On April 28, 2015, you requested a 401 Water Quality Certification from the Division of Water Resources
(Division). On June 3, 2015, the Division sent a request for additional information letter. On June 25, 2015, DWR
received a request via email from Terry Allen with T.E. Allen Engineering requesting to withdraw the current
application. Therefore, your file is hereby considered withdrawn. The request outlined that the seawall and
boathouse would not be built. The request indicated that a new dock would replace the existing dock and the
Army Corps of Engineers had been notified of the new approach. This approach, driving the dock pilings, was
verified with the Corps and will not initiate permitting.
Please be aware that you have no authorization under Section 401 of the Clean Water Act for this activity and any
work done within waters of the state may be a violation of North Carolina General Statutes and Administrative
Code.
