Dear Mr. Wake Hamilton:
This office has reviewed the subject erosion and sedimentation control plan. We find the revised
plans submitted on June 15t'',2023 to be acceptable with the following modifications:
1. Construction shall not begin before ownership of properties have been transferred to the
FRO. Copy of new deed should be presented to this office at that time.
2. Provide copies of 401 and 404 permits prior to any land disturbing activities being conducted
outside of the LODs in Phase 1 and 2 and into Phase 3 LODs.
3. Note should be provided on plans at each riser basin that states orifices meant for the final
BMP stage should be closed off during their use as skimmer basins.
We hereby issue this Letter of Approval w/Modifications and the following comments:
1. A pre-construction conference is required for this project. Contact this office at least
48 hours in advance.
2. This approval does not authorize off-site land-disturbing activity (borrow or spoil)
associated with this project.
3. This approval does not supercede nor negate the need for any applicable development
permits or approvals including (ie: planning, subdivision, floodplain, DOT,etc.).

Please be advised that Section 18-52 b. of the Rowan County Soil Erosion & Sedimentation
Ordinance (RCSESO) states that a copy of the approved Erosion Control Plan be on file at the job site.
Also,you should consider this letter as giving the Notice required by G.S. 113A-61(d)& Section 18.53 a.
of that same ordinance specifying our right of periodic inspection to ensure compliance with the approved
plan. This plan approval shall expire three (3) years following the date of approval if no land-disturbing
activity has been undertaken,as is required by Title 15A NCAC 4B.0129.
Based on rules established by the North Carolina Department of Environmental Management
Land Resources (DEMLR) as of April 1, 2019, all new construction activities are required to complete
and submit an electronic Notice of Intent (NOI) form requesting a Certificate of Coverage (COC) under
the NCG010000 Construction Stormwater General Permit. This form MUST be submitted prior to the
commencement of any land disturbing activity on the above mentioned project. The NOI form may be
accessed at deq.nc.gov/NCG01. Please direct questions about the NOI form to Paul Clark at
Paul.clark@ncdenr.gov. After you submit a complete and correct NOI form, a COC will be emailed to
you within three business days. A $100 fee will be charged annually. This fee is to be sent to the
DEMLR Stormwater Central Office staff in Raleigh.
Rowan County's Sedimentation Pollution Control Program is performance oriented, requiring
protection of the natural resources and adjoining properties. If, following the commencement of this
project, it is determined that the erosion and sedimentation control plan is inadequate to meet the
requirements of the Sedimentation Pollution Act of 1973 (North Carolina General Statute 113A-51 thru
66), which are set forth in the local ordinance, this office may require revisions to the plan and
implementation of the revisions to ensure compliance with the Act.
Acceptance and approval of this plan is conditioned upon your compliance with Federal and State
water quality laws,regulations,and rules pursuant to G.S. 113A-61(bl).
Please note that this approval is based in part on the accuracy of the information provided in the
Financial Responsibility Form which you have provided. You are requested to file an amended form if
there is any change in the information included on the form.
