The property is currently vacant forested land. It is bordered on the east by the railroad tracks, on the west by NC147, south by Ellis Rd., and on the
north by industrial properties. Other industrial properties and a charter school exist on the south side of Ellis Road.

The entire 302 acres were delineated and field verified by the USACE and City of Durham (COD). The site plan was developed to avoid as many
impacts as possible. The residential apartment community within Phase 1 and requested here avoided all regulated wetlands, streams and buffers.
The only impacts requested are for the installation of the sanitary sewer outfall required to connect the apartments community to the existing COD
sanitary sewer system.

The sanitary sewer installation will comply with all NWP12 & GC3884 conditions as well and all other State and Local regulations applying to sanitary
sewer systems and erosion and sediment control regulations.

The requested sanitary sewer does not require an SMP However, the proposed residential apartment community to which the sewer will connect as

The overall project being the Ellis Road Assemblage is a Phased development that is anticipated to require additional impacts to streams, wetlands
and riparian buffers. However, the details of these impacts have not yet been identified. The applicant understands that future impacts will be
cumulative to these impacts. All development will be subject to Durham stormwater and water quality protection ordinances to include the protection of
riparian buffers and requirement for approved SMPs and associated BMP devices. As such, nearby downstream water quality will be protected.

Explanation: The feature(s) listed on the attached Table 1 have been located on the Soil Survey
of Durham County, North Carolina and /or the most recent copy of the USGS Topographic map at
a 1:24,000 scale, or was determined to be subject per section 8.5(B)(4) of the Durham Unified
Development Ordinance. Each feature that is checked "Not Subject" has been determined not to
be a stream or is not present on the property. Features that are checked "Subject" have been
located on the property and possess characteristics that qualify it to be a stream. There may be
other streams located on your property that do not show up on the maps referenced above but,
still may be considered jurisdictional according to the US Army Corps of Engineers and /or to the
Division of Water Resources (DWR).
This on -site determination shall expire five (5) years from the date of determination in this
letter. Landowners or affected parties that dispute a determination made by the City of
Durham may request a determination by the N.C. Division of Water Resources. An appeal
request must be made within sixty (60) calendar days of date of this letter or from the date
the affected party (including downstream and /or adjacent owners) is notified of this
letter. A request for a determination by the DWR shall be referred to DWR in writing c/o
Karen Higgins, Surface Water Protection Section, 1650 Mail Service Center, Raleigh, NC
27699 -1650.
DWR's determination can be contested as provided in Articles 3 and 4 of General Statute 150B by
filing a written petition for an administrative hearing to the Office of Administrative Hearings

(hereby known as OAH). A petition form may be obtained from the OAH at

petition is considered filed when the original and one (1) copy along with any applicable OAH
filing fee is received in the OAH during normal office hours (Monday through Friday between
8:OOam and S:OOpm, excluding official state holidays).
The petition may be faxed to the OAH at (919) 431 -3100, provided the original and one copy of
the petition along with any applicable OAH filing fee is received by the OAH within five (5)
business days following the faxed transmission.
