Salisbury St., Archdale Bldg. 91h Flr Raleigh, NC 27604 Re: Foundation Drive Apartments SAW-2021-00426 Wake Forest, Wake County Request for Riparian Buffer Authorization Sage Project #2020.100 On behalf of Heritage RMX, LLC (c/o Robert Defeo, owner and applicant), please find attached a complete application and supplemental information requesting written concurrence from the NC Division of Water Resources (NCDWR) that the activities associated with the proposed Foundation Drive Apartments development (Project) may proceed under the Neuse River Basin Riparian Buffer Protection Program. No impacts are proposed to jurisdictional wetlands or surface waters; therefore, a written 404/401 verification is not required. Project Purpose and Location The purpose of the Project is to construct an apartment development to meet the demand for housing in this part of the county. The +/-5.15-acre Project is located northwest of the intersection of Foundation Drive and Forestville Road, in Wake Forest, Wake County, NC. The coordinates of 35.9451 °N, 78.5085°W generally correspond to the center of the Site. The Site is within the Smith Creek Watershed (HUC 030202010702) of the Neuse River Basin and drains to Smith Creek. Project Detail The purpose of the Project is to construct an apartment development to meet the demand for housing in this part of the county. Access to the Site will be provided by a connection to Foundation Drive to the southwest. Apartment buildings and associated attendant features such as parking, sidewalks, and stormwater control measures will be constructed. Impacts to Zone 2 of the riparian buffer will result from grading for the stormwater pond, grading for the parking area, and installation of an aerial sewerline. Zone 1 impacts will result from the installation of the aerial sewerline. Sewer and water will tie into existing lines adjacent to the Site. The sewerline connection will cross Smith Creek to the north. The construction corridor and the maintenance easement will be 40-feet in width. The majority of the Site is currently undeveloped and wooded. The northern and western portions of the Site contain mature pines with a relatively open understory. Hardwoods are dominant in the drainage along the eastern boundary. Adjacent parcels to the south and east have been cleared, and a small portion of the Site was also cleared for access to the other parcels. General land use in the area includes commercial and residential development. Project History A Site delineation was completed by Mr. Sean Clark of Sage Ecological Services, Inc. (Sage) in December 2020. A PJD was issued on May 18, 2021 (SAW-2021-00426). A Neuse River Riparian Buffer Determination was not requested as the presence of riparian buffers on the Site are not contested. Foundation Drive Apartments Page 1 of 2 Avoidance and Minimization A stream and wetland delineation was performed to identify environmentally sensitive areas on the Site. No impacts to jurisdictional Waters of the US are proposed. Steeper slopes are proposed adjacent to the outer zones of the riparian buffer to minimize grading impacts in Zone 2. Construction fencing will be used to define the construction corridor and prevent any accidental additional impacts. Silt fencing and appropriate sediment and erosion control devices will be installed to provide additional protection from stormwater runoff. Project Impacts Proposed Zone 1 impacts total 1,590 SF for installation of a sewerline to connect to existing adjacent sewer lines. Zone 2 impacts total 755 SF for sewerline installation. Zone 2 impacts will result from grading for the SCM pond (3,471 SF) and from grading for a parking lot (1,520 SF). No other impacts are proposed. Mitigation Proposed riparian buffer impacts are considered "Allowable Upon Authorization", therefore, no mitigation is required. No other impacts are proposed.
