Relative to the site visit on July 7th, I assume that you will want to be onsite as early as
possible due to the afternoon temperatures most likely being very warm. I am an early riser
and I know that Charles would prefer earlier than later for a start time. I am available to
start anytime after 6:30. Just let us know what time works best for you.
Relative to where to meet, I suggest that we meet at the existing treatment plant site, which
is on County Home Road off Hwy 210. The treatment plant comprises the western terminus
of the project corridor.
Attached is a PDF of the delineation index map and associated delineation maps. I will
bring three hard copies of the attached delineation maps to the site visit.
Please let me know if you have any questions, would like to meet at a different location,
etc.

Attached are two versions of the checklist. The checklist from NMFS does not like to open
in some PDF viewer programs. Therefore, I printed it to a PDF and also attached the
printed version.
I will send the photos either later today or over the weekend. I have to run into Raleigh for
a meeting and will not be back at my desk for a large portion of the day. I have the photos,
but I have to find them. I did not save them in the project directory, which means they are
in my phone's picture download directory on an external hard drive.

Sorry for the delay. The engineer was on vacation last week and I was in the field
yesterday. Attached is the latest set of drawings for the project.
Please let me know if you have any questions or if the submittal to NMFS is not going to
occur in the near future such that I can let the project team know. I will keep you apprised
of the easement acquisition process for the last parcel within the project corridor.

I won't be able to visit the property, or claim jurisdiction over any areas on it, without
landowner authorization. However, I can put you on the schedule to look at the remainder of
the alignment and hopefully the negotiations will be complete by then.
NMFS hasn't yet been contacted. Apologies — the best I can figure I decided to hold for
your update on the easements. I'm working on that now. You offered to send a PDF of the
design plans — if you can share those it would be helpful in case anything has been changed.
My version is the latest you shared in early February (attached). Please reduce file size as
best you are able. My limit is around 20MB.

Attached is the NMFS Section 7 Checklist for the project. The mussel survey has been
contracted and will be performed by Three Oaks. Let me know if you need a PDF of the
design drawings for the project to send to NMFS.
Also attached is the SHPO response letter for the project file. Their conclusion was that
they have no comment on the project as proposed.
I will get with the engineer who is working on the easement acquisitions on Monday to get a
current list of easement segments that have been acquired. I will send you a map of the
obtained easement segments overlain on the jurisdictional waters map such that you decide
whether you can go ahead and schedule a site visit.
Please let me know if you have any questions or need additional information. I will be in
touch on Monday relative to the acquired easements.

Please complete the attached NMFS Section 7 Checklist and I'll use it to initiate
consultation. SHPO can be done by either of us. Although, if an issue is raised it may be in
your client's interest to know sooner than later. My contact with them would be closer to
issuing the permit.
I am having trouble matching the JD request up with impacts. Am I reading it incorrectly?
S3 and Neuse River are not included in the JD
2. The JD documents W2 is 0.43 ac, and W3 is 0.06 acre, but the impacts in the
PCN are .491 and .198 respectively.
3. The pond, Wetland W 1, Stream S 1, and Stream S2 are all exact amounts
within your corridor.
I located the stream crossing details — thank you for those. However, I'm unable to find a
detail showing the 0.1 acre of open water impact (i.e. — how will it be constructed in the dry
per the project description?).
I'd also like an opportunity to review the delineations and stream crossings. I located Mr.
Hester's agent authorization, but looking at the county's GIS and the two deeds I did read,
there was no mention of an easement. This isn't uncommon particularly for newer
easements. Can you get me a copy of the county's easement records so we can get a site
visit scheduled?

I will work with Three Oaks relative to getting a mussel survey performed. Also, do you
want me to contact SHPO or are you going to? Either way works for me.
Relative to NMFS, we have recently (within the last year or so) received concurrence from
NMFS for a project upstream of this project. The NMFS representative is adamant that he
will only coordinate with the USACE and not the consultant. Have you initiated contact
with NMFS? If so, have they provided the Section 7 Checklist for me to fill out?

I've reviewed the application provided and am sending this note to convey that I will not be
able to issue a determination on this project until the NMFS and USFWS reviews are
completed and concurrence/no objection letters received.
The PCN form submitted acknowledged that consultation with the NMFS needed to occur,
and the December 16, 2020 letter from the USFWS service included in your application
requested surveys be conducted. Please note that, given the length of this project and
proposed disturbance to the bank of the Neuse River, we also request the NC SHPO have an
opportunity to review and comment.
Please continue to keep this office copied on progress so we can be timely in our
responsiveness once you are ready to proceed with permitting.
