I am in receipt of, and thank you, for your letter dated April 17, 1996,
concerning the above referenced undivided properties located at Kinnakeet
Shores Subdivision, Avon, North Carolina.
As discussed by telephone this date, I am enclosing a plat for the
Kinnakeet Shores Subdivision that shows the tracts of property where the
ownership is in dispute. I have provided you with background information
regarding my efforts to stop construction and the connection of
sewage/septic hookup's to newly constructed homes on the Benjamin Austin
and G. M. O'Neal properties until such time as the ownership issue has
been resolved with Kinnakeet Shores General Pari.,,tr--hip.
As a point of reference, the family cemetery, is highlighted and anchors
the O'Neal property to the ground on the enclosed plat. I have reviewed
the development of the subdivision and the portion of this tract of land
containing the cemetery has not yet been developed or platted by
Kinnakeet Shores General Partnership. Several phases of KS Subdivision
have been platted and sold around the cemetary, but no subdivision plat
has been recorded which encompasses the area in which the cemetary is
located. The cemetary is located approximately 1,300 feet due weft from
Lot 601, Phase VI. The G. M. O'Neal Homeplace Tract is west of the
cemetary. The G. M. O'Neal 8.6 acre tract is south of the cemetary and
joins the Warren O'Neal tract on the north line and G.H. O'Neal tract on
the south and runs from the ocean to the sound.
The Benjamin Austin tract, 34.4 acres, is placed on the ground by the
joining property owner deeds.

This tract joins the Christopher Barnes tract on the north and the Isaac
Farrow tract on the south. I did not find any subdivision plat that has
been recorded which encompasses this tract of property, although
development has occurred on the ocean front (east of NC Rt.12).
Since only limited development has occurred on the west side of NC Rt.12
on these properties, I ask that you consider this dispute of ownership
when evaluating permit applications to extend sewer lines that would
encroach on the boundary lines of these properties.
