On June 5, 2023, the Division of Water Resources (Division) received your applicaƟon requesƟng a 401 Water Quality
CerƟficaƟon from the Division for the subject project. The Division has determined that your applicaƟon is incomplete
and cannot be processed. The applicaƟon is on‐hold unƟl all of the following informaƟon is received:
1. Discussions with Ms. Sarah Kilby indicate that some modificaƟons will be made to the project and an updated
PCN will be submiƩed. The Division is placing the applicaƟon on hold unƟl the updated informaƟon is
received. [15A NCAC 02H .0502(a)]
2. The Division requires that culverts be placed below the elevaƟon of the streambed by 20% of the culvert
diameter for culverts having a diameter less than 48 inches to allow low flow passage of water and aquaƟc life.
Please clarify and include on plans whether this is proposed. [15A NCAC 02H .0506(b)]
3. The Division requires that all work in or adjacent to streams be conducted so that the flowing stream does not
come in contact with the disturbed area. The PCN idenƟfies 40 feet of temporary impacts for dewatering during
culvert installaƟon but doesn’t describe the proposed diversion system. Please include on plans the design of
any proposed diversion system or a note that work will only occur when the intermiƩent channel is not
flowing. [15A NCAC 02H .0506(b)]
Pursuant to Title 15A NCAC 02H .0502(c), the applicant shall furnish all of the above requested informaƟon for the
proper consideraƟon of the applicaƟon. Please provide your response by August 25, 2023. If all of the requested
informaƟon is not received, the Division will be unable to approve the applicaƟon and it will be denied as incomplete.
The denial of this project will necessitate reapplicaƟon to the Division for approval, including a complete applicaƟon
package and appropriate fee.
