Hi Jennifer,
It is my understanding that I am supposed to submit the text below and
attachments rather than following the old PCN process for this USDA-NRCS
stream restoration project. The NRCS officials for this project are copied. Please
forgive me if I am doing anything incorrectly; I am following the advice of a
consultant that submits 404 and 401 applications much more often than I do.
Please see the attached information listed below to document activities that do not
require a pre -construction notification (PCN) through Nationwide Permit (NWP)
27 Aquatic Habitat Restoration, Enhancement, and Establishment Activities. This
will serve as documentation that NRCS is the lead agency for your records.
Project Location: Cleveland County
Stream Name(s) and Feet of Impacts: Adams Branch and Little Knob Creek
(1,094 ft)
Latitude/Longitude: 35.506299,-81.550519

Per the Notification Section of the NWP 27 guidance with the effective dates of
February 25, 2022, through March 14, 2026. The USACE in North Carolina can
provide authorization to impact WoUS for stream and wetland restoration projects
which are being conducted under a NRCS program without submittal of a PCN.
Under the terms of NWP 27 - Notification: The permittee must submit a pre -
construction notification to the district engineer prior to commencing any activity
(see general condition 32), except for the following activities:
(1) Activities conducted on non -Federal public lands and private lands, in
accordance with the terms and conditions of a binding stream enhancement or
restoration agreement or wetland enhancement, restoration, or establishment
agreement between the landowner and the FWS, NRCS, FSA, NMFS, NOS,
USFS or their designated state cooperating agencies;

Quality Certification and checked "yes" under the "For the record only for Corps
