Hi Joey,
1. Discussions with Ms. Sarah Kilby indicate that some modifications will be made to the project and an updated
PCN will be submitted. The Division is placing the application on hold until the updated information is
received. [15A NCAC 02H .0502(a)] To be discussed during our scheduled call tomorrow.
2. The Division requires that culverts be placed below the elevation of the streambed by 20% of the culvert
diameter for culverts having a diameter less than 48 inches to allow low flow passage of water and aquatic
life. Please clarify and include on plans whether this is proposed. [15A NCAC 02H .0506(b)] On the site plan
map ("Jurisdictional Determination Map with Proposed Site Plan") it is noted in the details that the
squash/arch culvert should be placed 1ft below the streambed (approx. 33% of culvert diameter).
3. The Division requires that all work in or adjacent to streams be conducted so that the flowing stream does not
come in contact with the disturbed area. The PCN identifies 40 feet of temporary impacts for dewatering
during culvert installation but doesn’t describe the proposed diversion system. Please include on plans the
design of any proposed diversion system or a note that work will only occur when the intermittent channel is
not flowing. [15A NCAC 02H .0506(b)] I will add a pump‐around/cofferdam to the site plan, however the
stream is flowing at less than 0.1cfs so I haven't specified this requirement in the past since for streams of
this size. If you have a different recommendation, I'd be glad to apply the measures you prefer for this
project.

On June 5, 2023, the Division of Water Resources (Division) received your application requesting a 401 Water Quality
Certification from the Division for the subject project. The Division has determined that your application is incomplete
and cannot be processed. The application is on‐hold until all of the following information is received:

Pursuant to Title 15A NCAC 02H .0502(c), the applicant shall furnish all of the above requested information for the
proper consideration of the application. Please provide your response by August 25, 2023. If all of the requested
information is not received, the Division will be unable to approve the application and it will be denied as incomplete.
The denial of this project will necessitate reapplication to the Division for approval, including a complete application
package and appropriate fee.
