The Division has determined that your application is incomplete and cannot be processed. The application is on -hold until all of the following information is received: The application states that Impact S4 is for the installation of a culvert. It appears that this culvert is for the purpose of supporting fill slope. Please also provide justification as to why this stream impact cannot be avoided by steeper fill slopes and/or the use of a retaining wall within the area. 2. The application states that Impact S5 is for the installation of a culvert. It is unclear of the purpose of this impact as it appears that a retaining wall is proposed adjacent to the stream. Please clarify the need for this impact. Please provide a detailed engineering plan, profile view, and cross-section of all proposed culverts. These drawings must include details regarding stream alignment in relation to pipe alignment, pipe slope, pipe burial, and dissipater pad (riprap) if required for velocity control. If riprap is required, please enumerate and clearly label the temporary and permanent impacts on the site plan and submit a channel restoration detail. Riprap must be located below the stream bed elevation. Please note that all work must be done "in the dry". Therefore, dewatering methods will be necessary to temporarily dewater the stream channel during pipe installation. Please provide a construction sequence that details the method of dewatering to be utilized at the site and the sequence of construction events to be followed to ensure compliance with this condition. In addition, please ensure that the location of the temporary impacts are shown on the construction drawings and clearly indicated in the revised impact table. The impacts of wetland impact W1 appear to be beyond the limits of a proposed retaining wall. Please clarify why permanent impacts are proposed beyond the retaining wall. 6. Pursuant to 15A NCAC 02H.0506(b) "a 401 Water Quality Certification may only be issued upon determining that the proposed activity will comply with state water quality standards which includes designated uses, numeric criteria, narrative criteria and the state's antidegradation policy, as defined in rules of 15A NCAC 02B .0200... In assessing whether the proposed activity will comply with water quality standards, the Division shall evaluate if the proposed activity: (2) would cause or contribute to a violation of water quality standards; (3) would result in secondary or cumulative impacts that cause or contribute to, or will cause or contribute to, a violation of water quality standards;" In order to evaluate secondary or indirect impacts from the proposed High Density development, please provide either: A Complete Stormwater Management Plan which includes all appropriate supplemental forms, O&M agreements, calculations, drawings, etc., that complies with the requirements of the State Stormwater Program. The Stormwater Design Manual and applicable forms may be found on the DEMLR's website at https://deg.nc.gov/about/divisions/energy-mineral- land-resources/energy-mineral-land-permit-guidance/stormwater-bmp-manual. Please also submit the application form SWU-101; however, the application fee and last two signature pages of this form are not required and may be omitted. OR b. The following items to document that the project will not cause degradation of downstream surface waters: A discussion on how the project will not cause degradation of downstream surface waters when considering both the water quality and the volume/velocity of the increased flows to the current size/condition of the receiving stream. Delineation of each drainage area and accompanying calculations to show that flows from every discharge point will be non -erosive to both the land surface and the receiving surface water during the peak flow from the 10-year storm event. You may refer to the guidelines from DEMLR - Sedimentation and Erosion Control to determine an appropriate non -erosive velocity. The permissible velocities for erosion protection are under Appendix 8.05 (i.e. Chapter 8). iii. Calculations to demonstrate that for any discharge points proposed to increase flow rate and volume, the structural stability and the water quality of the receiving surface water will not be compromised. iv. Designed drawings (both aerial and profile views showing the actual designed dimensions) and calculations of any proposed diffuse flow or detention systems and any vegetated conveyances (if provided). If all of the requested information is not received within 30 calendar days of receipt of this letter, the Division will be unable to approve the application and it will be denied as incomplete. The denial of this project will necessitate reapplication to the Division for approval, including a complete application package and the appropriate fee. Please be aware that you have no authorization under the Section 401 of the Clean Water Act for this activity and any work done within waters of the state may be a violation of North Carolina General Statutes and Administrative Code.
