Hi Brandee and Seren, Regarding those ten PCNs that we submitted June 8 to 12 for the Deep Creek Flood -control dam repairs, I just wanted to point out a couple things: 1. The riser repairs on Dam 19A and Dam 21 are the first phase of larger repair projects on these dams, to be done in a few years. A NEPA EA is presently under review for those two dams; USDA is the lead agency. At the other eight dam sites, the work is just the riser repairs described in the PCN; no further work is proposed and no NEPA document is involved. 2. There are four sediment disposal sites for the ten dams. Disposal site #1 at 1600 Hoots Rd will be used first, and will receive sediment from dams 21, 22A, 23, and 30A. Please process those four PCNs first so the contractor can get started on those. Those are the first four PCNs that we submitted June 8-10. Thanks! I discussed these with Amanda while you were away in April, and she decided they don't require ACE written authorization. Her decision was based on the plan to drain the lakes and excavate sediment from the drained lake bed. The engineer informed me a couple weeks ago that their contractor prefers to keep the lakes full and use hydraulic dredging from a boat with filter bags set up on the shore beside the lake. So, I am including both options in the PCNs. The contractor will select which method will work best based on site conditions. The impact areas (open waters only) will be the same using either method. There will be no stream or wetland impacts at any of the ten dams. Does the "written authorization not required" decision from ACE still stand? Seren Homer at DWR determined that 401 written approval IS required unless a DEMLR-approved E+S Plan is submitted. The proposed impacts are below the DEMLR permit thresholds, so the applicant is not submitting E+S Plans to DEMLR, but Schnabel Engineering has included the appropriate E+S measures in the plans and specs. There will also be temporary fill for dewatering around the riser within the footprint of the sediment removal/excavated areas. The excavated material will be removed from site and deposited in upland areas as also shown on the attached map. Based on the information provided, this work would be covered under our existing Nationwide Permit #3 and would not require submittal of a pre -construction notification to this office. Activities covered under NWP 3 may require an Individual 401 if they involve "complete dewatering and drawdowns to a sediment layer related to pond/dam maintenance or removal unless the dewatering activity has been designed to ensure no discharge of sediment will occur into downstream waters AND has been covered by a Sediment and Erosion Control Plan Approval from the Division of Energy, Mineral, and Land Resources (DEMLR) or a delegated local program" (GC4239 (f)). Essentially, if you will be dewatering down to a sediment layer and are applying to DEMLR for approval, then the activity is covered under GC4239 and does not require an Individual 401. However, if you are not submitting to DEMLR, then a PCN will be required.
