In preparation for our meeting tomorrow at 10:30a to review the Jordan Buffer statutes as it relates to our Edge project,
our consultant Amanda Jones pulled together the below and attached information from our meeting with the State on
May 11th confirming the current status.

Subject: Summary of 401 /Jordan Buffer Statues for the Edge
Adam,
Prior to the meeting tomorrow, I wanted to provide a summary of the laws /statutes that affect the permitting
options for The Edge Project. As you recall, based on our meeting with Ms. Jennifer Burdette on May 1 lth, she
informed us that because the project site encompasses both county and Town jurisdictions that delegation of
implementation of the Jordan Buffer Rules revert back to the Division of Water Resources (NCDWR). A copy
of Ms. Burdette's email confirming this is attached along with the statute (15 NCAC 02B with appropriate
section highlighted).
Also due to the fact that implementation/review of the proposed impacts to the Jordan Buffers is the
responsibility of NCDWR, the most recent session law (attached with sections highlighted) that was issued last
June allows a stream to be piped and subsequently impacts to the Jordan Buffer without mitigation provided a
Nationwide Permit is issued by the U.S. Army Corps of Engineers.
