The current use of the subject property within the Tar-Pamlico Riparian Buffer is agriculture. This use has been ongoing before the subject buffer rules came into effect. Provided that the subject buffer area remains in agriculture, disturbance of this area from adjacent construction will not require a buffer authorization. We show a temporary disturbance on the Erosion and Sedimentatin Control Plan wiithin the 20 foot wide stirp (Zone 2) of the Riparian Buffer. The present use is farm land and the developer proposes to return the use to farm land upon completion of the construction of the stormwater pond. Is this acceptable within the regulations.
