Good Afternoon Kevin/Crystal/David,
I apologize for any confusion on the original permit modification submittal, on July 11, 2023. NCDOT
Division 14 staff had requested the riffle structures be removed from the design plans prior to me
taking over the project with my new position. I was unaware of the original discussion, concerning
the riffle structures in the UT to Richland Creek, on the original permit. The design firm has added
the structures back to the plans as requested (please see attachment). Please note the impact
changes, are all reductions, from the original issued permit. Please see below for details:

Site 3 (Detour/Stream Stabilization) 1169’ Permanent

10’ Temporary (Reduction in 22 linear feet)
Due to the removal of the two-railroad bridges and some project cross-section redesign, NCDOT was
able to minimize both permanent and temporary impacts at all sites when compared to the original
issued permit. If there are any questions, please let me know.

Patrick,
On July 11, 2023, the Division of Water Resources (Division) received your application requesting a
modification to the 401 Water Quality Certification from the Division for the subject project. The
Division has determined that your application is incomplete and cannot be processed. The
application is on-hold until the following information is received:
The new submittal for the subject project does not show the energy dissipator riffles/sills that were
approved in the previous version 1 plans. These bed form features were designed to provide more
uplift to the channel and were incorporated into the design to offset mitigation requirements. This
was discussed in detail with DOT, DWR, and the Corps before the original submittal. DWR typically
requires mitigation on channel relocations that exceed 300 linear feet and do not provide functional
uplift to the resource. Please re-design the channel incorporating the previous riffle/step/pool
features in the Version 1 plans or consider mitigation as an option through NCDMS.
Pursuant to Title 15A NCAC 02H .0502(c), the applicant shall furnish all of the above requested
information for the proper consideration of the application. Please provide your response by
September 1, 2023. If all of the requested information is not received, the Division will be unable to
approve the application and it will be denied as incomplete. The denial of this project will
necessitate reapplication to the Division for approval, including complete application and the
appropriate fee.
