PROJECT SUMMARY: The applicants propose to develop 20 acre tract with an access road through wooded 404 wetlands, vehicular bridge over Coastal Wetlands, gravel parking area, one single family residence, boat ramp, riprap toe revetment and offshore sill for shoreline stabilization, a pier with one wet slip, and a single pile for osprey nesting. David) Knoch Pungo River Hyde County Project Setting The ±20 acre project site is located at the terminus of SR 1147, Sandy Point road, in the former Greenville Timberline subdivision known as the Currituck 10 at Sandy Point on the Pungo River in Hyde County near Scranton, North Carolina. Prior to the subdivision development that occurred in the early part of 2000 at Sandy Point, the site was a pine plantation managed and owned by Weyerhaeuser. The site is best describe as a low lying wooded 404 wetland with limited amount of uplands. Of the 20.6 acres comprising the project site, 17.79 acres are wetlands and 2.84 are uplands. There is an upland area next to the unimproved dirt road used to access the project site off the end of Sandy Point road and another upland area adjacent the Pungo River. The surrounding tracts to the project site remain largely undeveloped with the exception of the adjacent tract to the northwest developed with a single family residence, riprap revetment for shoreline stabilization and a pier. The wooded 404 wetlands were part of a managed pine plantation that was clear cut approximately 10 years ago. The cutover area is vegetated with various shrubs, scattered loblolly pine, red cedar and gum trees. There is an extensive area of Coastal Wetlands marsh that extends landward from the Pungo River into and off the tract to the adjacent parcel to the east. This marsh divides the upland area adjacent the Pungo River. The larger portion of the uplands adjacent the river is bordered on three sides by this marsh and the river on the other. The uplands adjacent the river are vegetated with large mature trees with an open understory and were not part of the earlier described timber harvest. The project site shoreline is subject to high wave energy orientated to the southwest with a fetch that exceeds 2 miles. The uplands adjacent the river shore have a sediment bank shoreline with a +3' vertical escarpment comprising mainly of clay soils. These clay soils while being resistant to erosion have resulted in a shoreline with jagged undulations in the shoreline escarpment. Due to the limited amount of sand input from bank erosion, the normal water level (NWL) is at the erosion escarpment with no sandy estuarine beach. However the marsh that separates the uplands does have a sand bank that rolls over and retreats with the shoreline erosion. The remaining Coastal Wetland shoreline is a vertical peat escarpment at ± 18 ". The Coastal Wetland is vegetated primarily with black needlerush (Iuncus roemarianus), and also contains salt grass (Distichlis svicata), salt meadow hay(Snartina patens), three square (Scirvus americanus), and smooth cordgrass (Spartina alterniflora) fringes along the river shoreline. The nearshore area below the NWL is generally shallow ( <3') and deepens gradually as you move offshore. The bottom substrate is sand. A cursory review by DCM staff of the nearshore area did not reveal any submerged aquatic vegetation (SAV). The Pungo River in this location classified by the Environmental Management Commission as SA HQW, NSW and is open to shellfishing. The Marine Fisheries Commission classifies this area as Coastal Waters. David Knoch Pungo River Hyde County Page Two Project Description The applicant proposes to develop the tract for a single family residence to be constructed on the largest upland area adjacent the Pungo River. Access to the home site will be by a road to be filled 22' wide x 961 long through the wooded wetlands to the river shore. The filled road will have a top width or travel lane 10' wide. Three 15" diameter culvert pipes will be equally spaced along the road to maintain the surface hydrology within the wetland. The previous owner of the project site had obtained a Nationwide Permit No. 14 (Action ID 200802276) from the US Army Corps of Engineers (USACOE) and a 401 Water Quality Certification (DWQ Project # 08- 1006) from the Division of Water Resources (DWR) for road construction in the same alignment proposed in this application. The applicant proposes to mitigate for the 404 wooded wetland impacts by recording a protective covenant on the remaining project site wetlands. A 10' wide x 135' long pile supported wooden bridge is to be constructed over Coastal Wetlands to reach the larger area of uplands and the proposed home site. The bridge decking will be elevated 3'. above Coastal Wetland substrate. The home site has an active septic tank permit issued by the Hyde County Health Department. The applicant proposes to construct 10' wide x 20' gravel boat ramp in uplands for the purpose of launching small skiffs and kayaks. A 10' gravel road will be constructed to the boat ramp off the access road. A three space parking area will also be constructed at the foot of the access road to the boat ramp. This associated infrastructure will be constructed in uplands on the north side of the vehicular bridge on the smaller upland area adjacent the river. A total of 1,158 linear feet of shoreline is proposed to be stabilized with a riprap toe revetment armoring the erosion escarpment which includes 321' of wooded 404 wetland shoreline, 237' of Coastal Wetland shoreline and 600' of upland shoreline. The Coastal Wetland shoreline with the sandy bank that separates the uplands adjacent the river will be protected with an overlapping riprap offshore sill. The sills will be 12' wide x 70' and 83' long respectively. The ends of the sills will overlap the toe revetments on each end and in the center maintaining a ±10' wide opening. The sills will have a height 1.5' above the NWL and will be constructed a maximum distance of 40'seaward of the NWL. The applicant also proposes to construct a 6' x 100' pier with an 8' x 12' L -head platform and two tie pilings for one wet slip. A single piling is to be driven ±40' offshore the NWL for the purpose of constructing an osprey nesting site within view of the proposed residence. Anticipated Impacts The road construction will result in the filling of 21,142 ft' of wooded 404 wetlands. The proposed shoreline stabilization measures will fill 9,984 ft2 of Pungo River bottom. The proposed boat ramp will fill 200 ft2 of Pungo River bottom. The proposed pier will shade 96 ft2 of Pungo River bottom. The proposed development will disturb 20,038 ft2 of uplands. The project will increase small boat traffic in the area and their associated impacts. For reference, the property is approximately centered on 35.445405 °N and - 76.556575 0W. The subject property is currently 20.63 acres and contains 17.79 acres of jurisdictional wetlands and 2.84 acres of uplands. The majority of the property is wooded wetlands and uplands or coastal wetlands. This property is on the Pungo River and is suffering from a high erosion rate which is evident from the recent normal water line (NWL) survey compared to previous surveys. The eroded banks consist of peat beds and sandy deposits. The adjacent property to the north contains a house and riprap shoreline stabilization along with a pier and the adjacent property to the south is undeveloped (similar to the Knoch Property). A Section 404 delineation was performed by USACE and surveyed in 2008 by consultants for the previous owner. Also in 2008, there was a Nationwide 14 and 401 Water Quality Certification issued for a driveway on the subject property. This work was never completed and the permits have expired (copies included). On April 281h 2015, Steve Trowel[, DCM, flagged the coastal wetlands line in areas of the proposed work and surveyors located the flags on the same day (see plotted coastal wetlands line). The Knoch's wish to do the following development activities on the subject property: A. Driveway through Section 404 wetlands This includes proposed fill of 0.49 acres of Section 404 non - coastal wetlands. This is a similar alignment as permitted in the previous Nationwide 14/ 401 Cert. The proposed compensatory mitigation for this activity is on -site preservation of 5.0 acres (10:1 preservation to impact ratio). Other mitigation options have been explored including in -lieu contribution to NC Division of Mitigation Services and private mitigation banks. Based on the cost of mitigation banks costs, the amount (roughly $26,000) in mitigation payment costs would render this project cost prohibitive. Preservation proposed would be achieved in the form of a Protective Covenant (in perpetuity) to be recorded with Hyde County Register of Deeds. A draft Protective covenant is attached. The driveway will include a 10 ft wide gravel surface and a shoulder with side slopes on each side. If necessary, the topsoil in the driveway alignment will be stripped and /or covered with geo- textile fabric prior to receiving sand fill and gravel surfacing. The driveway will include three (roughly equally spaced) 15 inch diameter traffic rated culverts to maintain connectivity of surficial hydrology within the wetland areas. B. Riprap shoreline stabilization and sill This is intended to protect the subject property from erosion and includes: upland protection riprap (600 ft), low profile wetland protection riprap (558 ft) and an offshore sill adjacent to the coastal wetland area consisting of two overlapping sections (153 ft) C. Vehicular bridge to access homesite This is to be a pile- supported timber bridge (10 ft wide), elevated a minimum of 3 ft over coastal wetland elevation. The total length of the proposed bridge is 135 ft, spanning 124 ft of Section 404 wetlands, including 88 ft of coastal wetlands. D. Residential house with on -site septic The residential house footprint is depicted on the CAMA plan along with the proposed on -site septic system. Hyde County Health Dept. has evaluated soil conditions in this location and has found them to be provisionally suitable for an on -site septic system (permit is attached). E. Gravel boat ramp /launch The ramp location is depicted on the plan and is meant to be used by small skiffs and paddle vessels.
