H&H is proposing to install a total of four permanent monitoring wells. One monitoring well is to be located at 2927 Battleground Avenue (AMW-105). Two monitoring wells are to be located in the City of Greensboro Right-of-Way along Stratford Road near 2803 and 2811 Stratford Road (AMW-106 and AMW-107). The remaining monitoring well is to be located on the source property at 2965 Battleground Avenue. Please note that monitoring wells located on the DSCA Source Property do not require a permit, and as such, no permit application is included for this well. Enclosed please find the permit application, well construction details, site maps with the proposed locations, and other relevant information. Only the activities described in Exhibit B attached may be performed, and only within the time periods permitted in Exhibit B. Any expansion of the scope of work in Exhibit B or work past such permitted time periods will require an amendment to this access agreement (or a separate new access agreement) mutually acceptable to Property Owner and Tenant. II. The Division is responsible for manifesting and disposing of all generated wastes associated with the activities on Exhibit B. III. Any independent Contractor of the Division (including but not limited to AECOM Technical Services of North Carolina, Inc.) which is to perform any work on the Property shall first provide copies of Certificates of Insurance to the Property Owner and Tenant documenting the levels of insurance required by the Division, and agrees to maintain such insurance during the performance of activities on the Property. Property Owner and Tenant shall each be named as additional insureds under each such Contractor's general liability policy with respect to any work performed at or affecting the Property. IV. The Property Owner and Tenant will be provided with copies of all reports documenting results of the assessment and subsequent groundwater monitoring. (00398695.3 DSCA Site ID No. Page 5 of 8 41-0045 Exhibit B: Scone and Schedule of Work The proposed scope of work includes the following: Stage 1 The initial mobilization will include the installation of up to eight (8) borings utilizing a direct push drilling rig, at the approximate locations depicted on the attached Exhibit C, for the purpose of collecting groundwater and (where indicated on Exhibit C) soil vapor samples (to determine potential for vapor intrusion into the onsite structure where employees and the public may be exposed). The borings where groundwater will be collected will be installed as temporary monitoring wells (as defined in 15A NCAC 02C .0102 (33)) for the purpose of identifying the limits of the groundwater contamination plume emanating from the adjacent and upgradient dry- cleaning facility and characterizing the central portion of the plume as well. Prior to installation of the temporary wells and vapor sampling points, the vicinities where the wells are proposed will be carefully checked for utilities and other subsurface hazards by both public and private utility locators. The exact locations of each boring for each groundwater sample point and vapor sampling point will be determined by the presence of subsurface and overhead utilities, assessment objectives, and input from the Tenant; but must in each case be confirmed with and approved by Tenant before drilling. Groundwater samples will be collected from each temporary well and submitted to a fixed analytical laboratory for analysis of volatile organic compounds (VOCs) by EPA Method 8260. Soil vapor samples will be collected from the vapor points and submitted to a fixed analytical laboratory for analysis of volatile organic compounds (VOCs) by EPA Method TO-15. Each groundwater sample point that is not also to be utilized as a soil vapor sample point will be properly abandoned in accordance with all applicable laws and state regulations immediately after such groundwater samples are taken, and the surface will be restored, to the extent possible, to its prior condition. Upon completion of sampling from the up to five (5) soil vapor points, they will be properly abandoned in accordance with all applicable laws and state regulations and the surface will be restored, to the extent possible, to its prior condition. Upon completion of work for the initial mobilization and following removal of investigation derived wastes, all associated equipment and materials will be removed from the Property. It is anticipated that the field work for Stage 1 should be completed over a period of approximately four to five days. However, all drilling shall be conducted between Tenant's closing for business on any given day, and Tenant's opening for business on the immediately following day; provided that drilling which is inside the rear fenced portion of the Property may (00398695-3) DSCA Site ID No. Page 6 of 8 41-0045 also be conducted at any approved time on a Sunday (as Tenant's service and parts departments are closed on Sundays). In all cases, scheduling shall be coordinated with and approved in advance by Tenant. All Stage 1 activities described above will be completed on or before August 31, 2014, except that vapor samples from the designated vapor sampling points may be collected by the Division or its Contractors up to July 31, 2016, but notice shall be provided in accordance with Paragraph (3) in the above `Other conditions'. Stage 2 Following the analysis of the data from the first mobilization described above, if necessary, based on laboratory data received from the soil vapor sample points, indoor air samples may need to be collected from the structure on the Property and analyzed for VOCs by EPA Method TO-15 to ensure that employees and the public are not being exposed to vapor phase dry-cleaning contaminants from the subsurface release above applicable action levels. In such case, indoor air samples may be collected in such manner and at such times as coordinated with and approved in advance by Tenant, but in no event later than July 31, 2016. Stage 3 Following the analysis of the data from the Stage 1 described above, the Division may propose that another mobilization to the Property take place for the purpose of installing not more than three (3) groundwater monitoring wells on the Property utilizing direct push technology,hollow stem auger drilling or air rotary drilling methods as necessary. In such event, the Division or its Contractor shall provide a diagram showing the vicinities where the wells are proposed, and the proposed schedule and deadlines for such work, and the proposed maximum duration for sampling from such wells after installed (which shall in no event extend beyond December 31, 2017, unless Property Owner and Tenant agree to a separate written consent). The locations of such wells, and times for drilling thereof, must be coordinated with and approved in advance by Tenant (similar to the process used to determine the locations of and schedule for the Stage 1 borings above). Once location and schedule of Stage 3 monitoring wells are determined,prior to installation of the monitoring wells,the approved approximate locations where the wells are to be installed will be carefully checked for utilities and other subsurface hazards by both public and private utility locators. The exact locations of each monitoring well will be determined by the presence of subsurface and overhead utilities, data from the previous mobilization, assessment objectives, and input from the Tenant; but must in each case be confirmed with and approved by Tenant before drilling. (00398695.3; e DSCA Site ID No. Page 7 of 8 41-0045 Stage 3 mobilization, anticipated to occur approximately three to twelve months after the Stage 1 mobilization (depending on obtaining additional offsite access at other properties as necessary), will also take approximately four to five days, but is subject to the same scheduling limitations as provided above for the Stage 1 borings. Monitoring wells will be constructed in accordance with all applicable state regulations and finished with flush-mount manhole covers and concrete pads and will be suitable for vehicle traffic to drive over. Upon completion, monitoring wells will be properly developed to clear up turbidity and surveyed for horizontal and vertical location. Following installation, surveying and development, water levels will be measured and groundwater samples will be collected from each monitoring well and submitted to a fixed analytical laboratory for analysis of volatile organic compounds (VOCs) by EPA Method 8260. On or before December 31, 2017, barring any additional written consent between the Property Owner and Tenant and the Division extending the timeframe, all groundwater monitoring wells installed on the Property shall be properly abandoned in accordance with all applicable laws and state regulations. Upon completion of work for the Stage 3 mobilization and following removal of investigation derived wastes, all associated equipment and materials (other than the monitoring wells) will be removed from the Property. General If additional time to complete any stage of work is necessary, the Division's independent Contractor shall notify Tenant and request an extension of time; but the above-time limits may not be exceeded without approval of Property Owner and Tenant. Additionally, the Division's independent Contractor will coordinate with the Property Owner and Tenant to ensure that disturbances at the Property are minimized. Once the work is completed, it is anticipated that the initial laboratory results should be back in about two weeks. The final report for each Stage of work should take approximately five to seven weeks following receipt of the lab data. The DSCA Program will send the Property Owner and Tenant a copy of the final report(s) once completed. If any remediation on the Property is determined by the Division to be necessary, then the Division shall present the proposed work to Property Owner and Tenant for consideration; but no such work will be performed until the scope thereof and schedule therefor have been set forth in another access agreement similar in content and detail to this agreement. As part of the additional proposed scope of work, one additional permanent monitoring well will be installed at the location indicated on Exhibit B. In addition, two temporary soil borings and one temporary soil gas monitoring point will be installed at the locations indicated on Exhibit B. Additional details regarding the scope of work are detailed below. Prior to subsurface activities, the proposed boring locations will be checked for utilities and other subsurface hazards by both public and private utility locators. The exact boring locations may vary depending on the presence of subsurface and overhead utilities or other structures. Approval of the final boring locations will be obtained from the Tenant prior to drilling. The first five feet of each boring will be advanced using a hand auger(to the extent practicable) in order to clear potential utilities. Below a depth of approximately five feet below ground surface, the borings will be advanced with a direct-push technology or hollow stem auger drilling rig. The monitoring well will be constructed in accordance with applicable state regulations and finished with a flush-mount manhole cover and concrete pad that will be suitable for vehicle traffic to drive over. After installation, water levels will be measured and groundwater samples will be collected from the two monitoring wells on the property (one existing and one proposed). The samples will be submitted to a certified laboratory for analysis of volatile organic compounds (VOCs) by EPA Method 8260. After the initial sampling event, the monitoring wells will remain in-place and be used periodically for sampling, as referenced further below. At the two proposed soil boring locations, a temporary boring will be advanced and used for soil sample collection. The soil samples will be submitted to a certified laboratory for analysis of VOCs by EPA Method 8260. At the conclusion of soil sampling activities, the borings will be properly abandoned and the surface restored, to the extent practicable, to its prior condition. At the proposed soil gas sampling location, a temporary soil gas monitoring point will be installed using Teflon tubing. Soil gas samples will then be collected from the monitoring point and submitted to a certified laboratory for analysis of tetrachloroethylene and associated degradation products by EPA Method TO-15. At the conclusion of soil gas sampling activities, the monitoring point will be removed and the boring will be properly abandoned and the surface restored,to the extent practicable, to its prior condition. Upon completion of sampling activities, equipment, materials, and investigation derived wastes will be removed from the property. The initial phase of field work referenced above will be completed over a period of approximately two weeks. Scheduling shall be coordinated with and approved in advance by Tenant. Following the initial phase of field work referenced above, periodic sampling of the two monitoring wells (one existing and one proposed) will be performed using procedures similar to those described above.As detailed in the July 2022 Access Consent Amendment, the monitoring wells will remain in-place until either(1)the Division notifies the property owner and tenant of the intent to abandon the wells, or (2) the property owner or tenant requests that the Division abandon the monitoring wells. Abandonment of the monitoring wells will be performed in accordance with all applicable laws and state regulations.
