Dear Mr. Hodge,
This is to confirm our discussion of today, where we reviewed the developer's plans
for continuation of the Hatteras Island Plaza Shopping Center which was approved in
1988.
It is my understanding that, since the existing Kinnakeet Shores wastewater treatment
facility is operating at only a fraction of its design capacity, that the wastewater
capacity for this portion of the shopping center was included in the previous allocation
made by Kinnakeet Shores General Partnership, and that the wastewater collection
lines were completed under the original permit, no additional authorization will be
needed from your office to make the connection of Phase II to these existing collection
lines.
Enclosed as you requested is a copy of the original permit application and supporting
data for the wastewater collection system extension, and the permit which was
issued on February 19, 1988. Once you have reviewed this information, I would
appreciate it if you would correspond with Mr. Elvin Hooper of the Dare County
Building Inspections department to confirm that the connection to this system is
authorized.
As I indicated, the developer will be responsible for cleaning and retesting these lines,
and then making any repairs or adjustments which are necessary to make this system
water tight. This work is scheduled to be completed as part of the Phase II -A site
work. A copy of the original plan and the revised plans are included for your
reference.

construction and operation of approximately 57 linear feet of 4 inch
and 1740 linear feet of 8 inch gravity sewer to serve Kinnakeet Shores
Shopping Center and the discharge of collected domestic wastewater
into the Kinnakeet Shores existing sewerage system, pursuant to the
application received on March 4, 1988, and in conformity with the
project plan, specifications, and other supporting data subsequently
filed and approved by the Department of Natural Resources and
Community Development and considered a part of this permit.
This permit shall be effective from .the date of issuance until
rescinded, and shall be subject to the following specified conditions
and limitations:
1. This permit shall become voidable unless the facilities are
constructed in accordance with the approved plans, specifications
and other supporting data.
2. This permit is effective only with respect to the nature and
volume of wastes described in the application and other supporting
data.
3. The facilities shall be properly maintained and operated at all
times.
4. The permit shall become voidable unless the agreement between the
Daniels & Daniels Construction Company, Inc. and Kinnakeet
Shores Partnership for the collection and final treatment of
domestic wastewater is in full force and effect.
5. The sewage and wastewater collected by this system shall be
adequately treated in the Kinnakeet Shores Soundside Wastewater
Treatment Plant prior to being discharged into the receiving
stream.

6. This permit is not transferable.
7. Construction of the sewers shall be so scheduled so as not to
interrupt service by the existing utilities nor result in an
overflow or bypass discharge of wastewater to the surface waters
of the State.
8, Upon completion of construction and prior to operation of this
permitted facility, a certification must be received from a
professional engineer certifying that the permitted facility has
been installed in accordance with the approved plans and
