Staff reviof the plans and specifications has determined that the project, as proposed, will comply with' the Stormwater Regulations set forth in Title 15A NCAC 2H.1000. We are forwarding Permit. No. SW8 050516, dated June 2, 2005, which replaces Permit No. SW8 890308, for the construction of the subject project. This permit shall be effective from the date of issuance until rescinded and shall be subject tc the conditions and limitations as specified therein, and does not supercede any other agency permit that may be required. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request q;n adjudicatory hearing upon written request within thirty (30) days followlnq receipt of f is permit. North Development, Inc. Cannonsgate at Bogue Sound Carteret County FOR THE construction, operation and maintenance of a 25% low density subdivision with a curb outlet system in with the provisions of 15A NCAC 2H .1000 (hereafter referred to as the "stormwater rules' and the approved stormwater management plans and specifications, and other supporting data as attached and on file with and approved by the Division of Water Quality and considered a part of this permit. This Permit replaces Stormwater Permit No. SW8 890308 and shall be effective from the date of issuance until rescinded and shall be subject to the following specific conditions and limitations: I. DESIGN STANDARDS 1. The pro1'ect is permitted for 525 lots, each limited to a maximum built -upon area as listed in Attachment D, as defined by the stormwater rules, and as indicated in the approved plans. 2. The overall tract built -upon area percentage for the project must be maintained at 25%, per the requirements of Section .1005 of the stormwater rules. 3. This project proposes a curb outlet system. Each designated curb outlet swale or 1 00'vegetated area shown on the a proved plan must be maintained at a minimum ':of 100' long, maintain 5:1 H:V) side slopes or flatter, have a longitudinal slope no steeper than 5 /o, carry the flow from a 10 year storm in a non -erosive manner, maintain a dense vegetated cover, and be located in either a dedicated common area or a recorded drainage easement. 4. No piping shall be allowed except those minimum amounts necessary to direct runoff beneath an impervious surface such as a road or under driveways to provide access to lots. 5. Runoff conveyances other than the curb outlet system swales, such as perimeter ditches, must be vegetated with side slopes no steeper than 3:1 (H:V). 6. Approved plans and specifications for projects covered by this permit are incorporated by reference and are enforceable parts of the permit. SCHEDULE OF COMPLIANCE Curb outlet swales, vegetated areas and other vegetated conveyances shall be constructed in their entirety, vegetated, and be operational for their intended use prior to the construction of any built -upon surface, per the approved plans 2. During construction, erosion shall be kept to a minimum and any eroded areas of the swales or other vegetated conveyances will be repaired immediately. 3. The permittee shall at all times provide the operation and maintenance necessary to operate the permitted stormwater management systems at optimum efficiency to include: a. Inspections b. Sediment removal. C. Mowing, and revegetating of the side slopes. d. Immediate repair of eroded areas. e. Maintenance of side slopes in accordance with approved plans and specifications. f. Cleaning and repair of catch basin grates, flumes, piping, and the flow spreader mechanism. 4. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to the approved plans, regardless of size. b. Project name change. C. Transfer of ownership. d. Redesign or addition'to the approved amount of built -upon area or to the drainage area. e. Further subdivision, acquisition or sale of the project area. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval was sought. f. Filling in, piping, or altering any vegetative conveyance shown on the approved plan. 5. The Director may determine that other revisions to the project should require a modification to the permit. 6. The permittee is responsible for verifying that the proposed built -upon area does not exceed the allowable built -upon area. Once the lot transfer is complete, the built -upon area may not be revised without approval from the Division of Water Quality, and responsibility for meeting the built -upon area limit is transferred to the individual property owner. 7. The permittee must certify in writing that the project's stormwater controls, and impervious surfaces have been constructed within substantial intent of the approved plans and specifications. Any deviation from the approved plans must be noted on the Certification. The permittee shall submit the Certification to the Division Within 30 days of completion of the project. 8. The permittee shall submit all information requested by the Director or his representative within the time frame specified in the written information request. 9. Each lot in the subdivision covered by this permit will maintain a minimum 30 foot wide vegetative buffer between all impervious areas and surface waters. 10. Deed restrictions are incorporated into this permit by reference and must be recorded with the Office of the Register of Deeds prior to the sale of any lot. 11. All roof drains must terminate at least 30' from the Mean High Water mark. Page 3 of 5 State Stormwater Management Systems Permit No. SW8 050516 12. Recorded deed restrictions must include, at a minimum, the following statements related to stormwater management: a. The following covenants are intended to ensure ongoing compliance with State Stormwater Management Permit Number SW8 050516, as issued by the Division of !^later Quality under NCAC 2H.1000. b. The State of North Carolina is made a beneficiary, of these covenants to the extent necessary to maintain compliance with the Stormwater Management Permit. C. These covenants are to run with the land and be binding on all persons and parties claiming under them. d. The covenants pertaining to stormwater may not be altered or rescinded without the express written consent of the State of North Carolina, Division of Water Quality. e. Alteration of the drainage as shown on the approved plans may not take place without the concurrence of the Division of Water Quality. f. The maximum built -upon area per lot for 525 lots is as defined by Attachment D. This allotted amount includes any built -upon area constructed within the lot property boundaries, and that portion of the right -of -war between the front lot line and the edge of the pavement. Built upon area includes, but is not limited to, structures, aspphalt, concrete, gravel, brick, stone, slate, coquina. driveways. and parkina areas; hid does not include raised, open wood decking, or the water surface of swimming pools. g. Filling in, piping or altering any 3:1 vegetated conveyances (ditches, sw'ales, etc.) associated with the development except for average driveway crossings, is prohibited by any persons. h. Filling in, piping or altering any designated 5:1 curb outlet swale or vegetated area associated with the development is prohibited by any persons. i. A 30' vegetated buffer must be maintained between all built -upon area and the Mean High Water line of surface waters. j. All roof drains shall terminate at least 30' from the Mean High Water mark. I. Each designated curb outlet swale or 100' vegetated area shown on the approved plan must be maintained at a minimum of 100' long, maintain 5:1 (H:V) side slopes or flatter, have a longitudinal slope no steeper than 5%, carry the flow from a 10 year storm in a non -erosive manner, maintain a dense vegetated cover, and be located in either a dedicated common area or a recorded drainage easement. 13. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified: in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. 14. The permittee must submit a copy of the recorded deed restrictions within 30 days of the date of recording. Page 4 of 5 State Stormwater Management Systems Permit No. SW8 050516 15. Prior to transfer of ownership, the swales must be inspected and determined to be in compliance with the permit. Any deficiencies will be repaired or replaced prior to the transfer. 16. The final plats for the project will be recorded showing all required swale easements and common areas, in accordance with the approved plans. III. GENERAL CONDITIONS 1. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an enforcement action by the Division of Water Qualityy, in accordance with North Carolina General Statutes 143-215.6A to 143-215.6C. 2. The permit issued shall continue in force and effect until revoked or terminated. 3. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance, or termination does not stay any permit condition. 4. The issuafnce of this permit does not prohibit the Director from reopening and modifying the permit, revoking and reissuing the permit, or terminating the permit as allowed by the laws, rules, and regulations contained in Title 15A of the North Carolina Administrative Code, Subchapter 2H.1000; and North Carolina General Statute 143-215.1 et. al. i 5. The permit is not transferable to any person or entity except after notice to and approval by the Director. The Director may require modification or revocation and reissuance of the permit to change the name and incorporate such other requirements as may be necessary. A formal permit transfer request must be submitted to the Division of Water Quality accompanied by the appropriate fee, documentation from both parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits, and may or may not be approved. The permittee is responsible for compliance with all the terms and conditions of this permit until the Division approves the permit transfer. 6. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances imposed by other government agencies (local, state and federal) which have jurisdiction. If any of those permits or approvals result in revisions to the plans, a permit modification must be saubmitted. 7. The permittee grants permission to DENR Staff to enter the property during business,hours for the purposes of inspecting the stormwater control system and it's components. 8. The permittee shall notify the Division of Water Quality of any name, ownership or mailing address changes within 30 days. Permit issued this the 2nd day of June 2005. Built upon area includes, but is not limited to, structures, asphalt, concrete, gravel, brick, stone, slate, coquina, driveways, and parking areas, but does not include raised, open wood decking, or the water surface of swimming pools. g. Filling in, piping or altering any 3:1 vegetated conveyances (ditches, sw'ales, etc.) associated with the development except for average driveway crossings, is prohibited by any persons. h. Filling in, piping or altering any designated 5:1 curb outlet swale or vegetated area associated with the development is prohibited by any persons. i. A 30' vegetated buffer must be maintained between all built -upon area and the Mean High Water line of surface waters. j. All roof drains shall terminate at least 30' from the Mean High Water mark. Each designated curb outlet swale or 100' vegetated area shown on the approved plan must be maintained at a minimum of 100' long, maintain 5:1 (H:V) side slopes or flatter, have a longitudinal slope no steeper than 5%, carry the flow from a 10 year storm in a non -erosive manner, maintain a dense vegetated cover, and be located in either a dedicated common area or a recorded drainage easement. 13. The Director may notify the permittee when the permitted site does not meet one or more df the minimum requirements of the permit. Within the time frame specified .in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. 14. The permittee must submit a copy of the recorded deed restrictions within 30 days of the date of recording. Page 4 of 5 State Stormwater Management Systems Permit No. SW8 050516 15. Prior to transfer of ownership, the swales must be inspected and determined to be in compliance with the permit. Any deficiencies will be repaired or replaced prior to the transfer. 16. The final plats for the project will be recorded showing all required swale easements and common areas, in accordance with the approved plans. III. GENERAL CONDITIONS 1. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an enforcement action by the Division of Water Qualityy, in accordance with North Carolina General Statutes 143-215.6A to 143-215.6C. 2. The permit issued shall continue in force and effect until revoked or terminated. 3. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance, or termination does not stay any permit condition. 4. The issuance of this permit does not prohibit the Director from reopening and modifying, the permit, revoking and reissuing the permit, or terminating the permit as allowed by the laws, rules, and regulations contained in Title 15A of the North Carolina Administrative Code, Subchapter 2H.1000; and North Carolina General Statute 143-215.1 et. al. 5. The permit is not transferable to any person or entity except after notice to and approval by the Director. The Director may require modification or revocation and reissuance of the permit to change the name and incorporate such other requirements as may be necessary. A formal permit transfer request must be submitted to the Division of Water Quality accompanied by the appropriate fee, documentation from both parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits, and may or may not be approved. The permittee is responsible for compliance with all the terms and conditions of this permit until the Division approves the permit transfer. 6. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances imposed by other governmdnt agencies (local, state and federal) which have jurisdiction. If any of those permits or approvals result in revisions to the plans, a permit modification must be submitted. 4 7. The permittee grants permission to DENR Staff to enter the property during business hours for the purposes of inspecting the stormwater control system and it's components. 8. PROJECT DESCRIPTION: CAMA Major Permit No. 120-88 was issued to Broad Reach Investments, Inc. on 6/29/88, and subsequently modified for development of an upland marina basin, entrance channel and access canal and construction of a subdivision. The permit has also been renewed several times, most recently renewed on 12/20/04. The permit is scheduled to expire on 12/31/06. The applicant, Randy Allen c/o R.A. North Development, Inc., has provided a copy of the contract to purchase agreement and has also requested a permit transfer from Broad Reach Investments, Inc. to Randy Allen c/o R.A. North Development, Inc. The property is comprised of approximately 287 acres ofhigh ground and lies adjacent to Sikes Creek, Sanders Bay and Bogue Sound, off of NC Hwy 24, near Ocean, in Carteret County. The majority of the property consists of high ground, however, there are a few small pockets of "404" type wetlands. Elevation at the site ranges from 5' to 7' above Mean High Water (MHW). The project site is bordered, along Sikes Creek and Bogue Sound, by a continuous strip of "404" type and coastal wetlands (sections vary from 30'-100' in width). High ground vegetation consists primarily of Long Leaf Pines, Live Oaks, Sweet Gums, Cedars, Magnolias, Dogwoods and Red Maples. Understory vegetation includes Wax Myrtles, Yaupons, and Red Bays. Transitional species, including: Sea Oxeye (Borrichia frutescens), Common Reed (Fragmites australis) and Grounsel-bush (Baccharus halimifolia) are located along the upper edge of the coastal wetlands. High coastal marsh vegetation, including, Black Needle Rush (Juncus roemarianus), Spike Grass (Distichlis spicata), and Salt Meadow Grass (SDarting patens ) complete the transition to the waters edge where Smooth Cordgrass Marsh (Spartina alterniflora) is the predominant species. No Submerged Aquatic Vegetation (SAV) was noted during the on -site visits. The waters of the Bogue Sound, located adjacent to the proposed project area, are classified "SA-ORW" by the Division of Water Quality, and the waters of Sanders/Sikes Creek are classified as "SA". This section of Sanders/Sikes Creek, adjacent to the project site, is designated as a Primary Nursery Area by the Division of Marine Fisheries. According to maps provided by Shellfish Sanitation, the area adjacent to the project site is CLOSED to the harvesting of shellfish. PROPOSED PROJECT: The applicant is proposing to modify the existing permit by reconfiguring the existing 75-slip marina, redesigning a 500+/--lot subdivision with amenities and utilities, installing three (3) observation piers and a boat ramp. Additionally, the applicant is proposing to perform maintenance dredging within the existing boat basin, access canal and entrance channel. The applicant proposes to develop 525 lots for single-family dwellings, giving a density of 1.83 units per acre. No individual units are proposed as part of the application package. As such, each individual property owner proposing to develop within any AEC would be required to obtain their his/her own individual CAMA permit. Beginning along the northern portion of the property (adjacent to NC Hwy 24) and working south towards Bogue Sound, the applicant proposes the following development: Construction of an entrance drive (Cannonsgate Drive), located in the north central section of the property, a wastewater treatment facility and a boat storage area (both located in the northeast corner of the property). Four wastewater collection ponds and two created nature ponds would also be located along the northern portion of the property. Please note that Cannonsgate Drive would provide access to numerous side streets within the subdivision, however not all of the side streets, drives and/or courts will be discussed in the field investigation report. Please refer to the workplat drawicigs (sheets CP-3 and CP-7) for a detailed description of the road infrastructure. Mr. Randy Allen Page Three Continuing south, approximately 1,900' from the intersection of NC Hwy 24 and Cannonsgate Drive, and located outside of the 575' Coastal Shoreline Area of Environmental Concern (AEC), the applicant proposes to remove two sections of the existing bulkhead that is located at the "404" type wetlands road crossing (what is now a dirt road, or what would be developed as Cannonsgate Drive). The applicant proposes to reconstruct the crossing using vinyl sheets capped with 2' x 2' concrete caps. The caps would support two guardrails (located on each side of the Cannonsgate Drive) that would span the entire section of the crossing. As proposed, the existing culvert located beneath the bulkhead section would not be replaced. Heading further south along Cannonsgate Drive, near the center of the property, and located outside -of the 575' Coastal Shoreline Area of Environmental Concern (AEC) , the applicant proposes to construct a community center, or common area. Development activities within this section include: the construction of a clubhouse, parking area, mailroom, tennis court, swimming pool, putting green, croquet lawn, formal garden, function lawn, rose garden, carriage drive and drop-off cul-de-sac. Please refer to the workplat drawings (sheets CP-3 and CP-5) for a detailed description of the community center. Just south and east of the community center, the applicant proposes to excavate an area of high ground for the disposal of spoil material excavated from the marina basin, access canal and entrance channel. According to the application, the spoil basin (150' x 280' x 9') would temporarily be used for spoil deposition and would not be available for future dredging events. In addition to the high ground spoil basin, the applicant proposes to excavate two additional nature ponds (one to the east of the spoil basin and one to the west adjacent to the western property line). As proposed, the two ponds would be used for recreation purposes only. The applicant indicates that materials excavated from the proposed wastewater collection ponds, nature ponds and spoil disposal pond would be used for road construction and preparation of the community center. The applicant proposes to construct three (3) community observation piers throughout the property. As indicated in the application package, Pier #1 (6' x 545') would begin from a common area located between Lots 475 and 476. Pier # 1 would extend in a southeasterly direction towards Bogue Sound and would terminate into a 15' x 15' "T-head" platform. Pier #2 (6' x 85') would be located along the northeastern property line, between Lots 422 and 423, and would extend into Sikes Creek from a designated common area Pier #2 would terminate into a 15' x 15' "T-head" platform over the open waters of Sikes Creek. Lastly, Pier #3 (6' x 210') would also be located along the northern property line adjacent to Sikes Creek. Pier #3 would originate from a designated common area, between Lots 403 and 404 and would span in a northerly direction towards the main run of Sikes Creek. Pier #3 would be located entirely over both "404" type and coastal wetlands and would terminate into a 6' x 6' platform. The modification request also includes reconfiguration of the marina basin. Beginning along the northern shoreline, adjacent to the marina basin, the applicant proposes to construct an 8' x 570' concrete sidewalk leading down to another 8' wide walkway (via three separate flights of concrete stairs) that encompasses the entire basin. The two walkways would be separated by the construction of a proposed retaining wall that would also encompass the entire basin. As proposed, both concrete walkways would be located outside of the 30' coastal shoreline buffer. However, the applicant has proposed the construction of two concrete overlooks/plazas within the 30' coastal shoreline buffer (one located on the northern side ofthe basin and one on the western side). The proposed concrete plaza would give way to the floating docks located within the basin however the proposed concrete overlook would not. Mr: Randy Allen Page Four Other development proposed within the existing basin includes the construction of a concrete boat ramp. The boat ramp (20' x 124') would be located in the southwest corner of the boat basin adjacent to the existing concrete bulkhead. A 20' x 37' concrete pad, bordered by two blocked wing walls, would give way to the ramp. The ramp would measure approximately 87' in length from the edge of the existing bulkhead/Normal High Water (NHW), to the terminal end. The applicant has indicated that fill material (rip -rap and railroad ballast) would need to be placed beneath the proposed ramp to obtain the appropriate slope of 12%. According to the site drawings, the terminal end of the boat ramp would be located approximately —7.0' below Normal Low Water (NLW). As part of this permit modification, the applicant has proposed the reconfiguration of the previously permitted floating dock system within the marina basin. As proposed, the total number of slips located within the marina basin would remain the same as what was originally permitted (75 slips). The floating dock configuration is as follows: Beginning just north of the proposed boat ramp and extending around the entire basin, the applicant proposes to construct a 10' x 1,480' section of floating dock (main dock) that would give access to the finger piers and dock spines within the basin. One, 8' x 105' finger pier would be located be located along the western wall, adjacent to the boat ramp, for boat launching. Five, 4' x 40' finger piers would also be attached to the main dock, adjacent to the western wall. Two, 10' x 225' dock spines would extend south from the northern wall towards the center of the basin. Ten finger piers (4-5' x 40', 54' x 50', 1-10' x 40' and 1-10' x 50') would attach to each of the spines. Seven finger piers (4' x 35') and one — 6' x 60' would be constructed to the main dock, adjacent to the eastern wall. Please refer to sheet CP-14 for a detailed description of the proposed dock dimensions and configuration. Lastly, the applicant is proposing to perform maintenance dredging within the existing marina basin, access canal and entrance channel to a depth greater that originally permitted. According to the application and site drawings, approximately 13,500 cu. yds. of material would be excavated using a hydraulic dredge. The boat basin (650' x 500') would be dredged from —6.0' to —7.5' Mean Low Water (MLW). The dredged footprint of the access canal would include a 40' (bottom cut) x 600' area, and final dredged contours would average —9.0' MLW. The entrance channel (40' bottom cut x 500') would be dredged to a depth of-10.5' MLW, or to the depth of the adjoining federally maintained channel. The top cut of the proposed dredging activities within the canal and entrance channel would be cut/tapered at a 4:1 side slope from the edge of the bottom cut. The proposed dredging activities would remain within the same footprint as originally permitted. Spoil material generated from the dredging activities would be pumped to the proposed spoil disposal site previously discussed. ANTICIPATED IMPACTS: Since this proposal is a modification of a previously permitted and partially constructed project, most of the types of impacts that will be referred to herein have been previously authorized. However, the redesigned subdivision and proposed retaining wall construction would disturb approximately 1,089,000 sq. A. of high ground. As proposed, total impervious coverage calculations for development within the 575' coastal shoreline AEC would be 24.80%, and total impervious coverage calculations for development within the 75' coastal shoreline AEC would be 30.56%. As proposed, no "404" type or coastal wetlands would be filled as part ofthe project. The proposed pier and platforms would provide access to the marsh and open water and shade approximately 930 sq. ft. of "404" type and coastal wetlands. The proposed piers/platforms and floating docks would incorporate approximately 32,156 sq. ft. of estuarine and public trust waters with 27,506 sq. ft. of the total area located within the man-made basin. I am forwarding copies of the bathometric survey that we recently performed to assist RA Management with their due -diligence. The work product is a GPS correlated, computerized analysis of the basin and approach corridor. In the past, we have found this process to be extremely reliable. We are led to believe that the original permit depth was to be minus six (-6.0) MLW min, according to the detail on Sheet 8 of 8, dated August 17, 1989, attached. Except for this drawing, I can find no language in my copy of the permit that sets a controlling depth for this dredging event. The permit does specify a 28% grade to be dredged between the marina basin and the ICW, with a minus ten (-10) ft depth at or near the mouth of the channel. I am not certain how this dredging was originally performed. The permit seems to imply that hydraulic dredging would be the preferred methodology, however I am led to believe that either a dragline or excavator actually dug this basin, using the earthen plug as a coffer dam. If this be the case, it is normal to assume that a certain amount of overcut would be allowable, and in fact, would be expected. It is normally accepted practice that in order to guarantee a specific controlling depth a contractor would need to overcut at least a foot in order to guarantee the proper marina elevation. This is especially true if a dragline were used. Whether or not the overcut was allowable under the permit is another question entirely. Clearly your call. My view is purely from an operational standpoint where BUT is normally applied. Where from here? I have taken some liberty in suggesting possible solutions, if it is determined by DCM or CAMA that corrective measures are necessary. As I see it there are at least three possible solutions. First, accept the project as it is. This would leave the marina basin deeper than the adjoining entrance channel. I would have a problem with this, in that the flushing of the basin would be compromised. Such a solution would violate the original intent and spirit of the order. Another scenario might be to fill in the basin with sand or shell. If this were done it would very expensive and extremely difcult to insure a relatively even bottom, free of humps and bumps. Fact is, Mother Nature will fill this area in time, anyway. I don't think my second suggestion is very sw000ft either! Assuming that the basin were determined to be at a maximum depth of minus eight (-8) rather than minus six (-6), then a 28% grade would put the entrance of the connecting channel at an elevation of minus twelve (-12), rather than the minus ten (-10). If this were done, then the spirit and original intent of the permit would be maintained. There may be environmental or "other" concerns surrounding the original issuance of the permit that might preclude dredging to this depth. Henry Wicker with the USACE might be helpful in researching this. The permit information that I have indicates that the ICW has a working depth of minus fourteen 04) at the entrance to the channel.
