the adjacent 15' riparian corridor setbacks nor exceed the existing pier -head line and will not extend beyond the '/4 width of the waterbody which measures approx. 116' in this location. It was received complete on August 11, 2023 and appears to be adequate for processing at this time. The projected deadline for making a decision is October 25, 2023. An additional 75-day review period is provided by law when such time is necessary to complete the review. If you have not been notified of a final action by the initial deadline stated above, you should consider the review period extended. Under those circumstances, this letter will serve as your notice of an extended review. However, an additional letter will be provided on or about the 75th day. If this agency does not render a permit decision within 70 days from August 11, 2023 you may request a meeting with the Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such a meeting will be held within five workingdays from the receipt of your written request and shall include the property owner, developer, and project designer/consultant. NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed development. You should post this notice at a conspicuous point along your property where it can be observed from a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of- way fronting your property; or at a point along the road right-of-way where a private road would lead one into your property. Failure to post this notice could result in an incomplete application.
