Dear Mr. Perez/Ms. Goss,
On behalf of Commonwealth Development Corporation, we are providing a response to the Request for
Additional Information (RAI) email received on June 28, 2023 for Fairhaven Glen, an approximately 16.75-
acre site located at 8301 and 8329 Nations Ford Road in Charlotte, North Carolina with Mecklenburg
County (the Site).
The revised Impacts Maps have been attached showing adjustments to Stream Impacts 1b, 1c, and 1d,
with additions of Stream Impacts 1e and 1f. These impacts have been adjusted/added due to the site design
changes involving the shift of the retaining wall north of Stream Impacts 1a-1f. The retaining wall was shifted
north as much as possible while still adhering to the City of Charlotte’s site design requirements. The City
of Charlotte requires the sidewalk, but made a project allowance to shift it 5’ closer to the curb providing an
8’ planting strip instead of 13’. Therefore, the retaining wall was moved with the sidewalk providing more
clearance from the jurisdictional stream.
Since the time of initial application, a discrepancy was identified in the calculations for three of the four
proposed dissipator pad locations (Impacts 1h, 2b, and 3c) resulting in decreases in permanent, no loss
impacts resulting from installation.
Additional revisions to the sewer line plans were also required. The City of Charlotte is requiring a 20-ft
easement for the sewer line rather than the 15-ft easement initially proposed, altering Impacts 4a and 4b.
A data discrepancy was also noted for these impacts, but the updated totals have been confirmed to be
correct. The location of the proposed underground directional bore (Sheet CWI-2.6) has shifted to avoid
the stormwater BMP easement. The bore will still avoid impacts to jurisdictional features.
Due to these changes, an updated Stream Impacts Table (Table 1) is provided on the following page for
ePCN sections D.3a-3h. New Impact rows and impact total adjustments are highlighted.

Mitigation Updates
Due to the site design changes to the retaining wall and stream relocation, and per the request of the
USACE, required mitigation has changed. Impacts 1d will result in 17 linear feet of permanent stream
impact to be replaced by a stream realignment. Additionally, Impacts 1c and 1e will result in 78 linear feet
of indirect loss to be replaced by a stream realignment. Based on feedback from the USACE, the reach of
streambed subject to stream realignment will require a 1:1 ratio. Therefore, 95 linear feet of stream credits
is proposed for these impacts.
Impact 1g, 111 linear feet of permanent impact associated with a road crossing, is proposed to be mitigated
at a 2:1 ratio, requiring 222 linear feet of stream credits.
Mitigation for Impacts relating to Stream E have not changed and remain at a 1.5:1 ratio for the 127 linear
feet of permanent loss impacts for this feature (impacts 2a and 3b) due to medium quality ranking per an
NC SAM analysis. Resulting in 191 stream credits for impacts to Stream E.
The permanent – no loss stream impacts for the riprap pad installation will not require mitigation due to the
proper design of keyed in riprap. The placement of the riprap dissipator pads keyed into existing grade
maintains the existing stream location and acts to protect it from erosion. Therefore, it is considered “no net
loss” or permanent impact resulting in no loss and does not count towards stream impact limits or mitigation.
In total, this project will require 508 stream credits. Mitigation is also itemized in Table 2 below.
The comments are outlined below in italics and are grouped by impact, with USACE comments in blue. Our
response is below each comment.
1) USACE comments
1. Please provide an overall site plan showing all proposed residential structures.
The overall site plan showing all proposed residential structures is attached.
2. Please explain in detail the need for the two proposed road crossings for Doverdale Lane
(proposed permanent impacts 1c and 3b). It isn't clear from you application why the site cannot be
redesigned with the road connection shifted further west in the project area, outside of jurisdictional
waters.
The City of Charlotte Department of Transportation required Doverdale Lane to extend across the
site in order to connect to the southern adjoining property. There was the option to extend
Carrolwood Drive as well but it would not eliminate the need to extend Doverdale Lane.
Doverdale Lane is a thoroughfare planning requirement. Several attempts were made to avoid this
crossing during conceptual design reviews; however, both the planning and transportation
departments maintained the requirement.
The project is not feasible without Doverdale Lane.
3. It isn't clear to me what the below highlighted area represents, but it appears to be a sidewalk.
Please explain in detail why the proposed stream realignment cannot be avoided entirely by
eliminating the southern sidewalk (i.e., the highlighted area below) and shifting the proposed cast-
in-place headwall closer to the roadway.
This is required as part of the City of Charlotte standard street section, required for all new public
streets. This is a requirement for safe pedestrian connectivity.
As mentioned above, a request was made to the City of Charlotte to adjust the right-of-way and
sidewalk. The City permitted the retaining wall to north as much as possible while still adhering to
the City of Charlotte’s site design requirements. The City of Charlotte requires the sidewalk, but it
was allowed to be shifted 5’ closer to the curb providing an 8’ planting strip instead of 13’.
4. If the proposed stream realignment cannot be avoided, I have serious concerns with the
proposed location of the realigned channel. Based on my measurement, it appears the stream
would be relocated to within two feet of the cast-in-place headwall. With no indication of natural
channel design indicated or explained in detail in the Pre-Construction Notification, the Corps will
require 1:1 mitigation for the total reach of streambed subject to realignment. This mitigation
requirement would act as a safeguard against potential short- and long-term stability issues.
Due to the site design, mitigation will be paid at the 1:1 ratio for the total reach of streambed subject
to realignment. This will include 17 lf of permanent impact from road fill (Impact 1d) and 78 lf of
indirect loss impact (Impacts 1 c and 1e) due to the need to realign the stream a reasonable
distance from the proposed headwall for long-term stability.
5. Please itemize and differentiate which impacts are proposed for verification under a Nationwide
Permit 18 and a Nationwide Permit 29.

Contractor will follow the following construction sequence:
·Contractor shall notify the Mecklenburg County Department of Public
Utilities 48-hours in advance of start of work during a period of time
with no rain in the forecast.
·Prior to start of work, contractor shall have all materials and
equipment on-site. For utility crossings with casings, the carrier pipe
shall be installed within the casing pipe prior to any open cut activities.
·Contractor shall install a temporary coffer dam on the upstream side of
the proposed crossing and pump water around the open cut area to
the downstream side.
·Contractor shall place the culvert or utility casing with carrier pipe at
elevations shown on the approved plans and backfill in accordance
with Mecklenburg County Department of Public Utilities specifications.
·Contractor shall restore channel and seed and stabilize any disturbance
with native species within 24-hours of start of work.

Dear Mr. Nesburg,
Wildlands Holdings VI, LLC, owned and operated by Wildlands Engineering, Inc., currently has sufficient stream
credits from the Wildlands Catawba 01 Umbrella Mitigation Bank: Firestone Mitigation Site and Double Rock
Mitigation Site to partially satisfy the stream mitigation requirements related to the above-mentioned project.
The project is located within the Catawba River Basin of the service area (HUC 03050101) of the Bank. Please
note that we are expecting additional stream credits to be released in August/September of 2023.
This letter is simply a statement of availability of credits as of the date written. It is neither a guarantee of
future credit availability, nor a guarantee of credit pricing. Credits are sold on a first come, first serve basis at
the Bank’s price at the time an invoice is requested. Invoices reserve both the credits and the price for a period
of 30 days. Credits and associated pricing may be reserved for up to 6 months with a signed reservation
agreement and a 10% deposit.
Final transfer of the credits will be made upon receipt of a copy of the US Army Corps of Engineers
Compensatory Mitigation Responsibility Transfer Form approving the Stream and/or wetland mitigation
purchase from the Bank and upon receipt of your payment to Wildlands Holdings VI, LLC.

The purpose of this letter is to notify you that the NCDEQ Division of Mitigation Services (DMS) is willing to
accept payment for compensatory mitigation for impacts associated with the above referenced project as
indicated in the table below. Please note that this decision does not assure that participation in the DMS in-
lieu fee mitigation program will be approved by the permit issuing agencies as mitigation for project impacts.
It is the responsibility of the applicant to contact permitting agencies to determine if payment to the DMS will
be approved. You must also comply with all other state, federal or local government permits, regulations or
authorizations associated with the proposed activity including G.S. § 143-214.11.
This acceptance is valid for six months from the date of this letter and is not transferable. If we have not
received a copy of the issued 404 Permit/401 Certification within this time frame, this acceptance will
expire. It is the applicant’s responsibility to send copies of the permits to DMS. Once DMS receives a copy
of the permit(s) an invoice will be issued based on the required mitigation in that permit and payment must
be made prior to conducting the authorized work. The amount of the in-lieu fee to be paid by an applicant is
calculated based upon the Fee Schedule and policies listed on the DMS website.
Based on the information supplied by you in your request to use the DMS, the impacts for which you are
requesting compensatory mitigation credit are summarized in the following table. The amount of mitigation
required and assigned to DMS for this impact is determined by permitting agencies and may exceed the
impact amounts shown below.
