TA'I�A SHCBE�ARI' The Nortl� Carolina Department of Transportation (NCDOT) is proposing to widen, grade, drain and pave the subject ioad. 'Chis proposal eutails improving tlie existiug gravel road to mcet current NCDOT seeondary road standards. The proposed improvements have been identified as necessary mainteuance and safety improvements. Funds l�ave been allocated for this project and NCDOT woiild like to perform these activities in 2015. I am enclosing a YCN application, Rapanos Jnrisdictioual Detenninatiou Form, DMS (EEP) Mitigation Acceptance Letter, SHPO Forms, sh•eam assessment forms for Permit Site 3, plan sheets showing the proposed work, photographs aud a marked county map aud USGS topographic map. Nortli Carolina Nahual Heritage data were checked for records of feder�lly endangered or tlueatened species near tl�e projeet. There are 64 species with federal status that are known iu Jackson Couuty fi•om current or historical records. Of these, eight species, Carolina Nortliern Flying Squirrel (Glorrco�nys sabrii�rrs colornhrs), Lidiaua bat (i1�Iyotis so�lnlis), northem long- eared bat (h�lyotis se�Ienh•ionnlrs), Appalachian elktoe (,�lnsmidontn ra��enelin�on), spruce-iir moss spider (Mrcroliexirra inailii�aga), small wliorled pogonia (I.roh•in me�leoloi�les), swamp piiilc (Helo�aras brdlala) and rock gnome liclien (Gy�nnor(ernra linem•e), are listed as eitl�er threatened orendangered. There are no records for threatened or endangered aqaatic species in the Woods Branch watershed. Woods Braneh is too smTll and cold for mussels aud it does not support tish according to a 2008 survey by the Noi•th Caroliiia Wildlife Resonroes Commissioii (NCWRC). "fhe project area, which is comprised of single famil}� homes, yards, and small farms, is too low in elevatiou (<3,000 feet) and lacks the habitat needed by Carolu�a Nor�hern Flying Squirrel, rock gnome liclien, and spruce-i7r moss spider. The w�ork �vill not affect �vetlands that cotild support swamp pink. There are some forested habitats that will be cleared along the road, Uut they do not appear siiitable for small-whorled pagonia becaiise they are highly disturbed, comprised of an immature stand of trees, aud/or lack the thick leaf litter that tliis pla�it often prefers. Therefore, we recommend a"no eSfect" determination of this project on these listed terrestrial species. The only potential l�abitat for listed species iu the project area may be suitable roost h�ees a�id foraging �reas for bats. According to USGS data, there are undeigrouud miues aUout 2 miles from the project area, but wliether they are open and serving as l�ibernacula for bats is uiilu�own. Regardless, this project �vould not disturb hibernating bats because it should not i�equire blasting aud tlie road will be improved on its existiug aligmnent. Most grading will occur in open pasture �nd resideutial yards, but there will be some cleariug of forested areas. In anticipalion of tlie recent listiug of the nortliern long-eared bat and Indiaua bat for Jackson Couuty, the project was cleared (tree cuttiug) prior to April 15, 2015 to avoid auy conflict with potetitial raostiug bats. Since the project was cleared outside the roosting period, �ve recommeud a deterinination of"uo effect" ou Lidiaua Tnd noi�thern lo�ig-eared bat species. This project was reviewed by NCDOT's Humau E�iviromnent Uiiit iu 2015 for potential effects to historic architecture and archaeology. It �vas determined that no survey was required for arcl�aeology. A survey �vas conducted for historic architecture with a detennination of "no effect" (see attached SHPO forms). The best managemeut practices will be used to minimize and control sedimentation and erosion on this project. Watei• will be temporarily diverted around the �vork areas to miuimize erosio�i and sedimeutation during the culvert iustallations. Tl�e construction foreman will review all erosion control measures daily to ensiire that sedimentation and erosion are beiiig effectively controlled. If tl�e planued devices are not fimctiouing �s intended, they will be iumiediately replaced �vith better devices. Lupacts to Waters of the Uuited States Woods Branch (DWR Class: WS-III) is shown as a peremiial stre�m on the USGS topographic map. Woods Branch flows approsimately 0.8 mile to the East Fork Tuckasegee River, which then flows another 1.5 miles to tl�e Tucklsegee River. The Tuckasegee River meets the definition of a Traditioual Navigable Water ("I`NW). Woods Brauch and its wmamed tribataries meet the definition of Relatively Permauent Waters (RPW) and are under tlie jurisdiction of the US An�ry Corps of Eugineers. The project area is plotted along the southwest corner ofthe Tuckasegee USGS 7.S'topographic quadrangle(Figure l). A�uap review and site file search �vas couducted at the Office oC State Archaeology (OSA) on March 31, 2015. No previously recorded archaeological sites have been identified �vithin the APE, but hvo sites (31JK41 and 3IJK127) are reported within a mile ofthe project Accordiug to tl�e North Carolina State Historic Preservation Office online data base (HPOWGB 2015), there are no known his[oric architectural resources within the APE that may yield intact archaeological deposits. However, the East Fork Hydroelec[ric Plant, a determined cligible resource, is south of the project are�. "I'opographic maps, USDA soil survey maps, aerial photographs (NC One Map), and historic maps (Nordi Carolina maps �vebsite) were esamined tor inl'ormation on environmental and cultw�al variables that may have coniributed to prehistorle or historic settlemeiit within the project limits and to assess the level of ground disturbance. The APE [or the project is siWated on moderate to ve�ry steep side slopes (Figures 2 and 3). Woods Branch runs alon�side the road �vith ihe road crossing the stream once. Several small unnamed mountain drainages pass under the road tojoin tivith Woods Branch. Permits are required at the crossings. Woods Branch eventually draius inro the Tuckaseegee River to the south. Tliese watenvays are all part of the Little Tennessee drainage basin. The APE consists of a mis of residen[ial properties and forests. Growid disturbance is moderate froiu previous alterations to the topooraphy to allow for the e�isting road, hoines, and buried utilities. Two soils series compose the APE according to the USDA soil surve}� report for Jackson County (see Figw�es 2 and 3). Most of the APE is made up of Saunook gravelly loam (SbD), �vhile the Evard-Co�vee 'SV'n.lRCH.-IFOLOGl"SURPEI"RFOCl//UID"I nnf�r,1/inor]Yon�ormrinnPr,jccicnrOvn/I/le�HiiOialOn]Pr��yruunnuNr.ayr.r�nmi. I ul 6 Projer! TracAing �\'a: 14-03-0053 comples (EvD; EvE) is found to a lesser exten[ in the suuthern portion. Both series are considered well drained �vith the Saunook and C��D variant having a slope of I� to 30 percent. 'I'he EvE variant is much steeper at 30 to 50 percent Generally, landforins with a slope of I i percent or more are unlikely to yield significant archaeological sites and do not required subsurl'ace testing. A review of the site f iles shows several archaeological sinve}�s along the Tuckaseegee River, but none along the Tdjace��t mountains or within the APE. Two sites (31JK41 aud 31.1K 127) are reported �vell west of the road along the river. Both sites are prehistoric in origin yielding ceramics and lithic matcriaL Site 31JK41 is ineligible for thc National Register and 31 JK 127 has yet to have its eligible assessed. In general, more work is needed away from the river before condusions can be dra�vn on site predictability based upon known sites and past investigations. However, the ewrent pr�ject �vill not provide the data ueeded as the APE covers only a small area of undislw�bed properties adjaceot lo the road. All of �vhich is on slope I S percent or more. Lastly, a historic map review was conducted. Most maps prior to the 20th century provide few details concerniug the project area as they primarily show unly settlements and major routes. The 1907 USGS Cowee topographic map is one of the first to provide a reliable location for the project area (Pigw�e 4). This map depicts Woods Branch with no road or structures in the vicinity of the curre��t project. 13y the 1930s, clues to the road's presence can be scen. The 1938 State Highway map for ]ackson Counry shows homes and outbuilding on the mountain (Figure 5). This suggests that Luker Branch Road or an earlier road ran up the slope. None oCthe su�uctures appear sigiiiticant and most likely will not be impacted since they are offthe road alignment. Subsequent early 20th century maps provide no Yw�ther useful information. SUMMARY OP CULTURAL RESOURC�S R�VI�W Brief desci•rplrwr of revleiv ncli��ilres, resa(ts of revreiv, mir( conc/nsions: The Luker Branch Road improvement project is located just east of the comnwniry of Tuckasegee in centrel portion of Jackson County, North Carolina. The project area is plotted along the south���est corner of [he Tuckasegee USGS 7.5' topographic quadrangle (Figwe l). A map review and site file search was conducted at the Oftice of State Archaeology (OSA) on March 31, 2015. No pre�viously recorded archaeological sites have been identified �vithin the APE, but two sites (3 UK4l and 31JK 127) are reported within a inile of the project. According to the North Carolina State Historic Preservation Office online data base (HPOWEF3 2015), there are no known historic archirectural resow�ces within the APE that may yield intact archaeological deposits. However, the East Fork Hydroelectric Plant, a detennined eligible resow�ce, is south of the project area. Topographic maps, USDA soil smvey maps, aerial photographs (NC One Map), and historic maps (North Carolina maps website) �vere examined for infoi�mation on environmental and cultural variables that may have contributed to prehistoric or historic settlement within the project limits and to assess the level of ground disturbance. Tlie APE for the project is situated on moderate to very steep side slopes (Figures 2 and 3). Woods Branch runs alonaside the road with the road crossing the sh�eam once. Several sinall unnamed mountain draina�es pass w�der the road to join �vith Woods Branch. Permits are required at the crossings. Woods Branch eventually drains into the Tuckaseegee River to the south. Tliese watenvays are all part of the Little "I'ennessee drainage basin. The APE consists of � mix of residen[ial properties vid forests. Grom�d distwbance is moderate from previous altera[ions to the topography to allow for the existing road, homes, and buried utilities. Two soils series compose the APG accordin* to tlie USDA soil survey report f'or Jacksou Coun[y (see Figures 2 and 3). Both series are considered well drained with the Sauuook and EvD variant having a slope of I S to 30 percent. The EvE variant is much steeper at 30 to 50 percent. Generally, landforms with a slope of I S percent or iuore are unlikely to yield significant archaeological sites and do not required subsurface testing. A review of the site files shows several archaeological sur��eys along the Tuckaseegee River, but noiie along the adjacent mountains or within the APG. Two sites (3 UK41 and 31JK 127) are reported well �vest oC the road 11ong the river. Doth sites are prehista�ic in origin yielding ceramics and lithic materiaL Site 31JK41 is ineligible for the National Register aod 3IJK 127 has yet to have its eligible assessed. [n general, ma�e work is needcd away from the rivcr before conclusions can be drawn on site predictability based upon known sites and past investiga[ions. However, the cw�rent project will not provide the data needed as the APE covers only a small area of widishu�bed properties adjacent to the road. AII of which is on slope I � percent or more. Lastly, a historic map revie�v was conducted. Most maps prior to the 20th century provide few details concernino the project area as they primarily show only settlements and major routes. The 1907 USGS Cowee topographic map is one of the tirst to provide a reliable location for the project area (Figure 4). This map depic�s Woods Branch with no road or structures in Ihe vicinity of the cw�rent project By the 1930s, clues to the road's preseuce can be seen. 'fhe 1938 State Highway map fa� Jackson Counq� shows homes and outbuilding on the muuntain (�igure 5). This suggests that Luker Branch Road or an earlier road ran up the slope. None of the structures appear significant aud most likelp will not be impacted since they are off Ihe road alignment. Subsequent early 20th century maps provide no further useful informatiun.
