This permit shall be effective from the date of issuance until December 31, 1992, and shall be subject to the conditions and limitations as specified therein. If any parts, requirements, or limitations contained in this permit are unacceptable to you, you have the right to request an adjudicatory hearing upon written request within 30,days followingreceipt of this permit. This requ!2st must be in the form of a -written -petition, conforming to Chapter 150B of forth Carolina A General Statutes, and filed with the Office of Administrative Hearings, Post Office Drawer 11666, Raleigh, North Carolina 27604. Unless such demands are made, this permit shall be final and binding. One (1) set of approved plans and specifications is being forwarded to you. In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North Carolina as amended, and other applicable Laws, Rules, and Regulations PERMISSION IS HEREBY GRANTED TO Rinnakeet Shores Partnership Dare County FOR THE construction and operation of, approximately 3143 linear feet of 8-inch gravity sewer, 3,362 linear feet of 4-inch force main, a 134 GPM wet well pump station equipped with duplex submersible pumps and high water alarms, a 0.05 MGD extended aeration type wastewater treatment facility consisting of a bar screen, a 13,643 gallon surge tank with 80 GPM duplex surge pumps and a 15 CFM surge blower, 25,000 gallon each dual aeration tanks, 5439 gallon each dual secondary clarifiers, a 500 gallon sludge holding tank, dual 217 CFM rotary blowers, 34.8 sq. feet of total area tertiary filter with 4114 gallon dosing tank, 110 GPM dosing pumps with filter backwash and air scour_,4,__a---].,.4,60, gallon chlorine contact tank equipped-,P71-thKdual tablet feed type chlorinators,''two (2) 80 feet diameter each hydraulically driven rotary distributors with 200 linear feet of 3-inch effluent force main and 111 GPM duplex pumps, a -standby power generator, an effluent flow recording and totalizing meter and all related valves, pipes, pumps and appur-tanances. to serve-Xinnakeet Shores Southside Phase I located in Dare County with no discharge to the surface waters of the State, pursuant to the application received September 3, 1987, and in conformity with the project plan, specifications, and other supporting data subsequently filed and approved by the Department of Natural Resources and Community Development and considered a part of this permit. This permit shall be effective from the date of' issuance until December 31; 1992, and shall be subject to the following specified conditions and limitations: 1. This permit shall become voidable unless the facilities are constructed in accordance with the approved plans, specifications and other supporting data. 2. This permit is effective only with respect to- the nature and volume of wastes described in the application and other supporting data. 3. The facilities shall be properly maintained and :operated at all times. 4. This permit is not transferable. 5. Construction of the sewers shall be so scheduled so as not to interrupt service by the existing utilities nor result in an overflow or bypass discharge of wastewater to the surface waters of the State. 6. This permit shall become voidable in the event of failure of the soil to adequately absorb the wastes and may be rescinded unless the facilities are installed, maintained, and operated in a manner which will protect the assigned water quality standards of the surface waters and groundwaters. 7. The -sludge generated form these treatment facilities must be disposed of in accordance with General Statute 143.215.1 and in a manner approvable by the North Carolina Division of Environmental Management. 8. Reports on the operations of the treatment disposal facilities shall be submitted to the Washington Regional Office at regular intervals and in such form and detail as may be required by this Division. 9. Diversion or bypassing of the untreated wastewater from the treatment facility is prohibited. 10. The Permittee, at least six (6) months prior to the expiration of this permit, shall request its extension. Upon receipt of the request, the Commission will review the adequacy of the facilities described therein, and as indicated, will extend the Permit for such period of time and under such conditions and limitations as it may deem appropriate. 11. The Permittee shall employ a certified wastewater treatment plant operator in responsible charge of the wastewater treatment facilities. Such operator must hold a certificate of the grade at least equivalent to the classification assigned to the wastewater treatment facilities by the Certification Commission. 12. No wastewater shall be discharged into the proposed sewer collection system until Kinnakeet Shores Sounds-ide Wastewater Treatment Plant -has been.:xl_ry, completed and placed in operation. 13. Adequate inspection, maintenance, and cleaning shall be provdded by the permitte6.to insure proper operation of the subject facilities. 14. An acceptable reserve area, equal in size to the approved disposal area, shall be maintained at all -times. 15. The Permittee shall submit an application for a sludge disposal permit to the Division of Environmental Management within six (6) months of the date of issuance of this permit. The Permittee shall have the sludge disposal system in place and operational within twelve (12) months of the date of issuance of this permit. 16. The Permittee shall provide for the pump station and force main the following items: a. Pump-on/pump-off elevations located so that 2-8 pumping cycles may be achieved per hour in the pump station. b. An air relief valve located at all high points along the force main. c. A screened vent for the wet well. d. Fillets located in the wet well at the intersection of the flooring and sidewalls. e. Three (3) feet of cover (minimum) over the force main or the use of ferrous material where three (3) feet cannot be maintained. f. Sufficient devices which will protect the pump station from vandals. g. Flood protection if the pump station is located below the 100-year flood elevation. 17. Failure of the Permittee to properly operate this system is subject to a penalty up to $10,000 per day. 18. Chlorine shall be maintained in the chlorinator.at all times such that a minimum of 0.5 mg/1 of chlorine residual is maintained after 30 minutes of contact time. 19. During the remainder of the year, this parameter shall be monitored monthly. 20. Monitoring reports including the above information shall be submitted monthly to Regional Supervisor, Washington Regional Office, P. 0. Box 1507, Washington, NC 27889. Each report shall be due within 30 days following the end of the reporting period. 21. The length of time that the standby power unit is operated shall be monitored and reported in the monthly reports described above. The length of time that the standby power is operated due to power outage shall be reported separately from the time that the standby power, is operated for the purpose of routine exercising. 22. The treatment facility shall be operated such that the treatment facility achieves a minimum of 90% removal of BODS and Total Suspended Solids and shall meet a monthly average effluent limit of 20 mg/l of B0D5 and 10 mg/l of Total Suspended Solids. 23. All treatment units described in this permit including the flow measuring and recording device, and the automatically activated standby power generator shall remain operational at all times. In the event of the failure of any unit or the bypass or overflow of any wastewater, the Permittee shall notify the Division of Environmental Management, Washington Regional Office, as soon as possible, but in no case later that 48 hours after the occurrence. 24. Prior to beginning waste disposal operations, four (4) monitor wells, one (1) upgradient and three (3) downgradient, must be installed to monitor groundwater quality. The location and construction details for these wells must be by approval of the Washington Regional Office, from which a well construction permit must be obtained. 25. The monitor wells must be sampled initially after construction (and prior to waste disposal operations) and thereafter every March, July, and November for the following parameters: NO3 pH Total Ammonia TOC TDS Chloride Water Levels Total Coliforms TOX (In November only) Orthophosphate Total Suspended Solids (Initial Sampling only) The measurement of water level must be made prior to sampling for the remaining parameters. The analytical methods used Jor-_.TOX: must be capable of detecting the total of; halogenated organic compounds -present at a concentration of 5.0 parts per billion (ppb) or greater. In the event that a TOX concentration of 5.0 ppb or greater is detected, any individual halogenated organic compounds present =at a concentration at or above their- method detectiom -limit (MDL) must be identifiedy_:•quantifie&--and reported with the sampling results. The results of the sampling and analysis shall be sent to the N. C. Division of Environmental Management on Form GW-59 (Compliance Monitoring Report Form). 26. Any additional groundwater quality monitoring, as deemed necessary by the Department, shall be provided. 27.. Upon -completion of construction and prior to operation of this permitted facility, a certification must be received from a professional engineer certifying that the permitted facility has been installed in accordance with the approved plans and specifications.
