Dear Mr. Church and Mr. Strickland:
The Division of Energy, Mineral and Land Resources (DEMLR), received a Stormwater
Management Permit Application for the subject project on December 19, 2022. A review of that
information has determined that the application is not complete. The following information is
needed to continue the stormwater review:
1. General MDC 3 —Please show the vegetated side slope of the SCM in the plan view.
2. Sand Filter MDC 6—Please specify that the sand media be ASTM C33 or equivalent on
the plans.
3. Off-site Areas—Per 15A NCAC 02H .1003(3)(b) any off-site areas that drain to the SCM
must be accounted for at their full build-out potential. This can be accomplished by
having the property owners enter int a legal agreement limiting the amount of BUA and
drainage area directed from the off-site property to the SCM or by assuming that the off-
site area is 100% BUA (its full build-out potential). Please see note following these
comments for more information. It is recommended to bypass this off-site drainage area
around the proposed SCM. If that is not possible, accounting for the off-site area as 100%
BUA should not be an issue since the SCM appears to be oversized (the provided design

volume of the SCM is greater than the minimum required design volume for the SCM
and should be able to account for the off-site "BUA"). Please revise as needed.
4. Sediment Chamber/Sand Chamber Volumes—Please ensure that the 3" stone aggregate
layer placed at the top of the sand layer is accounted for in the volume sizing of the sand
chamber. The provided calculations do not take into account the volume of the stones that
reduces (slightly) the volume provided in the sand chamber. Similarly, the volume of the
sand chamber should not include the volume provided upstream of the weir (@ 788.25')
separating the sediment chamber from the sand chamber. The volume provided in this
portion of the vault should be included in the sediment chamber volume not the sand
chamber volume (this results in sediment and sand chamber volumes that are more
equivalent, which is required per Sand Filter MDC 2).
5. Please correct the following issues with the Application:
a. Section IV, 10— See earlier comment with regard to off-site BUA, revise as needed.
6. Please correct the following issues with the Supplement-EZ Form:
a. Cover Page:
i. Line 7—Please include this value in accordance with 15A NCAC 02H .1003(4)
& .1017(10). It is noted that there are no surface waters located on-site, however
we ask that this value be included. Lines 8-10 can be left as-is since there are no
surface waters associated with this project.
b. Drainage Areas Page:
i. Entire Site Column:
1. The entire site column is an accounting of the entire project area (similar to
how the drainage area column is an accounting of the entire area draining to
the SCM). When asked for the "drainage area" of the entire site, please enter
the project area. Please note that any BUA that is located within the project
area but not draining to the SCM should be included in this column (in addition
to the BUA that is located within the project area and draining to the SCM).
2. Line 18—This item should reflect the value in Section IV, 8 of the Application
(the %BUA for the entire site). NOTE: Since this site has existing BUA, the
calculation method shown in 15A NCAC 02H .1003(1)(b) can be used to
calculate this value.
3. Lines 19-21 —These items are not needed for the entire site column.
ii. Sand Filter DA Column:
1. Line 11 —See earlier comment with regard to off-site BUA, revise as needed.
2. Line 20—The design volume of a sand filter is the volume that can be stored
above the bottom of the sediment chamber/top of the sand layer(@788.0') and
below the lowest bypass invert(weir @ 790.0'). It is equal to the sum of Lines
23 & 30 on the Sand Filter Page.
c. Sand Filter Page:
i. Line 2—This value may need to be revised to account for the off-site BUA. Please
revise as needed. NOTE: This value is different than the design volume and is
based on the drainage area to the SCM.
ii. Line 19—Please elaborate in the additional information section (Line 43) that this
design is a hybrid, in that there are portions of the design that are both open
bottomed and closed bottomed.
iii. Lines 23 & 30— See earlier comment with regard to the SCM chamber volumes.
Revise as needed.
iv. Line 29—The weir separating the sediment chamber from the sand chamber
appears to be located at elevation 788.25'.
v. Line 32—Please ensure that the portion of the vault upstream of the weir (@
788.25') is not included in the sand chamber surface area.
7. Electronic Files—Please upload the electronic files for this project, as instructed via
email sent on 12/20/2023, to our electronic repository (link in following comment).
Electronic files are required per 15A NCAC 02H .1042(2).
8. Provide PDFs of all revisions, 2 hardcopies of revised plan sheets, 1 hardcopy of other
documents, and a response to comments letter briefly describing how the comments have
been addressed.

Please reach out to me prior to hand delivering a submission to make sure that I
(or someone else in my group) will be able to receive the submission. Do not
leave the package in the foyer with the security guard.
NOTE: Hard copies should not be sent to a Regional Office. Doing so will delay
the review process and the submission package may be lost while being sent from
the Regional Office to me in the Central Office.
While it is not required, it is recommended that the off-site drainage from upstream properties be
diverted around the SCM since the Applicant cannot maintain control over the development of
property that they do not own. If the Applicant elects to account for off-site drainage, it must
either be accounted for as 100% BUA (its full build out potential, or there must be a recorded
legal agreement in place between the Applicant and the Owner of the upstream property in which
the Owner of the upstream property agrees to record a deed restriction limiting the
minimum/maximum amount of BUA on the upstream property that will be treated in the
Applicant's SCM, the locations and sizes of access and drainage easements, how construction
and/or ongoing maintenance costs will be handled, maintenance responsibility, a list of legal
recourses available to each party should one party fail to hold up their end of the agreement, and
any other related legal issues.
Please note that this request for additional information is in response to a preliminary review.
The requested information should be received by this Office prior to April 15, 2023, or the
application will be returned as incomplete. The return of a project will necessitate resubmittal
of all required items, including the application fee. Please reference the State assigned project
number SW4221202 on all correspondence.
If you need additional time to submit the information, please submit your request for a time
extension to the Division at the contact below. The request must indicate the date by which you
expect to submit the required information. The Division is allowed 90 days from the receipt of
a completed application to issue the permit.
The construction of any impervious surfaces, other than a construction entrance under an
approved Sedimentation Erosion Control Plan, is a violation of NCGS 143-215.1 and is subject
to enforcement action pursuant to NCGS 143-215.6A.
