Proposed CAM Rd for Wolfspeed Siler City Facility Access — HE-0011
Dear Mr. King:
On June 30, 2023, the Division of Water Resources (Division) received your application requesting a 401
Individual Water Quality Certification from the Division for the subject project. Please note that this
application is being reviewed in conjunction with DWR Project #20230949 for the Wolfspeed Siler City
Facility Site. The Division has determined that your application is incomplete and cannot be processed.
The application is on -hold until all of the following information is received:
1. Please provide a copy of the final map of jurisdictional features as referenced in the USACE
delineation concurrence email provided with the application.
2. The Jurisdictional limits of all stream features in the project vicinity (including features
adjacent to the project boundaries) should be depicted on the plans, specifically along
Graham Moore Road.
3. It appears that the proposed culvert length/stream impact length has been designed to
provide for the future four -lane road, although the application states that the NCDOT will be
constructing an intermediate two-lane road at this time. In order for the Division to
document that adequate avoidance and minimization has been provided please provide
additional information regarding justification for the proposed stream impact/culvert length,
including designed traffic analyses and justification for a 23-foot raised median.
4. The application notes that the roadway will currently be two 12-foot lanes and an 8-foot
shoulder on either side of the raised median, however the profile provided appears to show
that the road and shoulder would be over 40 feet wide on either side of the raised median.

5. It appears that the proposed side slopes for the roadway are 2:1 slopes. In order to
document maximum avoidance and minimization has been completed, please provide
detailed justification of why 3:1 slopes are not proposed for this access road.
6. In the PCN Impact Table, dewatering is listed at Site S2, but is not depicted on the plan sheet.
Please resolve this discrepancy and provide updated documents accordingly.
Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested
information for the proper consideration of the application. Please respond in writing within 30
calendar days of receipt of this letter by sending one (1) copy of all of the above requested information
to the 401 & Buffer Permitting Branch, 1617 Mail Service Center, Raleigh, NC 27699-1617 OR by
submitting all of the above requested information through this
link: https://edocs.deg.nc.gov/Forms/Supplemental-Information-Form (note the DWR# requested on
the link is referenced above).
If all of the requested information is not received within 30 calendar days of receipt of this letter, the
Division will be unable to approve the application and it will be denied as incomplete. The denial of this
project will necessitate reapplication to the Division for approval, including a complete application
package and the appropriate fee.
Please be aware that you have no authorization under the Section 401 of the Clean Water Act for this
activity and any work done within waters of the state may be a violation of North Carolina General
Statutes and Administrative Code.
