On May 13, 2015, the Water Quality Committee of the North Carolina Environmental Management Commission (Commission) denied your request for a variance. The Final Agency Decision was issued on June l8,2OI5. I5ANCACO2B.0283(9)(cViii\states that upon the Commission's denial, the Division shall issue a final decision denying the major variance. In accordance with 15AyWCAC 02B.0233, your application for a major variance from the Neuse buffer rules is hereby denied. This decision can be contested as provided in Articles 3 and 4 of General Statute 150B by filing a written petition for an administrative hearing to the Office of Administrative Hearings (hereby known as OAH) within sixty (60) calendar days.
