SUMMARY
The permit is being modified to extend the interim deadline for submittal of Corrective Action
Plan (CAP) for 120 days (as per 40 CFR 122.63(c)) in section A. (3.) paragraph 2. The interim
deadline was initially on September 1, 2023, and it changed so that the facility could be able to
finish preparing CAP.
Two studies including "Temperature Study" and "North Fork Catawba River Trout Waters
Assessment" have been submitted in 2023 by the consultant engineers as part of the facility efforts
to meet Temperature Compliance Schedule conditions. The extended time will allow Baxter to
fully explore the best available engineering and management control options with respect to

reliability, energy and water utilization, seasonality, as well as timelines for construction or
implementation.
All the remaining terms and conditions of the permit remain unchanged. Public notice was
not required as per 40 CFR 122.63(c).
