PROJECT DESCRIPTION The proposed project is located on the north end of Dare Street at 49 Dare Street in Ocean Isle Beach, Brunswick County. General Permit #49150 was issued on 10/1 1/07 to install a 6' x 10' access pier and a 6' x 3 V floating dock on the north side of the property, adjacent to Feeder Canal # 19 (Slip 2, See Sheet 2 of 3). General Permit #69053 was issued on 4/4/17 to install a 4' x10' access pier and an 8' x 20' floating dock on the west side of the property, adjacent to Finger Canal #7 (Slip 1, See Sheet 2 of 3). The project site is approximately .19 acres and is vegetated primarily with domestic grasses and ornamental landscaping. The high ground portion is elevated approximately 4' above the normal high water (NHW) level, and the shoreline (+/- 205 linear feet) is stabilized by a concrete bulkhead. There are no indications of any Coastal Wetlands on -site. The applicant's property sits at the end of a man-made canal system between Finger Canal 47 to the west and Feeder Canal #19 to the north. Dare Street and residential properties border the project site to the east and south, respectively. According to the application, Feeder Canal # 19 measures approximately 112' wide from NHW at the bulkhead in the vicinity of the proposed project site. The waters of the canal system are classified SA by the Division of Water Quality and ARE NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. They are CLOSED to the harvest of shellfish. Based on visual observations made by DCM staff during the July 2023 site visit, there appears to be NO Submerged Aquatic Vegetation (SAV) in the surrounding waters. Water depths in the vicinity of the proposed boatlift range from -2.0' to -3.0', relative to NLW. PROPOSED PROJECT The applicant proposes to expand the existing docking facility for a total of three formalized slips within the Ocean Isle Beach canal system. As proposed, a 3' x 12' access pier would originate from the concrete bulkhead east of existing Slip 92 and extend north into Feeder Canal 419. The proposed access pier would terminate with a 2' x 13' T-head and provide access to a 14' x 14' open boatlift (Slip 3, See Sheet 2 of 3), oriented parallel with the concrete bulkhead. The boatlift would extend approximately 24' waterward of NHW, to align with the waterward edge of the adjacent floating dock (Slip 2). The proposed boatlift would remain landward of the '/4 width of the waterbody and outside of the eastern riparian setback. The applicant did not receive any adjacent setback waivers. 10. ANTICIPATED IMPACTS The proposed docking facility expansion would result in the incorporation of an additional 258 square feet of Estuarine Waters and Public Trust Area. As proposed, the boatlift would align with the waterward edge of the existing 6' x 30' floating dock and would not exceed the'/4 width of the waterbody. The proposed development would be located outside of both 15' riparian corridor setbacks. Water depths in the vicinity of the proposed boatlift range from -2.0' to -3.0', relative to NLW. Minor increases in turbidity should be expected during piling installation. The square footage of the proposed docking facility is calculated as follows: Shoreline length = 205 ft. x 8 sq. ft. = 1,640 sq. ft. Submitted by: Brendan Brock Date: July 25, 2023 Office: Wilmington Narrative As acting agent for Dunlap Forestry, LLC who owns 49 Dare Street., adjacent to a man-made canal, in Ocean Isle Beach, Brunswick County NC, I am submitting the enclosed CAMA Major Permit application for modifications to their existing docking facility. This application is for the installation of a new 14' x 14' boatlift which will be located adjacent to the existing 6' x 30' floating on the westward end. A new 3' x 12' access pier will also be installed which will extend to a new 2' x 13' walk board adjacent to the boatlift for access. The boatlift will provide dockage for 1 additional vessel, creating a total of 3 slips at the property within existing water depths ranging from -2 to -3' @ normal low water (NLW). As proposed, the structures will not encroach into either of the adjacent 15' riparian corridor setbacks nor exceed the existing pier -head line and will not extend beyond the 1/ width of the waterbody which measures approx. 112' in this location. It was received complete on July 24, 2023 and appears to be adequate for processing at this tune. The projected deadline for making a decision is October 7, 2023. An additional 75-day review period is provided by law when such time is necessary to complete the review. If you have not been notified of a final action by the initial deadline stated above, you should consider the review period extended. Under those circumstances, this letter will serve as your notice of an extended review. However, an additional letter will be provided on or about the 75th day. If this agency does not render a permit decision within 70 days from July 24, 2023 you may request a meeting with the Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such a meeting will be held within five working days from the receipt of your written request and shall include the property owner, developer, and project designer/consultant. NCGS 113A-I 19(b) requires that Notice of an application be posted at the location of the proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed development. You should post this notice at a conspicuous point along your property where it can be observed from a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of- way fronting your property; or at a point along the road right-of-way where a private road would lead one into your property. Failure to post this notice could result in an incomplete application. An onsite inspection will be made, and if additional information is required, you will be contacted by the appropriate State or Federal agency.
