This Office believes that the wetland impacts can be moved or reconfigured to minimize the impacts. Please revise the plans to avoid the impacts or provide a detailed explanation of why this plan for the activity cannot be practically accomplished, reduced, or reconfigured to avoid impacts to these impacts. • Please describe in detail why the gravel yard footprint needs to encroach 0.294 acres into wetland A and why the adjacent vacant parcels owned by Wake Stone cannot be utilized for gravel storage to avoid impacts to the wetland feature. Hi Rick, The PCN attachments packet in Laserfiche for the Goldrock Asphalt Plant is in black & white, most likely due to a LF upload error. Can you please provide a full color copy (via email or LF Forms if large file)? It is difficult to differentiate some of the features on the maps/aerials and pictures. Good morning, North Carolina Division of Water Resources (NCDWR): After review of the submitted NWP-39 PCN for the subject project dated April 14, 2023, and the enclosed Nationwide Permit 39 Water Quality General Certification (GC) 4246, dated December 18, 2020, it appears that an individual 401 water quality certification (WQC) is required from the NCDWR for the proposed activities. The ePCN received by our office on April 14, 2023, provided the 9 required elements for an individual WQC. This permit application/ePCN, dated April 14, 2023 constitutes the Corps initial receipt of the 401 WQC application. Unless NCDWR is granted a time review extension, a waiver will be deemed to occur if the NCDWR fails to act on this request for certification within 120 days from the date of the complete 401 request. The reasonable period of time (RPOT) for you to act on this WQC request is 120 calendar days. The date upon which the waiver will occur if you fail or refuse to act on the certification is August 14, 2023. If our assumption is incorrect and this proposed activity does not require an Individual WQC, please respond to this notification as soon as possible in order for our office to meet the Corps' Nationwide Permit review requirement. Applicant/Consultant: Please note, should we finalize our review prior to receiving the 401 WQC, you will receive a provisional general permit verification from the Corps. Once a 401 WQC is issued or waived by the DWR, the Corps will provide you with a final general permit verification.
