PROJECT SU1VIl17ARY: The applicant proposes to expand the existing docking facility for a total of three formalized slips within the Ocean Isle Beach canal system. PROJECT DESCRIPTION The proposed project is located on the south end of a concrete canal at 1 Pender Street in Ocean Isle Beach, Brunswick County. General Permit #66692 was issued on 8/24/16 to install a 4' x 12' access pier with a 4' x 6' L-head providing access to a 13' x 13' open boatlift on the south side of the property within the T-head portion of the canal (Slip #1). General Permit #666692 was modified on 8/25/16 to expand the 4' x 6' L-head to a 4' x 10' L-head. Historical imagery from 2016 and an August 2023 DCM site visit reveal that the access pier was originally built and remains as a 5' x 19' access pier with no L-head. No modification can be found for the change in access pier design. Additionally, no permit history can be found for the existing 8' x 24' irregular - shaped floating dock on the west side of the property but aerial imagery suggests it was built between 2005 and 2006. The project site is approximately .15 acres and is vegetated primarily with domestic grasses and ornamental landscaping. The high ground portion is elevated approximately 4' above the normal high water (NHW) level, and the shoreline (+/- 184 linear feet) is stabilized by a concrete bulkhead. There are no indications of any Coastal Wetlands on -site. The applicant's property sits at the south end of man-made canal 46. Residential properties border the project site to the north. Pender Street borders the property to the east and the concrete canal borders the property to the south and west. According to the application, canal #6 measures approximately 79' wide from NHW at the bulkhead in the vicinity of the proposed project site (See Sheet 2 of 4). The waters of the canal system are classified SA by the Division of Water Quality and ARE NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. They are CLOSED to the harvest of shellfish. Based on visual observations made by DCM staff during the August 2023 site visit, there appears to be NO Submerged Aquatic Vegetation (SAV) in the surrounding waters. Water depths in the vicinity of the proposed boatlift range from -2.0' to -3.0', relative to NLW. PROPOSED PROJECT The applicant proposes to expand the existing docking facility for a total of three formalized slips within the Ocean Isle Beach canal system. As proposed, a 13' x 13' open boatlift (Slip #3) would be installed at the pierhead line on the north side of the existing 8' x 24' irregular -shaped floating dock (Slip #2). In order to make room for the proposed open boatlift, the applicant has proposed to shift the existing floating dock 9' to the south. Access to the proposed boatlift would originate from the relocated floating dock (See Sheet 2 of 4). The boatlift would extend approximately 22.5' waterward of NHW, to align with the waterward edge of the adjacent floating dock (Slip #2). The proposed boatlift would extend beyond the 1/4 width of the waterbody but remain landward of the 1/3 width. As proposed, the boatlift would encroach into the northern riparian setback. The applicant received one waiver from the northern riparian landowner. 10. ANTICIPATED IMPACTS The proposed docking facility expansion would result in the incorporation of an additional 169 square feet of Estuarine Waters and Public Trust Area. As proposed, the boatlift would align with the waterward edge of the existing 8' x 24' irregular -shaped floating dock and would not exceed the pierhead line nor be waterward of the existing floating dock location. The proposed boatlift would extend approximately 22.5' waterward of NHW, exceeding the'/4 width but remaining landward of the 1/3 waterbody width. The proposed development would be located inside the northern 15' riparian corridor setback. Water depths in the vicinity of the proposed boatlift range from -2.0' to -3.0', relative to NLW. Minor increases in turbidity should be expected during piling installation. This application is for the relocation of the existing floating dock approx. 9' southeastward toward the "T" canal and the installation of a new 13' x 13' boatlift which will be located adjacent to the floating on the north end. The boatlift will provide dockage for 1 additional vessel, creating a total of 3 slips at the property within existing water depths ranging from -2' to -3' @ normal low water (NLW). As proposed, the boatlift will encroach into the adjacent 15' riparian corridor setback to the north (McGirt at 3 Pender, a waiver has been obtained) and will not exceed the existing pier -head. If this agency does not render a permit decision within 70 days from August 3, 2023 you may request a meeting with the Director of the Division of Coastal Management and permit staff to discuss the status of your project. NCGS 113A-I 19(b) requires that Notice of an application be posted at the location of the proposed development.
