The overall project area is located within 39 parcels located between East Rose Street to Sampson Street in the Duffyfield neighborhood, in New Bern (35.117256°N;-77.050464°W). The project is in the Neuse River basin and onsite waters drain to Jack Smith Creek. The Water Quality Classification for Jack Smith Creek is C;SW,NSW and the Stream Index Number is: 27-100. The cataloging unit for the site is 03020201. Proposed Project The goal of the City of New Berns innovative stormwater improvement project, Duffyfield Community Stormwater Enhancements, is to transform a community liability to a community asset by utilizing city -owned parcels and undevelopable, FEMA buyout repetitive -loss properties to create a community park. Phase 1 of the project is focused on enlarging the existing storage pond at the downstream end of the park and upgrading pump and outlet control systems. The pump station will discharge to a new 2,328 LF 12" diameter force main, flowing to the west, along the southern side of East Rose Street and discharging from a new stilling well on the north side of East Rose Street to an un- named tributary of Jack Smith Creek, south of the railroad tracks. The new stormwater outfall will replace the existing structure that is currently routed beneath the railroad tracks making maintenance difficult. Protect History WithersRavenel delineated the onsite wetlands and a ditch on May 20, 2020. A jurisdictional determination request was submitted to the USACE on November 15, 2022. Proposed Impacts The proposed impacts consist of 1,430 sf of permanent buffer impacts (Zone 1: 1,054 sf; Zone 2: 376 sf) and 1,582 sf of temporary buffer impacts (Zone 1: 803 sf; Zone 2: 779 sf) for construction of a stormwater discharge channel for Phase 1 of the project which is designed to provide overall stormwater improvements for the entire watershed. Avoidance and Minimization The proposed project requires installation of a stormwater outfall in order to convey stormwater from the overall stormwater project to surface waters. The existing outfall runs underneath the railroad bed making maintenance difficult. The proposed routing of the replacement line and outfall will eliminate these logistical maintenance issues. To discharge stormwater into the UT to Jack Smith Creek without erosive velocities, it is necessary to construct an outfall through riparian buffers. The impact area was sized according to need and was designed to minimize buffer impacts as much as possible. The stormwater infrastructure was routed in such a way to avoid additional buffer impacts while discharging in the desired location. Access to the site will be from uplands or existing roadways and erosion and sediment control measures will be implemented during construction. Mitigation The proposed project is an impact defined as a new drainage conveyance where the drainage area to the conveyance has no new built -upon area and is necessary for bypass of existing drainage. The proposed buffer impacts are "Allowable Upon Authorization" and do not require mitigation (15A NCAC 02B .0714 (9)(b)(ix)). This request is specific only to riparian buffer impacts for 1,430 square feet of permanent buffer impacts (Zone 1: 1,054 sf; Zone 2: 376 sf) and 1,582 square feet of temporary impacts (Zone 1: 803 sf; Zone 2: 779 sf) for construction of a stormwater outfall for the Duffyfield Community Stormwater Enhancement Project (Please see the attached documentation for details).
