Residents of Briar Chapel,
Many positive things occurred in 2022 and there are even better things to come in 2023 for
the wastewater system serving Briar Chapel.
The wastewater plant expansion is in its final stages and the plant is fully operational. Only
minor site grading and punch list items remain outstanding. The SD East lift station, serving the
commercial area on 15-501,was completed in August 2022 and is now fully operational. Our new
state of the art odor control system is fully operational and we have noticed reduced odors at the
plant. The diffused air system is increasing efficiencies with plant operations,reducing odors, and
it is significantly quieter than the old floating aerators and blowers.
In January 2022, due to excessive rain, we experienced difficulties with our contractor for
sludge removal. This led to some NOVs due to the excessive sludge that the plant was forced to
hold. In February we switched contractors to one who uses a different sludge removal process.
This new process is much more reliable and is not hampered by weather conditions. The new
contractor has helped tremendously with sludge removal and by allowing ONSWC to keep plant
operations in compliance with state standards. As of Februrary 2022, we are fully in compliance
with our permit and no additional NOVs have occurred.
It is worth noting that there are NOVs from April and June of 2022 on NCDEQs website,
but NCDEQ has informed us that there was a software glitch associated with these NOVs and they
are investigating the issue. The plant was fully in compliance with its permit during those
timeframes. We are working through these NOVs and will report back to the BCCA and the
management company with the resolution.
In December 2022, Irrigation Package H was approved and it will help significantly with
water disposal and with maintaining freeboard in the storage ponds. This takes our irrigation
capacity to 442,687 gallons per day. We are working diligently with Briar Chapel, Encore, Parks
and Recreation, and the trail community to dispose of water with minimal inconvenience to the
community. Irrigation start up is planned for mid-March 2023. As we get closer, we will update
the community through our website and by communicating with the management company,
Kuester.
We ask for your continued efforts in eliminating fats, oils and grease from the wastewater
system. They are harmful to your pipes and can cause sewage backups or overflows, both in your
home and in the community. We have attached a Grease Goblin flyer to this report. You will be
seeing more information from them in the coming months.

Reclaimed water bypass
April 22nd 2022 - 5,600 gallons - a contractor hit a main line with a pick axe digging a french
drain in Encore. NCDEQ was notified and a 5 day report was submitted to NCDEQ.
May 9th 2022 - 11,000 gallons - a master valve got stuck open; we removed and repaired valve;
8,000 went in a retention pond. NCDEQ was notified and a 5 day report was submitted to
NCDEQ.
July 21 st 2022 - 600 gallons - 2"ball valve failed; removed and replaced. NCDEQ was notified
and a 5 day report was submitted to NCDEQ.
Brair Chapel WWTP bypass
June 8th 2022 - 150,000 gallons was diverted to 5 day holding pond due to RAS pump failing.
NCDEQ was notified and a 5 day report was submitted to NCDEQ.

A Notice of Violation/Intent to Issue Civil Penalty is being issued for the noted violation of North Carolina General
Statute (G.S.) 143-215.1 and the facility's Non-discharge Permit. Pursuant to G.S. 143-215.6A, a civil penalty of
not more than twenty-five thousand dollars($25,000.00) may be assessed against any person who violates or
falls to act In accordance with the terms, conditions, or requirements of any permit issued pursuant to G.S.
143-215.1.
If you wish to provide additional information regarding the noted violation, request technical assistance, or
discuss overall compliance please respond in writing within ten (10) business dates after receipt of this Notice. A
review of your response will be considered along with any Information provided on the submitted Monitoring
Report(s). You will then be notified of any civil penalties that may be assessed regarding the violations. If no
response is reoeived in this Office within the 10-day period,a civil penalty assessment may be
prepared.
Remedial actions should have already been taken to correct this problem and prevent further occurrences in the
future. The Division of Water Resources may pursue enforcement action for this and any additional violations of
State law. If the violations are of a continuing nature, not related to operation and/or maintenance problems,
and you anticipate remedial construction activities, then you may wish to consider applying for a Special Order by
Consent.
Reminder:Pursuant to Permit Condition 6 in Section E,.the Permittee is required to verbally notify the Regional
Office as soon as possible, not to exceed 24 hours, from first knowledge of any non-compliance at
the facility Including limit violations, bypasses of, or failure of a treatment unit. A written report may
be required within 5 days if directed by Division staff. Prior,notice should be given for anticipated or
potential problems due to planned maintenance activities, taking units off-line, etc.
