Dear Pedro Fondevila:
The Division of Energy, Mineral and Land Resources (DEMLR)has reviewed your submittal of the No
Exposure Certification for Exclusion from NPDES Stormwater Permitting form,received on July 25,
2023.The Division is unable to concur with your certification of no exposure.
Based on an inspection of your facility on August 8, 2023,Mooresville Regional Office staff found that
open-top dumpsters containing scrap metal were located outside uncovered as well as used cardboard,
wood, and plastic pallets. Additionally, staff observed 2 nitrogen refrigerate tanks exposed to stormwater.
There was no representative from the site available at the time of inspection,therefore site processes
could not be evaluated at the time. Please apply for coverage under an NPDES General Permit
NCG0300000 or fix the above-mentioned issues to qualify with No Exposure applicability and reapply.
