Effective August 1,2013 the State Stormwater program has been transferred from the Division of Water
Quality(DWQ)to the Division of Energy,Mineral and Land Resources(DEMLR). All previous references to
DWQ or its predecessor,the Division of Environmental Management(DEM),will remain in older stormwater
permits issued prior to August 1,2013 until they are modified. Please note that the addendum to this renewed
permit will now reference DEMLR as the Division responsible for issuance of the permit.
The Wilmington Regional Office received a complete 8 year Stormwater Management Permit Renewal
Application for Landfall Clubhouse on March 28,2016.The Division is hereby notifying you that permit SW8
950506 has been renewed on May 12,2016,and shall be effective until September 10,2020. The renewal and
reissuance of this stormwater permit does not imply that the site is currently in compliance with the terms and
conditions of this state stormwater permit. The revised plans approved on April 6,2006,will remain in full
force and effect in accordance with the regulations set forth in Title 15A NCAC 2H.1000 effective September
1, 1995. Please attach this cover letter and permit addendum to your High Density Permit last issued on
September 10, 1998.
This permit is subject to the conditions and limitations as specified therein. Please pay special attention to the
conditions listed in this permit regarding the Operation and Maintenance of the BMP(s),recordation of deed
restrictions,and the procedures for changing ownership,transferring the permit,and renewing the
permit. Failure to establish an adequate system for operation and maintenance of the stormwater management
system,to record deed restrictions,to transfer the permit, or to renew the permit,will result in future
compliance problems.
If any parts,requirements,or limitations contained in this permit are unacceptable,you have the right to
request an adjudicatory hearing by filing a written petition with the Office of Administrative Hearings(OAH).
The written petition must conform to Chapter 150B of the North Carolina General Statutes,and must be filed
with the OAH within thirty(30)days of receipt of this permit. You should contact the OAH with all questions
regarding the filing fee(if a filing fee is required)and/or the details of the filing process at 6714 Mail Service
Center,Raleigh,NC 27699-6714,or via telephone at 919-431-3000,or visit their website at
www.NCOAH.com.Unless such demands are made this permit shall be final and binding.

amended, and other applicable Laws, Rules, and Regulations

FOR THE
construction, operation and maintenance of one (1) wet detention pond in compliance with the
provisions of 15A NCAC 2H .1000 (hereafter the "stormwater rules') and the approved stormwater
management plans and specifications and other supporting data as attached and on file with and
approved by the Division of Energy, Mineral and Land Resources (hereafter the Division or DEMLR)
and considered an enforceable part of this permit.
The permit is hereby renewed subject to the following addendums, clarifications, conditions and
limitations:
1. The original permit conditions contained in the permit issued on September 10, 1998
remain in full force and effect, except as amended herein. (An additional copy of this
original permit can be obtained from the Division, Wilmington Regional Office.)
2. This permit shall be effective from the date of issuance until September 10, 2020.
3. The permittee shall submit a permit renewal application request at least 180 days prior to
the expiration date of this permit. The renewal request must include the applicable
documentation and the processing fee.
4. Decorative spray fountains are allowed in a wet detention pond, subject to the following
criteria:
a. The permanent pool volume is a minimum of 30,00 cubic feet. The calculations did not
include the permanent pool volume, so if a fountain is desired, those calculations must
first be provided to the Division.
b. The fountain must draw its water from less than 2' below the permanent pool surface.
c. Separated units, where the nozzle, pump and intake are connected by tubing, may be
used only if they draw water from the surface in the deepest part of the pond.
d. The falling water from the fountain must be centered in the pond, away from the
shoreline.
e. The maximum horsepower for a fountain in this pond is n/a horsepower.
5. If the use of permeable pavement for BUA credit is desired, this permit must be modified to
add the permeable pavement conditions.
6. Any individual or entity found to be in noncompliance with the provisions of a stormwater
management permit or the requirements of the stormwater rules is subject to enforcement
action as set forth in NCGS 143 Article 21.

7. The permit is not transferable to any person or entity except after notice to and approval by
the Director. The permittee shall submit a completed and signed Name/Ownership Change
Form, accompanied by the supporting documentation as listed on the form, to the Division
of Energy, Mineral and Land Resources at least 60 days prior to any one or more of the
following events:
a. An ownership change including the sale or conveyance of the project area in whole
or in part,except in the case of an individual lot sale that is made subject to the
recorded deed restrictions;
b. The sale or conveyance of the common areas to a Homeowner's or Property
Owner's Association, subject to the requirements of Session Law 2011-256;
c. Bankruptcy;
d. Foreclosure, subject to the requirements of Session Law 2013-121;
e. Dissolution of the partnership or corporate entity, subject to NCGS 57D-2-01(e) and
NCGS 57D-6-07;
f. A name change of the current permittee;
g. A name change of the project;
h. A mailing address change of the permittee.

I got your name and email address from the stormwater file for the Landfall Clubhouse, SW8 950506, located off
Sunrunner Place. I was researching a complaint about piping of a swale from a Mr.John Homestead at 720 Autumn Crest
Place and discovered that this permit expired in 2012 and needs to be renewed as soon as possible.
The Division sent a letter to Landfall Subdivision II Owners Association, dated September 2, 2011, (attached)to remind
the permittee of the need to renew.To date,we have not received the renewal application. Landfall Subdivision II
Owners Association is currently discharging stormwater to surface waters without a valid permit,which is a violation of
NCGS 143 Article 21 subject to a fine of up to$25,000.
Please take a moment to download, complete,sign and submit the renewal application form available from our website
and submit it along with the required$505.00 renewal application fee.
Please submit the required renewal application by March 31, 2016,to avoid enforcement action. Please forward this

April 2006(we don't issue full permits for Plan Revisions);and the Permit Extension letter, changing the expiration date
of the permit to September 10, 2012 (note permit is now expired). These documents should give you the most complete
picture of what was permitted.

Dear Mr.Cooper:
The Division of Water Quality issued a Coastal Stormwater Management Permit, Number SW8 95056 to the Landfall
Subdivision II Owner's Association for a High Density project on September 10, 1998,with a Permit Extension letter issued on
May 19,2011. This permit expires on September 10,2012. Per 15A NCAC 2H.1003(h) (the stormwater rules),applications for
permit renewals shall be submitted 180 days prior to the expiration of a permit and must be accompanied by a processing fee,
which is currently set at$505.00. If this is still an active project please complete and submit the enclosed renewal application
prior to March 10, 2012. If this project has not been constructed and a permit is no longer needed, please submit a request to
have the permit rescinded. If you have sold the project please provide the name, mailing address and phone number of the
person or entity that is now responsible for this permit. Enclosed is a form for change of ownership,which should be completed
and submitted if the property has changed hands.
Your permit requires that upon completion of construction and prior to operation of the permitted stormwater treatment system,
a certification of completion be submitted to the Division from an appropriate designer for the type of system installed. This is to
certify that the permitted facility has been installed in accordance with the permit,the approved plans,specifications and
supporting documentation. If you have not already provided a Designer's Certification to our office, please include a copy with
your permit renewal request and processing fee.A copy of the certification form is enclosed for your convenience.
You should be aware that failure to provide the Designer's Certification and the operation of a stormwater treatment facility
without a valid permit, are violations of NC General Statute 143-215.1 and may result in appropriate enforcement action
including the assessment of civil penalties of up to$10,000 per day.

Dear Mr. Cooper:
On August 5, 2009, the Governor signed Session Law 2009-406. This law impacts any
development approval issued by the Division of Water Quality under Article 21 of
Chapter 143 of the General Statutes, which'is current and valid at any point between
January 1, 2008, and December 31, 2010. The law extends the effective period of any
stormwater permit that is set to expire during this time frame to three (3) years from its
current expiration date.. On August 2, 2010, the Governor signed Session Law 2010-
177 which grants an extra year for a total of four (4) years extension.
Accordingly, Stormwater Permit# SW8 950506 which has already expired on
September 10, 2008, is now in effect until September 10, 2012. Please resubmit the
renewal application and fee at least 180 days prior to September 10, 2012, which would
be March 10, 2012. A copy of the Renewal Application can be obtained from the
following website: http://portal.ncdenr.org/web/wq/ws/su/statesw/forms_docs.

being issued by NHC for projects at the Nicklaus Clubhouse. One project involves
the construction of a berm being done by Malpass Engineering, which can be exempted
from the requirement to obtain a stormwater permit, but the other project is being
done by ESP Associates for a new Pro Shop to be located between the 2 existing
buildings that currently make up the Nicklaus Clubhouse. The project appears to be
a redevelopment project (i.e. , it appears that the new construction is replacing
existing concrete area. ) This is a permittable type of project, but a stormwater
application must be submitted to and a permit must be issued by the Division prior
to any redevelopment of impervious areas at this site.

I'm still very unclear as to what is going on here. It appears that there are two
separate projects going on at the Nicklaus Clubhouse, one is yours for the berm at
the practice area, and one is ESP's for the addition of a Pro Shop at the clubhouse
itself.
ESP has not responded to our request for an application propbably because the
letter we sent was copied to you instead of to them. I'm going to send a new letter
to Landfallc copied to ESP, requesting an application for the Pro Shop addition.
As far as the berm is concerned, that project was exempted on June 27, 2006, and
the exemption applies only to that activity. Future land-disturbing activities will
need to be submitted for separate exemption under the same permit number.
