Hey Sue —
I apologize for the delay in getting back to you. This project has been challenging for several reasons.
It is my understanding the USACE and DWR have timelines you are required to meet by regulation.
We have failed to address a RAI dated 12.22.2022. Therefore, we would like to withdraw our application at this time.
I will keep everyone posted if the client decides to pick this back up and we have all the items identified in the letter.
I appreciate everyone's time and attention regarding this project.

Nick,
DWR has not received a response to a request for additional information that was sent out December 22, 2022. If you
are unable to provide a complete response within another week we will be required to deny the application as
incomplete due to timelines which we are required to meet by regulation. This would not prevent your applicant from
reapplying once they have all the items identified in the letter.

This is up to you and your client to make the call, if it was a Nation Wide Permit I would have already withdrawn it
(because of the tight 45 day clock),
But since this is an IP, that makes it different, but USACE HQ is on us to get the IP's out in 360 days, if not then we have
to justify to them why they are taking so long.
For this one we still need:
-RCW Survey
-NLEB night acoustics study (or whatever USFWS requires), might as well plan on doing this for the Tri-colored bat also
(it will go n the Endangered list this fall)
-NC SHPO Archaeology study (hot spot areas, or whatever they require)
I've already talked to Mickey about the possibility that this might be withdrawn.
Just let me and Holly know what you guys decide.

Nick,
If this project will not move forward in a timely manner then the Corps will have to withdraw it.
There seems to be several issues that are keeping this project from moving forward:
-NLEB survey (NCSHPO Consultation)
-RCW survey (USFWS Consultation)
-NCSHPO survey (USFWS Consultation)
-No Partner Buyer
These are all issues that will take some time to sort out (especially the NCSHPO, NLEB & RCW surveys and consultation)
Once new/requested information is submitted the project can be re -started again. (for Corps permit)
Please let me know what your client would like to do.

Thanks for following up. This project was put on hold in mid -May by the client. They can't move forward until they have
a partner buyer.
I've warned the client of the possibility of our permit being denied if we cannot respond in an adequate manner.

Hey Gary and Mickey —
I'm sending this email to request an extension for DWRs review period of 120 days.
It is my understanding this date starts from the issuance of the USACE public notice (November 18, 2022) which would
come out to March 18, 2023.
DWR had requested additional information on December 22, 2022, regarding this project. We are still working through
some of these challenges.
A FOIA request was submitted this week (March 1, 2023) to obtain information on the conservation easement.
Finalizing plans are contingent on the information we obtain from this request. Additionally, we are still looking at
potential temporary impacts associated with utilities.
Please let me know if have any questions or concerns.
