Per the requirements of the stormwater rules, NCAC 02H.1000, any project that is required to submit a CAMA Major Permit application or which disturbs >1 acre and must receive Erosion and Sedimentation Control Plan approval, must be reviewed for the applicability of the stormwater management rules. Lot number 437 located at 131 Greenhill Pace, Newport, is currently included as part of the development permitted under State Stormwater Management Permit number SW8 050516, which was issued to R. A. North Development, Inc. on June 2, 2005 and revised on September 22, 2011. A previous site plan for this lot was approved on July 16, 2012 and is now being modified to reflect additional BUA. The required deed restrictions were recorded on October 10, 2011 in Deed Book 1388 at Page 53 of the Carteret County Register of Deeds. The lot plans and documentation provided with the CAMA Major Permit application indicate a proposed built -upon area of 6,665 square feet, which is less than or equal to the permitted maximum allowable built -upon area of 6,665 square feet. This amount includes 882 square feet of "reserved" BUA. Staff review of the plans and specifications has determined that the development activities proposed on this lot at this time will not require a separate stormwater management permit because it is already subject to the terms and conditions of permit No. SW8 050516. Please note that it is the lot owner's responsibility to maintain compliance with the maximum built -upon area limit for the lot as per the permit and the recorded deed restrictions. To ensure compliance with the permit conditions, R.A. North Development, Inc. is required to review all proposed lot plans and monitor the project on a routine basis. R.A. Per the applicant, a final house design has been completed that was not prepared during the original permit application. The current proposal is for a realignment of the previously permitted retaining wall, the addition of a 138 square foot sidewalk, pool with apron as well as the filling of an additional 103 square feet for a total of 659.5 square feet of jurisdictional 404 wetlands. In order to meet the Cannonsgate ARC requirements, this additional wetland fill and retaining wall realignment is necessary to maintain the house integrity and avoid conflicts with the house support pilings and the retaining wall tie backs. This house design incorporates less BUA than was previously permitted and reduces the retaining wall length from 260' to 256'. The current proposal will calculate the BUA as follows; the house with roof overhangs and covered porches at 3,070 sf, the driveway and turnaround at 2,116sf, the sidewalk at 138sf and the swimming pool apron and patio at 519sf for a total of 5,843sf of BUA or 18.7% of the lot area which is an ORW AEC. The Keesee lot has been allocated a total of 6,665sf of BUA previously through a modified stormwater permit. The proposal is consistent with the general and specific guidelines found in 15A NCAC 07H.0209. A check in the amount of $100.00 is included with the request. Major CAMA permit 102-12 was issued to Mr. and Mrs. Keesee on September 5, 2012 to fill and grade the lot, install a retaining wall, and construct a single-family residence with driveway and turn -around area. The permit authorized placement of fill in two areas of non -coastal wetlands totaling 556.5 square feet. The owners took several steps to avoid and minimize impacts to wetlands during the planning stages for this project. During a May 2010 meeting to review project plans, staff of the NC Division of Water Quality (DWQ) and US Army Corps of Engineers directed the owners to 1) pursue a variance from the Cannonsgate Architectural Review Committee (ARC) from the front build -to line requirements contained in the subdivision architectural standards and 2) request the developer to allocate additional BUA to this lot. Architectural standards for the subdivision require the front of the house to meet the "build -to" line, located 20' from the front line of the lot. The owners requested and received a variance from the ARC to place the house 50' from the front line of the lot, thus moving the house out of the wetlands and minimizing wetland fill. However, as a result of moving the house, the driveway length and associated built -upon area (BUA) increased. The Keesees then approached the developer of the subdivision and were successful in persuading him to modify the existing stormwater permit to allocate additional BUA to the lot, as described below. State stormwater permit SW8 050516 was issued to R.A. North Development, Inc. in June 2005 for development of the Cannonsgate subdivision. The permit originally limited impervious surfaces on the. Keesee lot (#437) to no more than 3,080 square feet. At the request of the permit owner, R.A. North Development, Inc., the stormwater permit was modified by DWQ on September 22, 2011 to provide for reallocation of a portion of the BUA set aside for future development to Lot #437. As a result, the permitted BUA allocated to Lot #437 is now 6,665 square feet. Documentation of the increased BUA allocation for the lot was recorded with the Carteret County Register of Deeds on October 10, 2011. Kenneth'and Gloria Keesee CAMA Permit 102-12 Modification Request June 5, 2013 Page 1 This submittal requests approval of revisions to the permitted project plans approved by major permit 102-12. The changes involve reconfiguration and reduction of the house footprint and driveway, and addition of a swimming pool, patio, sidewalk, and fence. Changes to the retaining wall alignment affecting 103 square feet of additional non -coastal wetlands are also requested. -The attached revised site plan dated May 24, 2013 was prepared by Craven Gardner Designs and is the basis for this submission. Site Description - — - - The Cannonsgate Cannonsgate subdivision is located along Highway 24 in Carteret County near the community of Ocean. The Keesee lot (#437) borders Sanders Bay, connecting to Bogue Sound, which is classified as Outstanding Resource Waters (ORW). The pie -shaped lot contains extensive coastal and non -coastal wetlands, which predominate on two sides of the property. The lot measures 31,328 square feet inclusive of wetland areas. There are no structures on the site. The property is located entirely within the 575' CAMA Coastal Shoreline Area of Environmental Concern (AEC). The US Army Corps of Engineers provided a Notification of Jurisdictional Determination to the property owners on August 12, 2010. Staff of the NC Division of Coastal Management provided assistance with the delineation of coastal wetlands and the locations of Normal High Water as shown on project plans. Project Changes The Keesees are requesting changes to the retaining wall alignment authorized by major permit 102-12. Realignment of the wall, as shown on the enclosed plans, will require fill in 103 square feet of additional non -coastal wetlands beyond what is currently authorized by the'CAMA permit. A realignment of the retaining wall is needed based on the final house design and change in materials allowed to be used for construction of the wall, as permitted by the Cannonsgate ARC. A final house design has now been completed. The final plan had not been prepared at the time of permit application as it was dependent upon permit requirements. Based on the plan that has now been developed, a modified retaining wall alignment is needed to maintain the integrity of the house foundation and avoid conflicts with the retaining wall tie -backs and house support pilings. The final house design incorporates less impervious surfaces than the permitted plan. It relocates the main entrance, requiring the addition of a sidewalk measuring 138 square feet.. The owners are requesting authorization to fill a small area of non -coastal wetlands adjacent the sidewalk in order to surround the house with a level grade, allow for safe access to the house and provide for drainage away from the foundation. The fill will also provide a stable yard for access for maintenance and repairs to the home. Kenneth and Gloria Keesee CAMA Permit 102-12 Modification Request' June 5, 2013 Page 2 The Keesees originally intended to use keystone or a similar material to construct the wall, thus facilitating incorporation of curved sections of the retaining wall. Since issuance of the permit in 2012, the Cannonsgate ARC has changed its rules and will not allow keystone to be used for retaining walls. The ARC now requires sheet pile material to be used for retaining walls, thus necessitating a modified alignment, with an associated small amount of additional wetland fill. Project plans dated June 7, 2012 and approved by the major permit identify the wetland areas to be__ _ _ filled as wetland impact area 1 (15.5 square feet) and impact area 2 (541 square feet). The wall The revised (enclosed) plan portrays the approved wetland fill areas and the additional proposed area measuring 103 square feet. With the additional area, a total of 659.5 square feet of non -coastal wetlands will be impacted by the project. The modified retaining wall measures 25.6 linear feet. The new alignment squares "rounded" corners and replaces one corner with a straight Fine. The permit currently authorizes 473 cubic yards of fill for highground and approved non -coastal wetland areas. The changes in the wall alignment will require an additional 15.5 cubic yards of fill material, for a total of 488.5 cubic yards. All fill material will be clean and free of debris. The retaining wall will serve to contain the lot fill and to prevent its movement into adjacent wetland area. No fill will be placed in coastal wetlands. The additional wetlands to be filled are the minimum needed to allow construction of the proposed (smaller) house and safe use of the sidewalk leading to the front entrance of the home, while stabilizing the lot and avoiding structural conflicts between the house and retaining wall. As currently authorized by permit 102-12, the house will utilize 3,354 square feet of built -upon area (BUA). The approved driveway and turn -around will utilize 2,379 square feet of BUA, for total BUA of 5,733 square feet. Included in the BUA calculation are 1.5' roof overhangs; however, the top of the retaining wall will be no wider than 12" and was not included, per guidance provided by Division of Water Quality staff. Built -upon areas currently authorized by the permit constitute 18.3% of the lot, within the percentage allowed by CAMA regulations for coastal shorelines adjacent ORW-classified waters and by the existing stormwater permit for the subdivision. The proposed changes to the house footprint (including roof overhangs and covered porches) will use 3,070 square feet of BUA, with the proposed driveway and turn -around utilizing 2,116 square feet. The proposed sidewalk will utilize 138 square feet of BUA, with the swimming pool apron and patio utilizing 519 square feet. Total BUA utilized by the modified plan is 5,843 square feet or 18.7% of the lot. Care will be taken during construction to avoid unnecessary impacts to wetlands. Silt fencing will be employed to avoid discharge of fill into unauthorized areas. No wetlands will be crossed in transporting equipment to the project site.
