Dear Mr. Shaeffer and Ms. Higgins,
On behalf of Woodfield Investments, we are requesting authorization from the USACE to use NWP 29
for 90 if of permanent stream impacts for the construction of the proposed apartment complex. The
proposed impacts are less than 150 if and will occur to a non - buffered stream, and therefore, written
authorization from NCDWR is not required in regards to 401 requirements. However, we are
requesting a Buffer Authorization for 1,053 sq ft of permanent impacts to Neuse River Riparian
Buffers for the construction of a greenway trail and stormwater BMP bypass outfall.
The project is ±11.35 acres in size and is located in the southeast quadrant of the intersection of
Weston Parkway and Evans Road in Cary, Wake County (Latitude: 35.8261 °N; Longitude: -
78.8040 °W). The project is located in the Neuse River basin (HUC 03020201) and the site drains to
Crabtree Creek. The Water Quality Classification for Crabtree Creek is C; NSW and the Stream Index
Number is: 27-3341)•
Proposed Proiect
The purpose of the proposed project is to construct a 308 unit apartment complex to meet the
demand for housing within the Weston Parkway commercial corridor. The proposed project consists
of the construction of three apartment buildings, an amenity pool, a parking deck and associated
infrastructure (i.e. internal roads, utilities, greenway, stormwater management, etc).
The proposed apartment complex will provide housing within walking distance of 4000+ jobs within
the numerous offices along the Weston Parkway corridor. By providing housing within walking
distance of jobs, the project will help to decrease traffic on the main thoroughfares during the
morning and afternoon rush hour commutes.
Proiect History
The site was originally reviewed by David Shaeffer on May 31ST, 2013 (SAW -2013- 01605) and
confirmed that there were no wetlands on the site and three jurisdictional streams. I have enclosed
a Preliminary JD Request which documents the site conditions reviewed by David Shaffer in 2013.
We are requesting issuance of the Preliminary JD in conjunction with issuance of the NWP 29.

In an email dated March 27th, 2015, David Shaeffer confirmed that there were no prior permitting
actions associated with the subject property, and that any proposed impacts for the current project
would not be considered cumulative with any previous projects. A copy of the email has been
provided as an Appendix.
NCDWR issued a Buffer Determination Letter (NBRRO# 14 -365) on October 7th, 2014. A copy of the
Buffer Determination letter has been provided as an Appendix.
Proposed Impacts
The proposed impacts consist of go if of permanent stream impacts and 1,053 sq ft of permanent
buffer impacts.
The proposed go if of permanent stream impacts (Impact #3) will occur from construction of building

The proposed 1,053 sq ft of permanent buffer impacts will occur at Impacts 1 & 2. Impact #1 (Zone 2:
174 sq ft) consists of the construction of a 6' wide greenway trail, which will connect to the existing
greenway trail along the southern property boundary. Impact #2 (Zone 1: 633 sq ft; Zone 2: 246 sq
ft) is required for the construction of the high flow bypass for the constructed wetland BMP.
Avoidance and Minimization
Prior to site plan design, the applicant requested that a detailed wetland delineation be conducted
so that impacts to wetlands and "waters" could be minimized.
The site design is constrained by the perennial stream and associated loo' Town of Cary buffers
along the southern property boundary. Additionally, due to the topography of the site, the
stormwater BMP must be located in the southern portion of the site, which is the lowest area, and
could not be relocated anywhere else on the site without massive earth removal to lower the grade
of the entire site, for which the cost would render the project unfeasible. These two constraints
pushed the proposed layout further north, resulting in impacts to the northern stream.
The proposed impacts have been limited to the northern stream. The proposed design will impact
the entire go if of the northern stream as a result of tying site fill to the existing grade at Weston
Parkway. The downstream portions of the stream proposed to be impacted have been historically
piped for the construction of Weston Parkway, Sage Commons and the Marriott Hotel. Additionally,
this stream is an unmapped, unbuffered stream and is fed entirely by ephemeral upland runoff, with
no wetlands upstream or adjacent to the stream. Overall, the functional value of the onsite stream
is extremely low, and should be considered an unimportant intermittent stream.
Therefore, impacts have been minimized to the greatest extent practicable, while maintaining a
feasible project.
Mitigation
Since the proposed impacts are less than 150 If, and will occur to a low quality remnant stream, no
mitigation is proposed.

Stormwater Management Plan
The stormwater management plan consists of a constructed wetland, which will provided go% TSS
removal, as well as nitrogen removal. The stormwater management plan will be reviewed and
approved by the Town of Cary.
The current request is for go if of permanent stream impacts and 1,053 sq ft of permanent buffer
impacts (see the attached maps and PCN for details).

David Shaeffer conducted a site visit with S &EC on May 31, 2013 (SAW- 2013 - 01605) and determined that there were no
wetlands, and the only jurisdictional features were the intermittent stream in the west, and a large perennial stream along
the southern property boundary. S &EC never submitted a JD Request associated with this site visit. Therefore, a
Preliminary JD Request has been submitted with this PCN, and we are requesting issuance of the Preliminary JD in
conjunction with issuance of the NWP 29.

W &R reviewed the NC Natural Heritage Program database, located at httos:// ncnhde .natureserve.orq /content/mao to
identify if there were any known occurrences of endangered species on or near the proposed project. The review of the
NHP data did not identify any occurrences of endangered species or critical habitat on the subject property or within 1.0
miles of the project, see attached NCNHP project review letter. Site reviews did not identify any potential habitat for any
federally protected species known to occur in Wake County, except for the Northern Long Eared Bat.
Potential habitat for the northern Long -eared bat (NLEB) is listed as mature forest with trees over 3" dbh, which is used
for roosting during the day. Since the entire project area consists of mature forest over 3" DBH, there is potential northern
long eared bat habitat present. In an email from USFWS dated April 15, 2015, the USFWS has specified that a project
may result in an adverse effect on the NLEB is there will be cutting or destroying of mature forest within 0.25 miles of an
known roosting site, or if the project involves the cutting or destroying of known, occupied roost trees during the pup
season (June 1St — July 31St). The only known active roost tree site is in Currituck County. Therefore, the proposed
project is not located within 0.25 miles of any known roost trees. Furthermore, clearing of mature forest between June 1 St
and July 31 st is not anticipated for construction of the proposed project. Therefore, W &R concludes that the project "may
affect, but is not likely to adversely affect" the northern long -eared bat.

Thanks for the info. I'll plan on submitting a JD Request Packet with the PCN to tie up the loose ends.
This parcel is part of the overall Weston PUD, which literally includes everything on Weston Parkway. But I'm pretty sure
that each parcel that was developed that required impacts has been permitted separately. This project is just southeast
of the MetLife site. I believe that MetLife had impacts that required permitting. So the permitting for this site would be
the same as the MetLife site.

David - you conducted a site visit to verify the wetland delineation with S &EC on May 31, 2013. 1 believe they may have
simply called the site "Weston Site ". I unfortunately don't have the AID #.
Sarah Knies issued a buffer determination for the site on October 7, 2014 (NBRRO #14 -365).
I have attached the proposed site plan which exhibits the proposed 90 If of stream impacts in the northwestern portion
of the site for construction of an apartment building. The site design is constrained by the perennial stream and
associated buffers along the southern property boundary. Additionally, due to the topography of the site, the
stormwater BMP must be located in the southern portion of the site which is the lowest area of the site. This pushed
the proposed design further north, resulting in impacts to the northern stream. The proposed design will result in the
impact to the entire 90 If of onsite stream as a result of tying fill for the apartment building to existing grade at Weston
Parkway.
The downstream portions of the stream proposed to be impacted have been historically piped for the construction of
Weston Parkway, Sage Commons and the Merriot Hotel. Only 90 If of the stream remains upstream of Weston Parkway
within the proposed project site. Furthermore, the stream proposed to be impacted is an unmapped, unbuffered
stream and is fed entirely by ephemeral upland runoff, with no wetlands upstream or adjacent to the stream. Overall,
the functional value of this section of stream is extremely low, and should be considered an unimportant intermittent
stream.
I would like to get your feedback prior to submitting the PCN so that I can address any comments or concerns in the
PCN. Also, since the stream impacts are less than 150 If and will occur to an unimportant intermittent channel, I was to
confirm that mitigation will not be required.

I. REQUESTS FOR CORPS APPROVAL OF SURVEY PLAT
Prior to final production of a Plat, the Wilmington District recommends that the Land
Surveyor electronically submit a draft of a Survey Plat to the Corps project manager for
review.
Due to storage limitations of our administrative records, the Corps requires that all hard -
copy submittals include at least one original Plat (to scale) that is no larder than 11 "x17"
(the use of match lines for larger tracts acceptable). Additional copies of a plat, including
those larger than I I "xI7 ", may also be submitted for Corps signature as needed. The
Corps also accepts electronic submittals of plats, such as those transmitted as a Portable
Document Format (PDF) file. Upon verification, the Corps can electronically sign these
plats and return them via e -mail to the requestor.

1. The Corps of Engineers believes that there may be jurisdictional waters of the
United States on the subject site, and the permit applicant or other affected party
who requested this preliminary JD is hereby advised of his or her option to
request and obtain an approved jurisdictional determination (JD) for that site.
Nevertheless, the permit applicant or other person who requested this
preliminary JD has declined to exercise the option to obtain an approved JD in
this instance and at this time.
2. In any circumstance where a permit applicant obtains an individual permit, or
a Nationwide General Permit (NWP) or other general permit verification requiring
"pre- construction notification" (PCN), or requests verification for a non - reporting
NWP or other general permit, and the permit applicant has not requested an
approved JD for the activity, the permit applicant is hereby made aware of the
following: (1) the permit applicant has elected to seek a permit authorization
based on a preliminary JD, which does not make an official determination of
jurisdictional waters; (2) that the applicant has the option to request an approved
