Please note that the proposed impacts will occur to a stream not subject to Jordan Lake Buffers, and therefore does not require written authorization from NCDWR. However, we are providing a courtesy submittal to NCDWR, and are requesting an email documenting that written concurrence is not required. The project is ±76 acres in size and is located south of the intersection of Lewter Shop Road and Ferrell Road West in Chatham County (Latitude: 35.79o828 °N; Longitude: - 78.938686 °W). The project is located in the Cape Fear River Qordan) basin (HUC 03030002) and onsite waters drain to Rocky Ford Branch. The Water Quality Classification for Rocky Ford Branch is WS -V; NSW and the Stream Index Number is: 16- 41- 6- 441). Proposed Proiect The proposed project consists of the construction of a residential subdivision to meet the growing demand for residential housing in the area. Proiect History Onsite wetlands were delineated by Withers and Ravenel and preliminarily approved by Andy Williams with the Corps of Engineers on November 21ST, 2014 (AID 200620036). I have included a Wetland Location Exhibit and an inventory table for the onsite jurisdictional features. For the purpose of the JD, the entire pond bottom is considered jurisdictional wetlands, and is now labeled as Wetland B. The Town of Cary issued a Buffer Determination Letter for the project on June 1St, 2015, which reflects the drained pond. A copy of the Buffer Determination Letter has been provided as an Appendix. Please note that Impact A will occur to an unbuffered section of this stream. The Town of Cary determined that the origin of the Jordan Lake buffers began at a point further downstream than the starting point of the stream determined by the Corps based on ordinary high water indicators. Therefore, the section of stream being impacted at Impact A is not subject to Jordan Lake Buffers. Proposed Impacts The proposed impacts consist of 121 if of permanent stream impacts for construction of Cool Oaks Drive, which will provide access to Lots 7, 8 & 9. Avoidance and Minimization Prior to site plan design, the applicant requested that a detailed wetland delineation be conducted so that impacts to wetlands and "waters" could be minimized. Proposed impacts have been minimized to only a single stream impact necessary to construct a road crossing access developable uplands. The proposed stream crossing for Cool Oaks Drive has been designed to cross the stream at as close to perpendicular as possible. Please note that that Cool Oaks Drive will also serve as the road stub to meet the Town of Cary's requirements to stub to all property lines. In the event that the property to the east is developed, the design of that property will require connection to Cool Oaks Drive. This resulted in the design of the road being unable to curve the road to make the crossing more perpendicular, as the curve would be too sharp to meet the minimum curve radii requirements by the Town of Cary. Therefore, impacts have been minimized to the greatest extent practicable. There are no proposed wetland or stream impacts proposed for lot construction. Please note that the two "lots" that do not have building setbacks shown are actually open space, and not lots. Please reference the "Overall Site Plan" for the locations of these open space areas, as they are labeled on this sheet. Mitigation The proposed permanent stream impacts are less than 150 If, and therefore, the applicant is not proposing mitigation. Stormwater Management Plan The stormwater management plan consists of four wet detention ponds designed for 9o% TSS removal, with level spreaders providing diffuse flow. The stormwater management plan and diffuse flow requirements will be reviewed and approved by the Town of Cary.
