In order to compensate for impacts associated with this permit, mitigation shall be provided in accordance with the provisions outlined on the most recent version of the attached Compensatory Mitigation Responsibility Transfer Form. The requirements of this form, including any special conditions listed on this form, are hereby incorporated as special conditions of this permit authorization. 2. Stream SD must be monitored in accordance with the following plan: Three pressure transducers must be installed prior to construction (per the enclosed plan entitled "Apollo" "Groundwater Monitoring Locations" dated February 2023),including • one ambient (air pressure), • one adjacent to the stream bank immediately downstream of Impact#3 (hydrologic, to document impact to base flows,if any), and • one within Stream SA between Impact#5 and its confluence with Stream SB (reference). They, along with photo monitoring stations, must be visited (photographs taken and data downloaded) monthly for five years. Annual monitoring reports showing these photographs and data must be submitted to the Corps no later than December 31s' of each monitoring year. If at the end of the monitoring period the monitoring results indicate that more than natural variations in the feature's hydrology have resulted from project construction, compensatory mitigation (i.e. purchasing stream credits) will be required at a 1:1 ratio for indirect impacts (reduction in aquatic function) in the reach of Stream SD between Impact 4 and its confluence with Stream SB. 3. Following construction, temporary wetland impact areas must be restored to natural grades, seeded with a regionally appropriate native wetland seed mix, and matted with natural fiber matting. 4. Suitable habitat for tricolored bat(Perimyotis subflavus) may be present at the site. On September 149 2022, the USFWS published a proposal in the Federal Register to list the tricolored bat as endangered under the Endangered Species Act(ESA). The permittee understands and agrees that all work associated with the clearing and removal of trees and removal or modification of culverts must be completed prior to September 15, 2023. Work associated with the aforementioned activities not completed by September 15, 2023, must cease and the permittee must contact Rachel Capito of the Corps' at (919) 440-1823 or Rachel.A.Capito@usace.army.mil to determine if additional coordination with the United States Fish and Wildlife Service is required under Section 7 of the Endangered Species Act prior to continuing work. 5. Please note that future impacts and/or phases of the Lennar Apollo 55 residential development and related activities associated with Corps Action ID: SAW-2019-02355 may be considered part of a single and complete project; these impacts may be considered cumulative with impacts permitted during earlier phases with respect to compensatory mitigation and Nationwide Permit thresholds. Current cumulative impacts to aquatic resources considered a permanent loss of waters for the Lennar Apollo 55 single and complete project include 0.026 acre (395 linear feet) of stream channel and 0.338 acre of wetlands, or 0.364 acre of total potential waters of the US. Once the Sponsor has signed this form, it is the Permittee's responsibility to ensure that Wilmington District Project Manager identified on page two is in receipt of a signed copy of this form before conducting authorized impacts, unless otherwise specified below.
